Ringer’s Dark Dystopic Delusions

Worldnutdaily columnist Robert Ringer is concerned, terribly concerned, you see. His mind spins fantasies of dystopia, making him think that President Obama is going to use the violence in the Middle East to declare a state of emergency and cancel the election he is very likely to win.

But the third possibility is the one that worries me the most. Since Obama beat Mush McCain in 2008, I’ve been warning about the possibility of his declaring a phony state of emergency as an excuse to “postpone” the 2012 elections. In that vein, doesn’t it seem a bit too convenient that Iran has picked this particular time to raise the stakes with regard to its nuclear threat against Israel?

The far left, of course, would love a state of emergency and suspension of the November elections, and the right would be rendered impotent while frantically searching for their microscopic gonads. As Obama has already discovered, there are no consequences to his violating the Constitution with reckless abandon.

And when this doesn’t happen — and of course, it won’t — that fever swamp between his ears will simply conjure up another wildly paranoid nightmare to fear. And he’ll pretend that he hadn’t been proven wrong by years of absurd predictions.

    Out of interest what would be the threshold for delaying a presidential election? Given there was one in the middle of the civil war it must be pretty damn high, certainly higher than ‘disputes with Iran’ but are there any circumstances where it would be conceivable?

    Actually I think this tells you how far out Ringer is…

    I don’t keep up with Ringer so I don’t know what he has said specifically, but if I had to hazard a guess, he would say that if the right “had balls” they would have impeached Obama for …well something, blown up the debt ceiling just because, and declared war on Iran because they’re muslim.

    And from the right wing again before the 2000 election.

    And during the Reagan Administration, there were those on the left claiming not that Reagan would cancel the election, but use the a national emergency to have FEMA round up the lefists and sequester them in sports stadia. (Or is the English plural stadiums?)

    I don’t have any direct memory of previous Administrations.

    At least one person who was convinced of such defended their belief in Ed’s blog. After it didn’t happen, one person rationalized why they’d made such a conclusion. I don’t remember their rationalization for the latter, just that it occurred.

    An act of Congress, changing the date (and potentially specifying a person to be acting President if such date is after the expiration of the existing term). A ruling from the United States Supreme Court (due to whatever factors) that attempting to hold them at the statutory date would violate the Equal Protection Clause or otherwise be unconstitutional, or else violate some fundamental manner of basic Equity. Complete de facto failure of Federal authority, including of the President as commander in Chief of US military forces.

    Otherwise… pretty much no such thing.

    If any state looked like it was going to miss the election date required by 3 USC § 1, and the Supreme Court wasn’t on board, whatever reason was behind it would appear to constitute “unlawful obstructions” that “make it impracticable to enforce the laws of the United States in any State by the ordinary course of judicial proceedings” — and allow 10 USC § 332 to trump 18 U.S.C. § 1385. That looks like the President could then issue an executive order as Commander In Chief calling up the entire national militia — in effect, draft every able bodied male between ages 18 and 45 and put them under military command — to insure an election was held.

    Presumably, a functioning judiciary might moderate the response a bit from the most drastic, directing a minor delay.

    (The simultaneously missed House election actually seems a bigger problem, since if the Electoral College doesn’t decide the Presidential election, it falls to the House.)

    Except Iran hasn’t really chosen to do anything unusual lately. The increasing heat is all coming from the Israeli and American right wings.
