Klayman Calls for Military Coup Against Obama

Larry Klayman, the dumbest lawyer in America not named Mat Staver, was on an American Family Association radio show with Tim Wildmon on Monday and he called for the military to rise up and remove President Obama from power. At what point is this open sedition? At what point do they start arresting people for this?

    If there was any chance that someone of authority in the military might actually listen to him, then I would agree that charges are warranted. Otherwise, arresting him just vindicates the obligatory persecution claims and lends more credence to his view than it deserves.

    OTOH, I would hope Homeland Security is keeping an eye on him. He isn’t dangerous now but he is a wannabe dangerous kook.

    The scope of the Smith Act (which is the only thing you could really hope to convict him on) was so restricted (and properly so!) by Yates v. United States and a few similar cases in the 1950s that convicting Klayman for saying the military should overthrow the government would be impossible, and arresting him would probably be a violation of 42 USC 1983.

    To be fair, Obama is also a Democrat. Yes, his skin color (much like Hillary’s sex) adds another ugly dimension to those opposed to his administration, but the opposition starts by party rather than by tone.

    I don’t think I can recall another time when Ed has slipped from his Free Speech absolutist stance. It’s somewhat disappointing.

    I believe sedition and a generalized threat against the country is the FBI’s problem. A credible threat to the President as an individual would be DHS’s problem (because the Secret Service is part of DHS). I don’t think he’s made any such threat, so no, DHS is probably not keeping an eye on him. Though like Eric Cartman, Klayman probably enjoys the thought of the goverment keeping a huge thick file on him, because its narcissistic.

    As far as I know, sedition is still a crime. But it isn’t likely that Klayman will be prosecuted. He isn’t adding anything new to the views of his audience, unseating Obama and undermining his legitimacy has been the goal of the right even before he was sworn in, and even a hinted threat of prosecution would benefit him by raise his profile and standing.

    As we were watching the reports about the climate change march in NYC, I remarked to my hubby that it is quite amusing that when the RWNJs like Klayman call for millions of their followers to congregate in DC, tens of them show up, but when progressives call for a march 300K-400K show up.

    I’ll bet that Klayman is gnashing his teeth about that.

    We in the USA already do have a way to remove politicians we don’t like or agree with. It’s called voting. That democracy thing.

    Ed, I suggest reconsidering your position here. I don’t think you can defend it very well.

    Context is important where from my perspective, Klayman’s rhetoric in this context should be protected, helps the cause of liberalism when we do point out such speech and then ridicule it, and demand such speech be defended.

    @32 – I think it’s still the Secret Service. IIRC it was part of the legislation that set them up that they do that, so as they move around, the responsibility for counterfeit investigation goes with them.

    AIUI the exact same thing happened with the US Coast Guard and the (separate example) US Immigration service, now called USCIS: when they moved over to DHS, all their authorities and legislated responsibilities came with them.
