Bigot: Call Out National Guard to Stop Marriage Equality

Even by Christian right standards, Randy Thomasson of the group Save California is a particularly virulent bigot. In a memo to other “pro-family” (read: anti-gay) leaders, he argues that governors whose bans on same-sex marriage have been overturned by the courts should call out the National Guard and continue to enforce those laws.

Each governor pledges themselves to “support and defend” the plain words of their state constitution, including, in morally conservative states, the definition of marriage as only for a man and a woman. Governors raise their right hand and publicly promise to “faithfully execute” (or carry out) these written laws, as commanded by their state constitutions.

Each governor also has an administration that serves his/her pleasure that is in charge of the state’s marriage forms (licenses and applications) that county clerks use.

And each governor is authorized to call out his/her state’s militia or National Guard to enforce written laws and maintain public order against foreign and domestic enemies…

Given these facts, it is state governors that are unfortunately allowing homosexual “marriages.” And given their constitutional and statutory powers, it is not good enough for governors to merely protest by appealing to a higher court the unconstitutional opinions of bad judges…

In view of the current crisis on marriage, a constitutional governor can and should do the following:

• Announce he took an oath to obey the constitution, not to obey a judge’s unconstitutional opinion.

• Announce that no homosexual “marriage” licenses will be issues, and no county clerk is permitted to issue marriage licenses to anyone other than a qualified man and woman.

• Utilize the support of the state attorney general (if that constitutional officer is willing to stand alongside) or use the state’s National Guard to enforce the law at county clerk’s offices.

Thomasson in 1967: Governors should call out the National Guard to prevent interracial couples from marrying.

Thomasson in 1954: Governors should call out the National Guard to prevent black kids from going to white schools.

Thomasson in 2003: Governors should call out the National Guard to keep putting gay people in jail.

    More seriously, reading Thomasson’s writing (and just about any anti-gay bigot) reveals an abject terror. Why call for military intervention unless he’s shitting bricks? Where does that come from?

    Since he’s from “Save California” (started in the Prop 8 dust-up, I’m sure), he should be lobbying Jerry Brown to call out the Guard. You could probably hear the laughter all the way from Sacramento to Los Angeles.

    Well, because that wouldn’t be true; we’re a nation of laws. Per 10 USC 334, the President has to issue a Proclamation To Disperse first.

    After that, however, the president not only can take whatever measures as he considers necessary to suppress any opposition or obstruction of the execution of the laws of the United States and any impediment to the course of justice under those laws, but he is obligated to do so by that law.

    Or in short — Proclamation first, then whatever he wants.

    If the county clerks in California report to anyone, it’s the AG, not the Governor. But then…Kamala Harris won’t lift a finger to help him any more than Jerry Brown would. (And for those not up on California political news…since Boxer said she’s not going to run for Senate again in 2016, Harris has said that she will. It’s going to take a pretty damned good candidate to shift my vote away from Harris…)

    And is Barack Obama likewise allowed to ignore court decisions? Say, any ruling against Obamacare?

    Correction there. Even the north accepted the right of the south to seceed. They didn’t need to have the guard out to protect their rights.

    Personally I’m glad that that the general in charge of the forces around Sumter decided to smash the south with the idiotball he was holding.

    P.s: Should see those Confederacy defenders react when you explain to them that it was the war of southern aggression, not as they like to claim the war of northern aggression
