Wingnuts Flip Out Over Possible Investigation of Muslim Ban

A few days ago, a bigot gun fetishist from Florida declared his gun shop to be a Muslim-free zone and now the wingnutosphere is flipping out about a possible DOJ investigation. Not that there is such an investigation at this point, but that’s no reason not to declare that Obama has taken “sick revenge” on the gun shop owner.

In response, President Barack Obama’s Department of Justice announced that it would launch a civil rights investigation into Hallinan’s establishment…

It’s past time for patriots like Hallinan to step up and speak their consciences. If his words are truly intolerant or, as Obama himself might say, on the wrong side of history, then the free market will prove that out by negatively impacting Hallinan’s bottom line as consumers choose to stop doing business with him.

But that is probably not the case — and the Obama Justice Department may actually feel pressure to intervene before the free market proves who really is on the wrong side of history.

No, actually the DOJ has not announced such an investigation at all. The only thing the DOJ has said, in response to a question from the Daily Dot, is that they will consider the complaint filed by CAIR when they receive it. That’s it. But why let pesky facts get in the way of a perfectly good rant, amirite? Of course, if the DOJ does launch an investigation it would be because the gun shop is violating federal law (and state law, for that matter) with the ban on Muslims. Title II of the Civil Rights Act clearly forbids businesses from discriminating on the basis of religion. But again, those are facts, something wingnuts are allergic to and uninterested in.

    You say this every time a Patriot refuses to kowtow to some Muslin’s Civil so-called “Rights”, but you have to remember that Islam isn’t a religion. It’s a political, social and economic ideology.

There are plenty of right-wingers in America who hate Muslims so much that they’d be more likely to patronize a business that discriminates against Muslims.     The problem here is that there will always be some uncertainty about how quickly Muslims can acquire guns from gun stores. But we don’t want the smoking gun to be a smoking gun.

    Pls note that Hallinan’s Fine Shootin’ Irons and Hatred, Inc, does its business within Inverness, FL, a town of approximately 6,789 residents.

    Inverness serves as the county seat of Citrus County, FL, home of >140K proud Citrus Countians, all about a hour’s drive north from Tampa or a bit less southwest from Ocala. Tampa happens to have a sizable Muslim community, while the Ocala area, horse-ranch country, includes many fine Arabians. I rather doubt that either group comprises much of Hallinan”s market base. Quite possibly, some rootin-tootin redwhitenblue Christian American Patriots™ have made the trip just to do business with Brother (“not ‘Bro’!”) Hallinan in tribute to his bravely politically-incorrect announcement, and will do so again if he shows he has the guts to Stay the Stupid.

    No he shouldn’t be permitted to break the law but I wish the smackdown would come from the State of Florida rather than the feds, just for the optics. If FL does it, it looks like locals policing locals, and the smackdown won’t produce much sympathy in the surrounding population. If DOJ does it, it looks like carpet-bagging northerners imposing their unwanted bohemian way of life on good ‘ol southern boys. Much more likely to provoke sympathy.

    Title II (42 USC § 2000a) forbids public accommodations from such. That is enumerated to include any establishment which provides lodging to transient guests; any principally engaged in selling food for consumption on the premises; any gasoline station; any place of exhibition or entertainment; and any establishment having one of those in it, within one of those, or holding itself as serving patrons of the above. (Some exceptions make that overbroad.) While a vicious prosecutor might try to bodge one in as a “place of entertainment” along side movie theaters, it would seem that the letter of the law means a gun store isn’t a public accommodation. (A gun range might be, but I expect many are members-only clubs that fall in one of the exceptions.)

    Which would seem to imply that if an atheist with gobs of money to burn wanted to raise some trouble, they could open a gun shop, and then refuse to serve Christians.
