That was based on 1973 medicine and judicial imaginings. Today, babies are being saved as early as 21 or 22 weeks into pregnancy. But we still live under the law created by the Supreme Court which set viability at 26 weeks.
After 26 weeks, doctors can still do abortions if they decide the mother’s life or health is at stake. In actual practice, that means that abortionists kill babies right up to the day of birth.
Dr Kermit Gosnell ran an abortion clinic that prosecutors described as “a chamber of horrors.” Dr Gosnell is now in prison. But he was not sent to prison for running a chamber of horrors. He is in prison because a few of the babies he killed lived through the abortion and he killed them afterwards.
The takeaway of the Gosnell verdict for the abortion industry is not to stop killing late-term babies. Based on all the pushback in Texas, it’s also not to provide standard medical care during abortions. Rather, it is to make absolutely, no-doubt-about-it-sure that the baby is dead before it is delivered.
Killing a baby while it’s inside its mother’s body is not a crime. Killing the same baby when it’s separate from its mother is murder.
In today’s tragic world, the right to life is defined by geography.
This Live Action video is of a doctor and counselor discussing an abortion on a woman who is 27 weeks pregnant.
Think about it: Twenty-seven weeks. That is a viable child, even by 1973 standards.
To top if off, they are telling the young women that she will go through labor alone in a hotel room. They even give her instructions about what to do if she delivers the baby while she’s on a toliet.
They blithely assure her that going through labor and delivering alone in a hotel room is safer than giving birth in a hospital under ideal medical conditions.
How does this benefit the woman? In what way is it medically necessary? If there was a medical reason to stop the pregnancy at 27 weeks to save the mother’s life, it would be far safer and better for her to deliver her baby in a hospital with pain-killing medication and to also provide medical care to save the life of her baby.
Should abortion clinics be exempt from the health care requirements of other surgical centers? That is the argument pro abortion people make, and they make it in the name of “women’s health.”
That is not feminism. It is not in the interest of women’s health. This child could and almost certainly would live if it was delivered properly, so it certainly is not in the interest of the baby.
Who and what do late-term abortions serve except the demons of death?

I’ve written before that Dr Gosnell is the monster that pro choice built.
Dr Gosnell is the recently convicted serial killer/abortionist who operated what some people have described as a “chamber of horrors” in Pennsylvania.
I knew I would catch some flak for saying that, and I did. But I had said it advisedly, based on my experience on both sides of the abortion wars. I knew what I was talking about.
We are seeing the dynamic I referred to acted out once again in Texas; pro choice people are going over the top to fight the regulation of abortion clinics in the name of “women’s health.”
About a week ago, Senator Wendy Davis of the Texas State Senate engaged in a 13-hour filibuster that resulted in a legislative train wreck for a good piece of pro life legislation. Her actions, along with some filibustering from the Senate gallery, effectively killed a bill that would have required that:
1. Abortion clinics provide the same kind of patient safety as any other ambulatory outpatient surgical center,
2. Doctors who perform abortions in clinics must have hospital privileges at a hospital that is within 30 miles of the clinic,
3. Abortion clinics provide their patients with a phone number which would be answered 24 hours so that they can call for medical follow-up to their abortions,
4. Abortion clinics give women the name and phone number of the emergency facility nearest to her home where she can go for medical care in the case of an emergency after her abortion,
5. Doctors, and not staff, prescribe drugs for a chemical abortion according to FDA guidelines, and that the drugs for chemical abortions may not be dispensed until after the prescribing physician has examined the patient and determined that she is not carrying an ectopic pregnancy.
6. Doctors who perform abortions who prescribe drugs for a chemical abortion also provide follow-up care, including a follow-up examination by the physician to determine that the abortion is complete and a 24 hour phone number in case the woman needs questions answered.
7. Doctors who perform abortions must report adverse affects caused by drugs used in chemical abortions to the FDA according to FDA guidelines.
These are the “outrageous” regulations that pro choice people are demonstrating to stop. In my humble opinion, there is not one thing on this list of requirements that even the most pro choice person would not want for their daughter if she was undergoing an abortion.
Doctors who do abortions — which are a surgery — should have hospital privileges?
Abortion clinics — which are outpatient surgical clinics — should comply with the same health and safety regulations that every other outpatient surgical clinic does?
Abortion docs should examine their patients before surgery and follow up with them afterwards? They should report side effects of the drugs they prescribe to the FDA? They should make sure that women they give abortion-causing drugs aren’t carrying an ectopic pregnancy, when giving those drugs to a woman who is carrying an ectopic pregnancy can cause her to bleed to death?
These regulations are exactly what anyone who is interested in “safe, legal” abortions should want. Frankly, I think the pro choice people should thank the pro life legislators who are pushing this bill for cleaning up their dirty little industry.
However, the pro abortionists have pulled out all the stops to kill this bill, including misrepresenting it to their own followers. I doubt very much that the many “pro choice” people in this country who are buying the stuff the abortion industry is putting out about this legislation actually know what the bill contains.
If they did, most of them would favor the legislation. Frankly, anyone who favors “women’s health” should favor this legislation. But they’ve been conditioned for many decades by the constant drum beat of pro abortion extremists to believe any stupid thing those extremists say. There is little actual thinking that goes into the positions they take on abortion.
I would imagine that even most of the legislators who oppose this bill think they are doing it because if they don’t women will be “sent to the back alleys.”
The Texas legislature can not overturn the United States Supreme Court. Roe is not in danger. What is in danger is the lives of the young women who go to clinics that are protected from providing good medical care by abortion zealots who are so caught up in their cause that they don’t have a genuine thought in their heads.
I read this morning that there are plans for celebrities to come to Texas and speak against the bill. The whole thing has turned into a cause celeb, both literally and figuratively. After all, it turns out that many of the clinics in Texas will have to close because they can’t comply with operating like regular outpatient surgical clinics do.
They want, they demand, that they be exempted from providing good medical care to women because if they do have to provide the same level of care that other outpatient surgical clinics provide, it will endanger women’s health.
Does anyone know who’s on first?
What are we making sure of?
That women’s doctors are free to not follow up with them, don’t have to provide the same health and safety for them that they would for any other surgery, don’t need to examine them before doing surgery on them or administering dangerous drugs to them, and … get ready for this now … don’t even have to have hospital privileges at a nearby hospital.
That’s “women’s health,” abortion style.
Remember Dr Gosnell and his chamber of horrors? This kind of folderol is exactly how pro choice built that monster.
They fight against any and all pro life legislation on the grounds that even safety standards “narrow” Roe. They tell poor deluded women that if laws like this one pass, they will be “forced into the back alleys” again.
So what happens to the women?
A lot of them end up suffering harm that would have been prevented by better medical care. I’m not even talking about what happens to the baby here. I am talking solely about women’s health.
I had to have a couple of surgeries last year. I came home the same day after both of them. Neither of them was as risky as poking around in a pregnant uterus.
I can tell you that I wanted a doctor with hospital privileges holding the knife when he went to work on me. I wanted him to examine me beforehand and make sure that he knew what he was doing and that I was a good candidate for the surgery. I wanted health and safety standards dutifully enforced in the place where he did this surgery. I would have been outraged if I had learned that I was on my own after the surgery with no support or follow up if something went wrong.
Nobody anywhere was out demonstrating for the doctor who cut into my foot to be free to practice dirty medicine, not have hospital privileges and dump me after the surgery. Not one person thought it was outrageous or a violation of my rights that my doctor was required to practice competent medicine on me.
But if I had been a woman who was seeking an abortion, they would have been jumping up and down, demonstrating, filibustering, importing celebrities to defend my “right” to incompetent medical practices.
That’s how pro choice built Dr Gosnell and his chamber of horrors. It’s how they endanger women’s lives all over this country.
Look at this carefully and tell me: What’s wrong with this picture?
This video is from this legislative session in Florida. It reflects the current attitude of Planned Parenthood concerning babies who are born alive during late-term abortions.
That’s the same Planned Parenthood we seeing throwing Dr Kermit Gosnell under the bus and condemning the very practices they paid a lobbyist to protect just a few weeks ago. I’ve written that Dr Gosnell is the monster pro choice built. Actions like the one in this video are how they built him.
Dr Gosnell only did what this lobbyist was working to protect. He was the physician. His patient had already voted that the baby should die by coming to him for his services. The Planned Parenthood lobbyist’s contention that the “decision” of what to do with a baby born alive during abortion “should be left up to the woman, her family and the physician,” was pretty well covered; the lobbyist’s oddball insertion of “her family” into the decision-making process notwithstanding.
So, what’s so bad about Gosnell?
Dr Kermit Gosnell accepted a deal in which he received life in prison without parole in exchange for giving up his right to an appeal.
He will be sentenced Wednesday for the third conviction, which is for involuntary manslaughter.
I think this is a good deal for everyone involved. I doubt that the 72-year-old Dr Gosnell will be busting out of prison to kill more people the way Ted Bundy did. By forfeiting the right to appeal, he will almost certainly have to do the time.
From CBS News:
Kermit Gosnell Update: Convicted Pa. abortion doctor gets life in prison
“They” are spinning the Gosnell verdict as best they can.
“They’ve” filed lawsuits against pro life legislation. “They’ve” lobbied — often successfully — to kill bills that would require abortionists to have hospital privileges, to give women informed consent before performing an abortion, to require parental notification before doing an elective abortion on a minor. They’ve fought bills that would allow the state to file murder charges on the life of the baby as well as the mother when a pregnant woman is murdered.
I could go on. And on. With the exception of requiring abortionists to have hospital privileges, the things I’ve just described happened with bills that I authored and that became law in Oklahoma. Abortion advocates fought these bills and then attacked me viciously for having authored them. I could easily multiply these things out to cover every legislature in this country.
Based on this, I believe that “they” do not want any limits on what an abortionist can do to babies, or for that matter, to women. So, it wasn’t any big surprise to me when “they” chimed in with non-sequitur verbal claptrap after the Gosnell verdict today. Their comments today were just an extension of the blab they’ve been blabbing throughout this trial.
Basically, “they” are saying that pro life people are the reason Dr Gosnell was able to commit these crimes. This kind of “who’s on first” sophistry is shameless. “They” don’t care how ridiculous it sounds. “They” know that their faithful followers in the media will buy it and sell it like the kool-aid it is.
Who are “they?”
The big-name abortion advocates Planned Parenthood and NARAL Pro Choice America. Here are their comments about the Gosnell verdict today. I am publishing the full statements:
Full statement from Ilyse Hogue, president of NARAL Pro-Choice America, on the conviction of Kermit Gosnell:
“Justice was served to Kermit Gosnell today and he will pay the price for the atrocities he committed. We hope that the lessons of the trial do not fade with the verdict. Anti-choice politicians, and their unrelenting efforts to deny women access to safe and legal abortion care, will only drive more women to back-alley butchers like Kermit Gosnell.
“From the lack of funding available for low-income women to access abortion services, to the sharp decline of reputable providers in Pennsylvania, to the gross negligence of authorities to enforce the law after complaints were filed against Gosnell, each aspect of this case must be a teachable moment for lawmakers: until we reject the politicization of women’s medical care and leave these decisions where they belong — between a woman and her family and her doctor — women will never be safe. The horrifying story of Kermit Gosnell is a peek into the world before Roe v. Wade made legal a woman’s right to make her own choices.
“NARAL Pro-Choice America’s annual Who Decides? publication has given Pennsylvania an ‘F’ grade precisely because it has passed medically unnecessary laws that restrict access to safe and legal abortion care. It is my sincere hope that the women in Gosnell’s clinic did not suffer in vain and that Pennsylvania, and every state, will step up and join us in making the protection of women’s ability to get, safe, high quality, and legal abortion care a top priority.”
Dr Kermit Gosnell stands convicted of 3 counts of first degree murder.
The charges stem from the deaths of babies that were born alive at Gosnell’s late-term abortion clinic and then subsequently killed by Dr Gosnell and members of his staff. According to testimony in his trial, Dr Gosnell most often murdered these babies by cutting their spinal cords through an incision in the backs of their necks.
The sentencing phase of the trial is still ahead. Prosecutors have said that they will seek the death penalty.
I’ve held off about making direct comments about Dr Gosnell because of the on-going trial. I’m going to continue that policy until after he is sentenced. However, I will make one small exception:
This verdict acknowledges something very important. By convicting Dr Gosnell of first degree murder, the jury has said that these babies were human beings. The misapprehension that any child before birth or even shortly after birth is not, in fact, a human, is what led to the things Dr Gosnell did.
This lie is what allowed Dr Gosnell to walk the gray area in the law for so long. I know from personal experience the lengths “pro choice” people will go to stop any regulation or limitation on the “right” to abortion. They are perfectly willing to endanger women’s lives with substandard and dangerous medical practices to protect abortionists.
In the case of Dr Gosnell, the militant opposition to anything that limits the rights of abortionists to kill at will has finally crossed a bridge too far. The simple acknowledgement that a baby that survives an abortion is a human being has entered a courtroom and a jury has agreed that the baby is a human being who may not be killed with impunity.
You cannot have a verdict of murder in the first degree unless 12 people agree that a human being has been deliberately killed with premeditation. “Things that will one day become human beings” do not have the dignity of having their deaths called murder.
I am going to save the rest of my thinking about Dr Gosnell and what he did for another time. I do not want to contribute in any way to an atmosphere that might be called prejudicial.
Let the system work.
Then, we’ll talk about it in detail.
From the New York Times:
PHILADELPHIA — Dr. Kermit Gosnell, a West Philadelphia doctor known for performing late-term abortions, was found guilty on Monday on three of four counts of first-degree murder.
The verdict came after a five-week trial in which the prosecution and the defense battled over whether the fetuses Dr. Gosnell was charged with killing were alive when they were removed from their mothers.
Prosecutors have said they will seek the death penalty when the trial moves into the sentencing phase on May 21.Dr. Gosnell, 72, wearing a dark suit, showed no emotion as the jury foreman read the verdicts on the 10th day of deliberations.
Before the foreman spoke, Dr. Gosnell smiled at his lawyer, Jack J. McMahon, and shook his hand. Read the rest here.)
Kermit Gosnell isn’t the only late-term abortionist in this country.
Most of us know about Gosnell/Tiller/Carhart. What we don’t realize is that many of our hospitals push late-term abortions on women for a variety of reasons. Any pregnant woman can fall prey to this. All she has to do is be pregnant with a baby that might have some sort of problem. The pressure intensifies if she’s doesn’t have money.
I’ve heard these stories from the women themselves and from hospital personnel, particularly nurses and hospital chaplains. Doctors bully, badger women into submitting to late-term abortions. The presumption seems to be that any baby that might have a health problem should be killed and women who refuse to do this are out of line and irresponsible.
The irony is that there is no reason to do a late term abortion.
This is a Live Action video of an undercover person talking to a doctor about late-term abortions.
There is no reason for late-term abortions.
Abortion supporters are fond of saying that people like Dr Kermit Gosnell, the late Dr George Tiller and Dr LeRoy Carhart perform a “necessary service” for “desperate women” when they “provide” late term abortions.
Not even close to being true.
There is no reason for a late-term abortion. None. Zip. Zilch.
The legislators I work with, and (I would guess) much of the general public, lives in a fantasy land about abortion. They seem to think that an elective abortion involves a preternatural procedure where the doctor waves a medical magic wand over the pregnant woman and — poof! — she is no longer pregnant.
In their self-consoling dream world, abortion is just a re-wind that doesn’t put women through a surgery or, in the case of late-term abortions, a labor and delivery. All they will allow themselves to think that happens with “safe, legal abortion” is that the woman pays her money and is, through a miraculous medical intervention, made unpregnant.
In this fantasy world, there are no dismembered little baby bodies and their scrambled parts to reassemble and check to make sure the abortion is complete. In fantasy abortions, women do not experience pain during the fantasy procedure and danger is non-existent.
This “thing” that will one day “become a baby” is not a human being. In the cowardly imaginations of those who won’t face facts, no one suffers, no one dies, and in fact, nothing much happens in an abortion. It’s all painless, deathless problem solving for problems they don’t want to actually solve.
That’s where most of the resistance to pro life legislation lives. It is a product of convenient lies that allow people to do monstrous things and keep their own mental skirts clean, at least so long as they box themselves off from reality and never know the truth.
This nonsense about “necessary services” for “desperate women” concerning the work of Gosnell/Tiller/Carhart is fantasy carried to the point of deliberate delusion.
Let’s stop for a moment and try thinking about the reality rather than the fantasy.
Late-term abortion refers to the deliberate killing of babies whose mothers are far along in their pregnancies. That’s where the phrase “late-term” comes from. What does that mean? It means that the baby looks like a baby, acts like a baby, sounds like a baby and, if it’s born at this point, would have a fighting chance of living like a baby.
Late-term abortions are performed on women who advanced months into their pregnancies before their “desperation” set in. This “service” requires that the women be put through horrific medical procedures that involve giving them large doses of contraction-stimulating hormones to induce unusually violent and painful labor and delivery. A nurse who assisted in these things told me that the doctors they worked for deliberately stimulated contractions so violent that the contractions would usually kill the baby while it was being born.
Aside from what this does to the baby, what do you think it does to the woman? The grisly and illegal procedure we call “partial birth abortion” requires that the baby be delivered feet first, then the delivery stopped so that the doctor can suction out the baby’s brain before it is legally born. Proponents of this procedure talked about how it was necessary for “women’s health.” But I ask you, aside from what it does to the baby, what do you think that does to the woman? How is that consistent with “women’s health?”
I’m not talking about her emotions here. I am talking about labor and delivery practices that are painful, dangerous and quite horrible for the woman. How is this something that protects “women’s health?”
The answer is, it doesn’t.
In addition to what this does to the woman, consider for a moment that many of these babies must be deliberately killed before the procedure takes place to keep them from being born alive. The way I’ve heard that this is usually done is to give the baby a shot of poison directly into its heart. This means jabbing a needle through the mother’s abdomen and into the baby. It means the mother has to feel her baby thrash around the avoid the needle, then feel it die. All this is done to keep the legal fiction that this late-term abortion is not, in fact, a cold-blooded murder.
In spite of this, many of these babies are born alive. The doctor might miss the mark and not shoot the poison into the baby’s heart. Or, the dose might be too small. Or, the doctor doesn’t administer the death-dealing drug and the baby is strong enough to survive the excessively violent contractions the doctor puts the mother through.
However it happens, babies do manage to survive these deliberate attempts to medically murder them and are born alive. When that happens, what does a doctor do? For decades, they killed these babies. Changes in the law now require them to administer medical care to the babies, but as we’ve learned, that doesn’t always happen.
How does all this support my contention that late-term abortion is never necessary? What about abortion to save the mother’s life?
The answer is so obvious it’s hard to believe people don’t see it.
If the woman is going to have to go through a labor and delivery anyway, there is no reason whatsoever to kill the baby. If the mother’s life is at stake, all that needs to be done is deliver the baby. Then, do your medical best to save both the child and its mother.
There is no reason to kill these babies. There is no medical reason. No moral reason. No situation that requires it.
In some instances, late-term abortions are performed on very young girls. Proponents don’t argue their case, because they don’t have one. They simply point to the young girl and yammer about how can anyone “force” her to have a child. Their whole argument is based on the magic rewind fantasy abortion.
It ignores the fact that a late-term abortion will put the young girl through a much harsher labor and delivery than she would experience if she received life-saving medical care designed to save both her and her baby. It ignores the reality that the baby is already here. There is a child.
All late-term abortion does is kill the child. It does not save the mother anything. It is not “necessary” and it is not done to “save” “desperate” women.
There is no reason for late-term abortion.
Pro life bloggers and tweeters have raised public awareness of the trial of Dr Kermit Gosnell, the late-term abortionist who is on trial for murder. It appears that the media is beginning to respond to this pressure with increased coverage.
However, when I asked the question earlier this week, Public Catholic readers told me they had seen coverage back when Dr Gosnell was first arrested. I did some looking around and turned up this incredible video by Katie Couric.
I’ve spent years working to pass pro life legislation. Much of this legislation involved trying to get true informed consent, parental consent and sensible regulations of clinics. The so-called pro-choice movement has fought every single one of these bills. Each time, they claim that the bill will “drive women back to the back alleys.”
My question: How is the “back alley” any worse than Kermit Gosnell and his chamber of horrors? I knew women who had illegal abortions back before Roe. None of them went through anything as bad as what is described here.
I am not advocating for abortion, either legal or illegal. What I am saying is that the obsessive pro-abortion attitude of our society has led to the empowerment of monsters who prey on women and subject them to “medical” care that is actually worse than the situations they use to justify their position.
There are many reasons why the media has ignored this story. One of them has to be the fact that they have been complicit in creating this situation with their blind defense of abortion, all abortion, under any circumstances, for any reason. They claim that they are doing this for women, but Dr Kermit Gosnell’s chamber of horrors puts that claim in question.
Before abortion was legalized, proponents promised us a world where crime rates, drug addiction, child abuse would all drop due to the fact that every child would be “wanted.”
They also promised us a world where women no longer would endanger their lives because of dehumanizing back-alley abortions.
The message of Dr Gosnell’s unreported trial is, wrong again.
I think there are many reasons why the pro choice media has tried so hard to ignore this story. I would guess that chief among them is the reality they won’t admit: Kermit Gosnell is the monster they helped build.
