After spending months in jail since his charity<\/a> was shut down by federal authorities on terrorism concerns, Rabih Haddad will get his day in (open) court. A federal judge ordered<\/a> the Justice Department to charge or release Haddad on Sept. 17th. \u201cAn open hearing will assure the public that the government is honoring the very principles that the terrorists sought to destroy,\u201d said US District Judge Nancy Edmunds. The decision was quickly praised<\/a> by Haddad\u2019s wife and supporters, who had been decrying the closed hearings and secret evidence<\/a> used against Haddad, tactics strengthened by last year\u2019s PATRIOT<\/a> Act. Although the Justice Department is not pleased with the decision (calling it \u201can unwarranted intrusion\u201d), it granted the open hearing<\/a> anyway on October 1st. Well, it\u2019s sort of open\u2026 the Department may \u201cclose those portions \u2026where sensitive information will be introduced which could prove valuable to terrorists seeking to harm America\u201d (a box cutter sale at Office Depot<\/a>, perhaps?). And despite granting the hearing, the Department will appeal<\/a> the decision, ex post facto. Meanwhile, Haddad claims he\u2019s no security risk<\/a>, a preparation for his possible release. Supporters still consider this a victory. \u201cAbuse flourishes in secrecy,\u201d says Mary Bejian of the ACLU. \u201cWe can\u2019t have a democracy without openness.\u201d<\/p>\n
