{"id":2972,"date":"2009-03-15T19:00:20","date_gmt":"2009-03-15T23:00:20","guid":{"rendered":"http:\/\/www.patheos.com\/blogs\/altmuslim\/?p=2972"},"modified":"2019-05-15T00:58:17","modified_gmt":"2019-05-15T04:58:17","slug":"the_long_march","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/altmuslim\/2009\/03\/the_long_march\/","title":{"rendered":"Pakistan&#039;s judiciary: The long march"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><table cellpadding=\"0\" cellspacing=\"0\" border=\"0\" align=\"right\">\n<tr>\n<td><img decoding=\"async\" src=\"https:\/\/www.altmuslim.com\/ee_images\/pakistan_march.jpg\" border=\"0\"><\/td>\n<\/tr>\n<tr>\n<td align=\"right\">\n<div class=\"caption\">Check, meet balance<\/div>\n<p><\/p><\/td>\n<\/tr>\n<\/table>\n<p>The \u201clong march\u201d to Islamabad undertaken by thousands of Pakistani lawyers and activists advocating for the restoration of an independent judiciary represents a resounding call for democracy amidst Pakistan\u2019s political volatility and oppressive rule by President Asif Zardari teetering it towards chaos. <\/p>\n<p>Due to corrupt, ineffectual leadership \u2013 a role admirably played by Zardari \u2013 and a series of military dictatorships \u2013 most recently exemplified by General Pervez Musharaff \u2013 Pakistan\u2019s Constitution and democratic processes seem as malleable as Play-Doh putty.<\/p>\n<p>In 2007, Chief Justice <a href=\"http:\/\/en.wikipedia.org%2Fwiki%2FIftikhar_Muhammad_Chaudhry\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Iftekhar Chaudhry<\/a> \u2013 one of the most respected and popular personalities in Pakistan \u2013 challenged Musharraf\u2019s <a href=\"http:\/\/www.guardian.co.uk%2Fworld%2F2007%2Fnov%2F04%2Fpakistan.declanwalsh\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">autocratic decision<\/a> to run for President while remaining Chief of the Army.  Musharaff declared <a href=\"http:\/\/www.guardian.co.uk%2Fworld%2F2007%2Fnov%2F04%2Fpakistan.declanwalsh\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Martial Law<\/a> and unilaterally removed Chaudhry along with 60 other judges. The U.S. ally in \u201cThe War on Terror\u201d suspended the Constitution and the Parliament, shut down independent TV stations and arrested thousands of activists, dissidents and lawyers.<\/p>\n<p>Zardari rode the \u201cdemocracy card\u201d promising several times to immediately reinstate Chaudhry if elected. However, Zardari also received a Christmas present in 2007 with a loathsome piece of Machiavellian legislation entitled the <a href=\"http:\/\/www.nytimes.com%2F2008%2F03%2F11%2Fworld%2Fasia%2F11pstan.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">National Reconciliation Ordinance<\/a>. Chief Justice Chaudhry initially moved to suspend the unlawful Ordinance, which was subsequently signed into power by Musharaff, granting amnesty to politicians, bureaucrats and political workers accused of corruption, embezzlement, money laundering, murder and terrorism. No wonder Zardari, a convict with <a href=\"http:\/\/www.guardian.co.uk%2Fworld%2F2008%2Fsep%2F22%2Fpakistan\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">major corruption charges<\/a> pending in four countries in 2007, never kept his promises thus prompting the \u201clong march\u201d and protests engulfing the country.<\/p>\n<p>Presently, the increasing instability of Pakistan, which <a href=\"http:\/\/www.telegraph.co.uk%2Fnews%2Fworldnews%2Fasia%2Fpakistan%2F3226857%2FPakistan-may-take-IMF-aid-to-avoid-bankruptcy.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">barely avoided<\/a> bankruptcy, faces rapid <a href=\"http:\/\/belfercenter.ksg.harvard.edu%2Fpublication%2F18537%2Ffrom_fata_to_the_nwfp.html\" class=\" decorated-link\" target=\"_blank\">Talibanization<\/a> of the Federally Administered Tribal Areas (FATA), and suffers from increased suicide bombings and terrorism, has effectively removed Zardari\u2019s Cheshire grin forcing him to use Musharaff\u2019s 2007 \u201cState of Emergency\u201d playbook.<\/p>\n<p>In the surreal soap opera that is Pakistani politics, history now presents itself as a rerun.<\/p>\n<p>Zardari recently allowed the police to arrest nearly 700 protestors in Punjab, detain nearly 450 opposition party workers, and block the broadcast of independent news channel Geo TV. Most foolishly, Zardari\u2019s Supreme Court disqualified popular political opponent Nawaz Sharif, Pakistan\u2019s twice former Prime Minister, and his brother Shahbaz Sharif from holding elective office.<\/p>\n<p>Muneer Malik, one of the most prominent attorneys in Pakistan spearheading the lawyer\u2019s movement, almost died in prison after his 2007 arrest following Musharaff\u2019s State of Emergency. With regards to Zardari\u2019s current crackdown, he emailed me on Friday and wrote: \u201cI am trying to make myself scarce to reach Lahore by tomorrow to join the long march. I was arrested yesterday and released late last night. I don\u2019t know if I will be arrested again.\u201d <\/p>\n<p>Similarly, Ali Zaidi, a spokesman for popular cricketer turned politician and activist Imran Khan, emailed me describing how the police were destroying their party\u2019s offices, smashing equipment, and fastidiously searching for Khan, who is currently in hiding. <\/p>\n<p>Ironically, one of the greatest beneficiaries of this chaos is Sharif, who holds considerable power and influence in Pakistan\u2019s most populous province of Punjab. Apparently, Zardari was just issued an <a href=\"http:\/\/www.hindustantimes.com%2FStoryPage%2FStoryPage.aspx%3FsectionName%3DHomePage%26id%3D47e16894-c726-4717-b83c-5645eb021f24%26Headline%3DUS%2Bissues%2B24-hour%2Bultimatum%2Bto%2BZardari%2Bto%2Bresolve%2Bdeadlock\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">ultimatum<\/a> by Prime Minister Gilani and Chief of Army Kayani that he would be removed from office unless he complied with certain conditions, one being returning political control of Punjab to elected members of parliament \u2013 loyalists of Sharif. <\/p>\n<p>Nawaz Sharif, who himself resigned as Prime Minister under corruption accusations, ironically has transformed himself into the greatest advocate for the judiciary, which is absurdly comical due to his history of stifling dissent. He <a href=\"http:\/\/www.paktoday.com%2Fshah.htm\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">humiliated<\/a> his own Chief Justice Sajjad Ali Shah in 1997 due to the latter\u2019s principled stand in ordering the release of civil servants unjustly arrested by Sharif\u2019s order. He also issued \u201cThe Registration of Printing Press and Publication Ordinance, 1997\u2033 <a href=\"http:\/\/www.thenews.com.pk%2Fprint1.asp%3Fid%3D94802\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">curbing the press<\/a> and freedom of expression.  One can safely assume this latest exhortation for democracy by Sharif is just a cynical ploy for another power grab. <\/p>\n<p>As back channel diplomacy is in full effect with U.S. envoy Richard Holbrooke <a href=\"http:\/\/news.bbc.co.uk%2F2%2Fhi%2Fsouth_asia%2F7941122.stm\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">talking<\/a> to Zardari and Sharif, the United States would be remiss to neglect the lawyer\u2019s movement, which is representative of a moderate, democratically inclined Pakistani electorate. <\/p>\n<p>The U.S., which provided substantial support to General Zia and Musharraf\u2019s respective dictatorships, should use its diplomatic resources to force the reinstatement of Chief Justice Chaudhry and the independent judiciary. As Malik told me, \u201cAbsent a revolution the only hope is to empower the people through a fearless and independent judiciary and thus chip away the domination of the military bureaucratic- Zardari establishment.\u201d<\/p>\n<p>By playing musical chairs in supporting Pakistan\u2019s recurring cast of rogues, both Pakistanis and the U.S. now risk playing a deadly game of Russian Roulette in light of the drastic rise in extremism igniting the AF\/PAK region.<\/p>\n<p>It would be a symbolic and fitting bookend to the 60 year ordeal of Pakistan if the lawyer\u2019s movement sowed the auspicious seeds of Pakistan\u2019s heralded democracy planted by her political and philosophical forefathers, <a href=\"http:\/\/en.wikipedia.org%2Fwiki%2FMuhammad_Ali_Jinnah\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Muhammad Ali Jinnah<\/a> and <a href=\"http:\/\/en.wikipedia.org%2Fwiki%2FMuhammad_Iqbal\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Allamah Iqbal<\/a>, who coincidentally were attorneys as well. <\/p>\n<p>Although the road to that realization is beset with volatility, dissension and violence, the long march defiantly moves forward.<\/p>\n<p><i>(Note: Pakistani President Asif Zardari agreed to <a href=\"http:\/\/www.reuters.com%2Farticle%2FlatestCrisis%2FidUSLF205623\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">reinstate<\/a> Chief Justice Chaudhry late Sunday evening.)<\/i><\/p>\n<p><i>Associate editor Wajahat Ali is a Pakistani Muslim American who is neither a terrorist nor a saint.
