Valencia, Spain, Jun 25, 2016 \/ 02:49 pm (CNA\/EWTN News<\/a>).- A judge in Spain has thrown out a \u201chate crime\u201d case concerning Cardinal Antonio Ca\u00f1izares of Valencia, Spain, ruling that the cardinal\u2019s homily warning of a \u201cgay empire\u201d is protected by freedom of speech.<\/p>\n

During a May 13 homily, Cardinal Canizares voiced support for \u201cthe precious good of the Christian family\u201d and denounced what he called a push by politicians and the \u201cgay empire\u201d to promote \u201cradical feminism\u201d and \u201cgender theory,\u201d calling it the \u201cmost insidious of all.\u201d<\/p>\n

On June 3, the Valencian LGBT group Lambda filed a criminal complaint against Cardinal Canizares, decrying his homily as \u201chomophobic and male chauvinist statements\u201d that do nothing but incite hatred.<\/p>\n

The Spanish Immigration Network also filed a legal complaint against the cardinal accusing him of xenophobia when, in the same homily, he questioned the background of refugees coming to Spain.<\/p>\n

This week, the judge dismissed both cases over lack of evidence saying that \u201ca generic accusation sprinkled with vague facts\u201d is not enough \u201cto trigger a criminal investigation.\u201d He said that he saw no \u201cpublic incitement to violence or hatred\u201d in the cardinal\u2019s homily.<\/p>\n

A Spanish free speech advocacy group called HazteOir (Make Yourself Heard) led a petition drive in support of Cardinal Canizares during the trial. The US-based Thomas More Law Center also lent support to the cardinal by launching a \u201cJe suis Canizares\u201d campaign saying that his homily expressed an \u201copinion widely held by Spaniards.\u201d<\/p>\n

Even while he was under investigation, Cardinal Canizares and thousands of Valencians participated in an act of reparation after gay rights activists combined images of Our Lady of the Forsaken, patroness of Valencia, and Our Lady of Monserrat, patroness of Catalonia, to depict the two Madonnas kissing as promotion for the Valencia gay pride parade.<\/p>\n
