No, not that one<\/a>. \u00a0This one<\/a>.<\/p>\n

I get it. \u00a0Trump did so in Trumpspeak, using Twitter and acting like a child who was just told he couldn\u2019t have dessert. \u00a0But the point is, as is typical now, I\u2019m seeing reactions that suggest we are on the verge of a constitutional crisis because our president has dared go against the court.<\/p>\n

Again, I understand. \u00a0We were all shocked by Trump\u2019s sudden revelation that the courts are there in order to provide a counter to the other branches. When he did that, I asked my boys why the courts can rule on\u00a0legislation. \u00a0\u201cWasn\u2019t that Marbury vs. Madison?\u201d, they answered. \u00a0Maybe they should advise Trump.<\/p>\n

The NY piece is the problem. \u00a0It glosses over Obama\u2019s stunning 2010 rebuke against the court. \u00a0That was no small thing. \u00a0In the day, I remember liberal pundits doing a Rodney Dangerfield with their collars as they tried to put the best spin on Obama\u2019s, not only rebuke, but virtually unprecedented\u00a0use of the State of the Union to do so. \u00a0Consider the NYT take (and that from a source hardly antagonistic toward\u00a0Obama):<\/p>\n

It is not unusual for presidents to disagree publicly with Supreme Court decisions. But they tend to do so at news conferences and in written statements, not to the justices\u2019 faces.<\/p><\/blockquote>\n

and later:<\/p>\n

The sharp attack from the president, echoing those of other Democrats and their allies, suggested that the left has found a decision to rail against, even if there is not much that can be done about it.<\/p><\/blockquote>\n

\u201cNot to the justices\u2019 faces\u201d, \u201cThe sharp attack.\u201d \u00a0In Times talk, that\u2019s admitting to a pretty stunning turn of behavior from Obama. \u00a0But compare that to this piece in the NY:<\/p>\n

Obama acknowledged this norm in his carefully worded rebuke \u2026 Obama prefaced his remarks with a nod to the legitimacy of the court\u2019s power, and then called on legislators to pass reforms that might mitigate the substantive harms of the Citizens United<\/em> ruling.<\/p>\n<\/blockquote>\n

How sweet. \u00a0As if there was barely anything worth noticing when it happened. \u00a0Just Obama being awesome and, according to the piece, justified.<\/p>\n

Did Obama cause a Constitutional crisis? \u00a0No. \u00a0But it sent shock waves through the political discourse nonetheless. \u00a0Conservatives objected, saying that Obama was out of line, challenging the role of the judiciary. And even Obama\u2019s staunchest supporters could do little more than assure us that while it was shocking, it was nothing other than trying to right a wrong that the Court had committed.<\/p>\n

Yes, Trump was out of the ballpark in his stunning disregard (or ignorance) of the role of the judiciary. \u00a0And yet, once more, we have Trump merely doing in Trumptalk\u00a0what we\u2019ve already witnessed ourselves lurching towards in the first place. \u00a0Those laughingly saying \u2018this time we have reason to impeach Trump\u2019 should have been making the same warnings when Obama did it, albeit in an Ivy league cant.<\/p>\n

All Trump is doing now is a schoolyard bully version of what Obama did as a Dean\u2019s list teacher\u2019s pet.<\/p>\n

Oh, and don\u2019t for a minute think it all started with Obama. \u00a0Just ask FDR about packing courts to circumvent the judiciary\u2019s role. \u00a0Criticize all we want. \u00a0And Trump deserves much criticism, if not out right laughter, for\u00a0his ignorance and boorish responses. \u00a0But we also see the problem when the critics seize upon every gaffe and failure as \u2018Impeach Trump! We\u2019re all going to die!\u2019 \u00a0Especially if, to do so, they must rewrite the history to say \u2018because for the first 240\u00a0years, the universe was a beautiful place, and everyone was happy and awesome, \u00a0but now!!!!\u2019<\/p>\n

Then we\u2019re stuck between two sides, one perhaps more flagrant than the other, but both ready to be wrong for the cause. \u00a0And if everything becomes\u00a0#impeachmentnow<\/a>, eventually nothing will. Because those all important Independents<\/a>\u00a0and fence sitters eventually will grow tired of hearing the same hysterics on a thrice daily basis. \u00a0Remember the Clinton years? \u00a0Democrats should learn from the GOP\u2019s mistakes, not think that this time they are justified in repeating them.<\/p>\n<\/body><\/html>\n","protected":false},"excerpt":{"rendered":"
