The very prominent libertarian legal scholar Richard Epstein, contemplating the current Kavanaugh\/Ford ugliness, asks \u201cWhat sane judge would like to be the next Supreme Court nominee?\u201d<\/p>\n

Perhaps a person\u2019s willingness to accept nomination to the Supreme Court of the United States should, in and of itself, be deemed sufficient evidence of poor judgment to deny \u00a0confirmation?<\/p>\n

Incidentally, I\u2019ve heard that there\u2019s a letter out there in which someone who declines to be questioned further on the matter claims to have recently remembered seeing Judge Kavanaugh\u2019s accuser rob a liquor store nearly four decades ago. \u00a0The letter writer might have been a bit under the influence at the time, and can\u2019t remember where the liquor store was or in what year the robbery happened or whether the criminal accuser of Judge Kavanaugh had one accomplice or three accomplices.<\/p>\n

\u00a0<\/p>\n

Anyway, the bottom line is that the credibility of Judge Kavanaugh\u2019s accuser is now definitively in tatters.<\/p>\n

Incidentally, should Judge Kavanaugh\u2019s nomination to the Supreme Court fail, there\u2019s an obvious back-up candidate to take his place \u2014 one who would, I\u2019m sure, have the support of virtually all Democrats:<\/p>\n

In my judgment, Senator Mazie Hirono (D-HI) has now achieved the rank of Leading Legal Thinker in the United States:<\/p>\n

\u00a0<\/p>\n

\u201cSen. Hirono: Men Need To \u2018Shut Up,\u2019 Kavanaugh Accuser Needs To Be Believed And I Believe Her\u201d<\/a><\/p>\n

\u00a0<\/p>\n

Human rights and the rule of law would be secure under Justice Hirono. \u00a0In fact, I\u2019m not even sure that the other eight justices of the Supreme Court will even have a role to play after she is seated on the bench.<\/p>\n

I did not think anybody could so soon top the recent Kavanaugh hearings held by the Senate Judiciary Committee, which Senator John Kennedy (R-LA) memorably and aptly termed \u201can intergalactic freak show.\u201d \u00a0After all, who knew that (the inevitable future presidential candidate) Senator Cory Booker (D-NJ) is actually Spartacus? \u00a0(See \u201cCory Booker Dodges Questions about Kavanaugh Document Release\u201d<\/a> and \u201cCory Booker Is Embarrassing Himself\u201d<\/a> and\u00a0\u201cCory Booker\u2019s 911 Calls\u201d<\/a>\u00a0and \u201cCory Booker: \u2018It Would Be Irresponsible Not\u2019 to Consider Presidential Run.\u201d<\/a>) \u00a0And that distinguished senator \u2014 who, it seems, originally hails from from ancient Thrace \u2014 had stiff competition from\u00a0(the inevitable future presidential candidate) Senator Kamala Harris (D-CA). \u00a0(See \u201cKamala Harris Wins the Democrats\u2019 Kavanaugh Primary,\u201d<\/a>\u00a0which was foreshadowed during the summer: \u00a0\u201cIs Kamala Harris the Future of American Politics?\u201d<\/a>)<\/p>\n
