What do you say about her?\u201d\u00a0[6] This they said to test him, that they might have some charge to bring against him. Jesus bent down and wrote with his finger on the ground.\u00a0[7] And as they continued to ask him, he stood up and said to them, \u201cLet him who is without sin among you be the first to throw a stone at her.\u201d\u00a0[8] And once more he bent down and wrote with his finger on the ground.\u00a0\u00a0[9] But when they heard it, they went away, one by one, beginning with the eldest, and Jesus was left alone with the woman standing before him.\u00a0[10] Jesus looked up and said to her, \u201cWoman, where are they? Has no one condemned you?\u201d\u00a0[11] She said, \u201cNo one, Lord.\u201d And Jesus said, \u201cNeither do I condemn you; go, and do not sin again.\u201d<\/p><\/blockquote>\n<p>Jesus didn\u2019t say, \u201cyou mustn\u2019t stone anyone anymore for adultery because it\u2019s always been wrong\u201d or \u201cthe Law is now null and void\u201d (He said the opposite about <em>that<\/em>\u00a0in the Sermon on the Mount).<\/p>\n<p>He didn\u2019t deny its validity at all. What He did was take the principle involved [the felt \u201ctension\u201d between love and justice] far deeper, into the new covenant realm of the primacy of mercy and grace (the \u201cweightier elements\u201d of the Law: Matthew 23:23): \u201cHe who is without sin, cast the first stone.\u201d<\/p>\n<p>Jesus is using typically Hebraic exaggeration \/ hyperbole, as He very often did, but to me the bottom-line point is what I have highlighted: He is going to the very roots of the deepest meanings of the law, as in Matthew 23:23-28:<\/p>\n<blockquote><p>Woe to you, scribes and Pharisees, hypocrites! for you tithe mint and dill and cummin, and have neglected the weightier matters of the law, justice and mercy and faith; these you ought to have done, without neglecting the others. [24] You blind guides, straining out a gnat and swallowing a camel! [25] \u201cWoe to you, scribes and Pharisees, hypocrites! for you cleanse the outside of the cup and of the plate, but inside they are full of extortion and rapacity. [26] You blind Pharisee! first cleanse the inside of the cup and of the plate, that the outside also may be clean. [27] \u201cWoe to you, scribes and Pharisees, hypocrites! for you are like whitewashed tombs, which outwardly appear beautiful, but within they are full of dead men\u2019s bones and all uncleanness. [28] So you also outwardly appear righteous to men, but within you are full of hypocrisy and iniquity. (RSV)<\/p><\/blockquote>\n<p>This is what I see recent popes doing with regard to the death penalty. They are highlighting and making central the \u201cweightier matters\u201d of the Law: \u201cjustice and mercy and faith.\u201d Pope Francis has simply <a href=\"http:\/\/www.ncregister.com\/daily-news\/vatican-draft-alters-catechism-wording-on-capital-punishment-calling-it-ina\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">made it more definitive today<\/a> than it has been before.<\/p>\n<p>The passage certainly seems (at least <em>prima facie<\/em>) more supportive of the anti-death penalty position than the pro-death penalty view, and it is so without asserting that the death penalty is intrinsically immoral.\u00a0\u201cChange\u201d in Church teaching in this instance means \u201cfurther development.\u201d Pope Francis is <em>not<\/em> saying it is <em>intrinsically wrong<\/em>. But he\u2019s saying that in our time \u2014 given our means to detain criminals today \u2014 there is no situation in which it is <em>admissible<\/em>.<\/p>\n<p>To declare capital punishment intrinsically or inherently immoral, on the other hand, would amount to pacifism and a denial of just war, and that isn\u2019t the position of the Church. Nothing has changed in that respect. The only change has been a position (since at least Pope St. John Paul II and <em>Evangelium Vitae<\/em>) of <em>almost total<\/em> opposition to the death penalty, to a <em>complete<\/em> opposition in all cases (now laid out in the Catechism and Pope Francis\u2019 further explanation).<\/p>\n<p>Romans 13:4 (see my treatment of it below) needs to be exegeted properly, since (I believe) it is the primary proof offered of the death penalty in the New Testament.
