Moreover,\u00a0<a href=\"https:\/\/www.washingtonpost.com\/blogs\/post-partisan\/wp\/2018\/06\/28\/behold-the-priest-kings-of-the-future-supreme-court\/?utm_term=.745bfe454e1d\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">just a few days ago<\/a>, I argued that the increasingly bitter judicial wars tearing apart today\u2019s politics can only be ended with more judicial deference to legislatures and to precedent. It stands to reason that I would be dismayed by the politically electrifying prospect that\u00a0<em>Roe<\/em>\u00a0might be overruled entirely. But I wouldn\u2019t be dismayed. I\u2019d be glad to see\u00a0<em>Roe<\/em>\u00a0go, as quickly as possible.<\/p>\n<p data-elm-loc=\"3\">How can someone who calls herself pro-choice oppose\u00a0<em>Roe v. Wade<\/em>? Let me count the ways.<\/p>\n<p data-elm-loc=\"4\">The decision itself is a poorly reasoned mess. It failed to mount a convincing case that the Constitution contains language that can be read as guaranteeing a woman\u2019s right to abort her pregnancy. Nor have the subsequent courts that amended and extended\u00a0<em>Roe<\/em>managed to come up with a constitutional justification; it\u2019s all \u201c<a href=\"https:\/\/concurringopinions.com\/archives\/2013\/09\/emanations-and-penumbras.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">emanations and penumbras<\/a>\u201d and similarly float-y language that did little to convince opponents that\u00a0<em>Roe v. Wade<\/em>\u00a0was a good or necessary ruling. Even many liberal supporters of a constitutional right to abortion have voiced concerns about the way the Burger Court got us there; those critics include\u00a0<a href=\"https:\/\/www.law.uchicago.edu\/news\/justice-ruth-bader-ginsburg-offers-critique-roe-v-wade-during-law-school-visit\" class=\" decorated-link\" target=\"_blank\">Justice Ruth Bader Ginsburg<\/a>.<\/p>\n<p data-elm-loc=\"5\">That poor drafting\u00a0<a href=\"http:\/\/articles.latimes.com\/2005\/sep\/14\/nation\/na-abortion14\/4\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">quasi-accidentally<\/a>\u00a0left America with some of the\u00a0<a href=\"https:\/\/www.theatlantic.com\/international\/archive\/2013\/08\/in-liberal-europe-abortion-laws-come-with-their-own-restrictions\/278350\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">most permissive abortion laws in the world<\/a>, far beyond what most legislatures would permit if the matter were open to public debate. Today, the United States is one of\u00a0<a href=\"https:\/\/www.washingtonpost.com\/news\/fact-checker\/wp\/2017\/10\/09\/is-the-united-states-one-of-seven-countries-that-allow-elective-abortions-after-20-weeks-of-pregnancy\/?utm_term=.a2e9371a8fd5\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">only a handful<\/a>\u00a0of countries to allow elective abortions after the 20th gestational week.<\/p>\n<p data-elm-loc=\"6\">And that, in turn, is the biggest problem with\u00a0<em>Roe<\/em>: It has given the\u00a0<a href=\"http:\/\/www.pewresearch.org\/fact-tank\/2015\/12\/23\/americans-are-in-the-middle-of-the-pack-globally-when-it-comes-to-importance-of-religion\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">most religious developed country in the world<\/a>\u00a0one of the world\u2019s most permissive abortion laws. This is not some peculiar quirk of the American political psyche. The abortion law is out of step with\u00a0<a href=\"https:\/\/news.gallup.com\/poll\/235469\/trimesters-key-abortion-views.aspx\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">what the majority of the population wants<\/a>, and given the seriousness of what\u2019s involved, it is\u00a0<em>Roe<\/em>, more than any other opinion, that is driving both the radicalization and the judicialization of American politics, as pro-lifers fight like caged tigers to amend the law through the only avenue left open to them.<\/p>\n<\/blockquote>\n<p data-elm-loc=\"6\"><strong><a href=\"https:\/\/www.washingtonpost.com\/blogs\/post-partisan\/wp\/2018\/07\/03\/let-roe-go\/?utm_term=.a4ed2b61f95c\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Read the rest.\u00a0<\/a><\/strong><\/p>\n<\/body><\/html>\n","protected":false},"excerpt":{"rendered":"<p>From Megan McArdle in\u00a0The Washington Post:\u00a0 I am myself uneasily pro-choice.
