With the Supreme Court now solidly conservative, more people are asking that question. The Washington Post<\/a><\/strong> offers an analysis \u2014 but the bottom line seems to be that the battle for life will not be over if and when the law is overturned:<\/p>\n

There\u2019s been\u00a0a lot of talk\u00a0<\/a>among abortion-rights activists and Democratic lawmakers that Brett M. Kavanaugh\u2019s ascension to the Supreme Court might provide a majority to overturn the\u00a0landmark 1973\u00a0Roe v. Wade<\/em>\u00a0decision.<\/p>\n

Here\u2019s the thing: even if that happened, abortion rights won\u2019t be immediately outlawed throughout the United States.<\/strong><\/p>\n

The truth is the legal framework surrounding abortion rights in the United States\u00a0is much more complicated<\/strong>, meaning that if the high court acted to overturn Roe, some states would continue allowing women access to abortions, while others may bar them from receiving the procedure \u2014 or restrict access to it at various points in a pregnancy and for any number of different reasons.<\/p>\n

That means even greater variance in abortion laws across the country depending on whether a state is run by Democrats or Republicans<\/strong>.<\/p>\n

Right now, how easily a woman can access\u00a0an abortion varies dramatically based on whether she lives in a politically red or blue state. Access would become even more segmented if a now solidly conservative high court moved the guideposts on when or how abortion can be restricted.<\/p>\n

It\u2019s worth remembering that\u00a0Roe<\/em>\u00a0didn\u2019t guarantee access to legal abortion \u2014 the decision\u00a0states\u00a0that the procedure\u00a0can\u2019t\u00a0be restricted before the point that a fetus is viable.\u00a0So overturning\u00a0Roe\u00a0<\/em>wouldn\u2019t change much of anything for states mainly run by Democrats who are supportive of abortion rights \u2014 they\u00a0could\u00a0keep abortion legal within their borders.\u00a0<\/strong>In fact, nine states have passed laws explicitly protecting abortion rights, regardless of a high court decision.<\/p>\n

But in the 26 states where Republicans hold the governorship and control the legislature, stricter abortion bans would probably follow if the court weakens or eliminates the\u00a0Roe\u00a0<\/em>standard.<\/p>\n

Four of these states \u2014 Louisiana, Mississippi and North and South Dakota \u2014 have enacted\u00a0\u201ctrigger laws,\u201d which would go into effect should\u00a0Roe<\/em>\u00a0be struck down. Louisiana\u2019s\u00a02006 law<\/a>\u00a0would prohibit all abortions except when the woman\u2019s life is in danger. Mississippi\u2019s\u00a02007 law<\/a>\u00a0would also allow an exception in cases of rape. Ten other states have kept pre-Roe<\/em>\u00a0abortion bans on the books.<\/p>\n

So it\u2019s easy to imagine a scenario in which abortion remained legal in states mainly controlled by Democrats and illegal in other states supervised by Republicans, cleaving the country\u00a0along the same geographic\u00a0lines<\/a>\u00a0that have divided it in elections.<\/strong><\/p><\/blockquote>\n
