The Washington Post<\/em>\u00a0has moved to dismiss a defamation lawsuit brought by Kentucky teenager Nicholas Sandmann, who on Jan. 18 quickly found himself the talk of social media when a group of students at\u00a0Covington Catholic High School came face-to-face with Native American activists at the foot of the Lincoln Memorial.<\/p>\n

When observers saw a video clip of the confrontation, some focused on\u00a0Sandmann, wearing a \u201cMake America Great Again\u201d hat and sporting a seemingly smug grin while watching Native American elder Nathan Phillips. In one of its first stories about the incident,\u00a0The Washington Post\u00a0<\/em>quoted Phillips<\/a>\u00a0as saying he felt \u201cthreatened by the teens,\u201d that they \u201cswarmed around him\u201d and one of them \u201cblocked my way and wouldn\u2019t allow me to retreat.\u201d<\/p>\n

A fuller video depicting what happened was much more ambiguous, and some who were initially critical of\u00a0Sandmann\u00a0apologized for snap judgments<\/a>. The paper itself appended an editor\u2019s note to its initial story. Nevertheless,\u00a0Sandmann has filed lawsuits against both\u00a0The Washington Post\u00a0<\/em>and CNN for what his attorney characterizes as \u201cmodern-day form of McCarthyism.\u201d<\/p>\n

In a dismissal motion filed Tuesday,\u00a0The Washington Post\u00a0<\/em>stands by its coverage and says it is neither false nor defamatory to report comments by eyewitnesses, including participants speaking publicly about an event that went viral on the Internet.<\/p>\n

\u201cNewspapers are often unable to publish a complete account of events when they first come to light,\u201d writes the paper\u2019s lawyers. \u201cStories often develop over time, as more witnesses emerge.\u201d<\/p>\n

The Washington Post\u00a0<\/em>points a Kentucky federal judge to its entire coverage of the incident from the initial condemnation of students by\u00a0the Diocese of Covington and Covington Catholic High School to a front-page story offering\u00a0Sandmann\u2019s perspective when he came forward to speak publicly about what happened.<\/p>\n

\u201cIn short, the articles at issue may not have been flattering of the Covington Catholic students, but they do not give rise to a defamation claim by Sandmann,\u201d continues the dismissal motion. \u201cIndeed, the Post\u2019s overall coverage \u2014 including the articles that the Complaint fails to mention \u2014 was not only accurate; it was ultimately favorable to him.\u201d<\/p><\/blockquote>\n
