Richard Doerflinger of the Bishop\u2019s Conference\u2019s Secretariat on Pro-Life Activities <a href=\"http:\/\/www.ncregister.com\/daily-news\/u.s.-bishops-spokesman-hawaii-bill-not-much-of-a-compromise-to-fix-contrace\/#ixzz1lns0SXmx\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>has declared<\/strong><\/a> compromise a no sale.  For every pundit defending President Obama outright \u2014 as <em>Salon\u2019s<\/em> Joan Walsh does when she <a href=\"http:\/\/www.salon.com\/2012\/02\/02\/catholics_need_to_preach_what_we_practice\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>calls on Catholics<\/strong><\/a> to \u201cpreach what we practice\u201d regarding birth control \u2014 two or three are pleading for reconciliation.  In the <em>Washington Post,<\/em> Melissa Rogers <a href=\"http:\/\/www.washingtonpost.com\/blogs\/on-faith\/post\/seeking-a-win-win-solution-for-hhs-regulations\/2011\/10\/07\/gIQAff6eSL_blog.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>calls for a \u201cWin-Win\u201d solution,<\/strong><\/a> i.e., one that will \u201cprotect the rights of conscience and secure access to important health care services.\u201d  <\/p>\n<p>That\u2019s a tall order \u2014 maybe too tall.  For that reason, it\u2019s good news for Catholics that so many people persist in trying to place it.  One reason may be the suspicion that the regulations won\u2019t hold up in court.  The 1993 <a href=\"http:\/\/www.welcomehome.org\/rainbow\/nfs-regs\/rfra-act.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>Religious Freedom Restoration Act<\/strong><\/a> holds any law burdening the free exercise of religion up to \u201cstrict scrutiny.\u201d  The government must prove that the law is: 1) \u201cacting in furtherance of a compelling government interest\u201d; and 2) that it represents \u201cthe least restrictive means available\u201d for doing so.  There are no guarantees the PPACA could pass both parts of that test. <\/p>\n<p>Another related, equally important reason may be the shrewdness shown by the bishops and their supporters in framing the issue.  According to the chorus, expanding conscience exemptions would represent no judgment against contraception.  NCR\u2019s Michael Sean Winters <a href=\"http:\/\/ncronline.org\/blogs\/distinctly-catholic\/jaccuse\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>begins his denunciation<\/strong><\/a> of Obama by insisting he\u2019s no \u201canti-contraceptive zealot.\u201d  <em>U.S.A. Today <\/em><a href=\"http:\/\/www.usatoday.com\/news\/opinion\/editorials\/story\/2012-02-05\/contraception-mandate-religious-freedom\/52975796\/1\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>agrees<\/strong><\/a> that the Republicans are launching no \u201cWar on Contraception.\u201d  Dr. Albert Mohler of the Southern Baptist Theological Seminary <a href=\"http:\/\/www.lifesitenews.com\/news\/southern-baptist-leader-obama-contraception-mandate-is-not-only-a-catholic\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>has reminded<\/strong><\/a> fellow evangelicals, many of whom use artificial contraceptives, that the controversy \u201cis not a Catholic issue,\u201d but a general assault on religious liberty.<\/p>\n<p>That frame is good, so long as it holds.  But will it?  Or will culture warriors cave in to temptation and take the whole thing to eleven?  In <em>Business Insider\u2019s<\/em> politics section, Brendan Michael Dougherty and Pascal-Emmanuel Gobry <a href=\"http:\/\/www.businessinsider.com\/time-to-admit-it-the-church-has-always-been-right-on-birth-control-2012-2\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>proclaim:<\/strong><\/a> \u201cTime to admit it: The Church Has Always Been Right on Birth Control.\u201d  As <em>Humanae Vitae<\/em> predicted, argue the authors, the ability to prevent conception has led to a lowering of moral standards, the objectification of women, increased infidelity and illegitimacy and government \u201ccoercion\u201d in reproductive issues.<\/p>\n<p>Dougherty and Gobry stop short of demanding that the state prohibit the sale or use of contraceptive devices.  Indeed, in <em>Griswold v. Connecticut, <\/em>the Supreme Court ruled that such prohibitions were unconstitutional.  But in the majority decision, Justice Douglas first posited the \u201cright to privacy\u201d found in the \u201cpenumbras\u201d of the First Amendment.  Of course, Justice Blackmun invoked that very right and those very penumbras in striking down abortion bans in <em>Roe v. Wade.<\/em>  This fact makes them, in some circles, the most hated right and the most hated penumbras in the history of American jurisprudence.  To expunge them from the books, as many would like to do, is to put prohibitions on contraception back on the table.  <\/p>\n<p>The idea would very likely please Rick Santorum.  In <a href=\"http:\/\/thinkprogress.org\/health\/2011\/10\/19\/348007\/rick-santorum-pledges-to-defund-contraception-its-not-okay-its-a-license-to-do-things\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>an interview<\/strong><\/a> with CaffeinatedThoughts.com editor Shane Vander Hart, he promised to withdraw all federal funding for contraceptives, and to use the presidency to warn of \u201cthe dangers of contraception.\u201d  Contraception, he said, \u201cIs not okay.  It\u2019s a license to do things in the sexual realm that is counter to how things are supposed to be.\u201d  Santorum, an attorney, also criticized the<em> Griswold <\/em>ruling from a jurisprudential point of view.  \u201cThe state has a right to [ban contraceptives],\u201d <a href=\"http:\/\/abcnews.go.com\/blogs\/politics\/2012\/01\/santorum-explains-06-loss-still-supports-state-right-to-outlaw-contraception\/?utm_source=twitterfeed&amp;utm_medium=twitter\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>he said<\/strong><\/a> in 2006.   \u201cThe state has the right to pass whatever statues they have. That is the thing I have said about the activism of the Supreme Court, they are creating rights, and they should be left up to the people to decide.\u201d<\/p>\n<p>Now, Santorum has yet to connect that dot between his abhorrence of contraceptives and his belief in judicial restraint.  He\u2019s never come right out and said that all rubbers should be contraband.  Will that last, I wonder?  In the short run, such a statement looks politically foolish \u2014 98% of Catholics have used artificial birth control, and <a href=\"http:\/\/www.ksl.com\/?sid=19173375&amp;nid=757&amp;title=contraception-mandate-has-catholic-support-despite-romneys-push&amp;s_cid=queue-11\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>58% believe<\/strong><\/a> that employers should cover contraception and birth control at no cost.  But, like Santorum or not, he\u2019s never shown much interest in doing the done thing, politically.  It was after losing an election that he affirmed his opposition to the reasoning in <em>Griswold<\/em>.  Three official primary victories (plus an unofficial fourth, Iowa) under his belt ought to redouble whatever courage Santorum has always had in his convictions.<\/p>\n<p>Or maybe what we should expect is an anti-contraceptive groundswell from intellectuals.  This past January in <em>First Things,<\/em> Howard Kainz, professor <em>emeritus <\/em>of philosophy at Marquette, <a href=\"http:\/\/www.firstthings.com\/onthesquare\/2012\/02\/gop-fails-to-connect-the-dots-on-contraception\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><strong>argued<\/strong><\/a> that a very short and slippery slope connects contraception to gay marriage.  If taken seriously, this ought to make contraceptives into very potent bogeymen indeed.  This very week on <em>Patheos, <\/em> Christopher West <a href=\"http:\/\/www.patheos.com\/Resources\/Additional-Resources\/Catholic-Call-to-Arms-Christopher-West-02-01-2011.html\" class=\" decorated-link\" target=\"_blank\"><strong>plugs his book,<\/strong><\/a> <em>At the Heart of the Gospel: Reclaiming the Body for the New Evangelization<\/em>, by warning that \u201cthe entire world has a vested interest in what happens in our bedrooms.\u201d  Citing crumbling marriages and laboratory-manufactured people, he urges readers to give <em>Humanae Vitae<\/em> \u201canother look.\u201d<\/p>\n<p>Gird your loins, so to speak, gang, and sing, O Muse.
