{"id":25208,"date":"2015-03-11T22:16:50","date_gmt":"2015-03-12T03:16:50","guid":{"rendered":"http:\/\/admin.patheos.com\/blogs\/drishtikone\/?p=25208"},"modified":"2015-03-13T22:05:53","modified_gmt":"2015-03-14T03:05:53","slug":"indias-daughter-unethical-journalism-breaching-voyeuristic-limits-to-shame-a-nation","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/drishtikone\/2015\/03\/indias-daughter-unethical-journalism-breaching-voyeuristic-limits-to-shame-a-nation\/","title":{"rendered":"India&#8217;s Daughter: Unethical Journalism Breaching Voyeuristic Limits to &#8220;Shame a Nation&#8221;"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p>Days after the launch of the movie \u201c50 Shades of Grey\u201d the world over, where BDSM (Bondage, Discipline, Sadism and Masochism) erotic practices are shown\u00a0\u2013 a\u00a0movie and a story where women are depicted akin to sex slaves to a rich handsome guy, we have in India and the world, a controversy about a documentary \u201cIndia\u2019s Daughter\u201d. \u00a0A documentary on a young girl who was brutally raped and left to die on the road along with her friend. \u00a0This documentary, which hinges on the testimony of one of the rapists \u2013 <a href=\"http:\/\/www.newindianexpress.com\/nation\/Deception-Lies-Behind-Making-of-India%E2%80%99s-Daughter\/2015\/03\/09\/article2704869.ece\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">shot without his consent<\/a> or knowledge \u2013 and arguments from his Defense lawyers, viewers are left without any idea of what the prosecution thinks or what the victim\u2019s friend \u2013 himself a victim that night \u2013 thought of it? \u00a0Such is the weight and halo given to the rapist\u2019s rather gruesome testimony with detailed graphic content of how she was raped and killed, that many this writer has interacted with, believe that rapist\u2019s version was the correct version of the events that night! \u00a0If the derivative public view in the world \u2013 God-forbid \u2013 been that of a jury, we would have the most bizarre situation where the rapist would have simply walked out. \u00a0In fact, a halo is already being constructed around the juvenile who violated the girl with an iron rod and pulled her entrails out! <a href=\"http:\/\/www.washingtonpost.com\/world\/asia_pacific\/juvenile-rapist-in-2012-new-delhi-assault-now-paints-and-cooks-at-correction-home\/2014\/08\/31\/1af8a383-1100-4305-b59b-8259784debf0_story.html\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">(Juvenile rapist in 2012 New Delhi assault now paints and cooks at correction home<\/a>) All this in the name of \u201cFree Speech\u201d and \u2013 if we can actually fathom it \u2013 to further \u201cFeminism\u201d. \u00a0Just that this liberal anachronism of those who have loved India\u2019s Daughter flies in the face of decent even normal, human conduct. \u00a0In a detailed article in European Journal of Law and Technology, Helen Boyle (<span style=\"color: #111111;\">Boyle, H. \u2018Rape and the Media: Victim\u2019s Rights to Anonymity and Effects of Technology on the Standard of Rape Coverage\u2019, European Journal of Law and Technology, Vol. 3, No. 3, 2012) <a href=\"http:\/\/ejlt.org\/article\/view\/172\/262\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">has cited<\/a> an interesting study:<\/span><\/p>\n<blockquote><p>Karen Dill cites a study which exposed some men to scenes from the films Show Girls and 9 \u00bd Weeks, including a striptease and a blindfolded woman; which emphasised female degradation, availability and submission and male power, dominance and sexual gratification.[8] The men were then asked to read accounts of date rape or stranger rape. Those who were exposed to the media degradation of women were much more likely to say that in cases of date rape, she got what she wanted or that she enjoyed it [Dill, 2009].<\/p><\/blockquote>\n<p>In the modern world of unabashed erotic titillating and submissive practices, we have the Western Media patronize India on the mindset problem of its male population. \u00a0That the rapist blames the raped \u2013 which is shown in sickening detail in the movie \u2013 is somehow characterized in the media as a decidedly \u201cIndian \u2013 and by extension, a Hindu \u2013 Problem\u201d. \u00a0Somehow, degradation of women and high number of rapes notwithstanding in the West, accompanied with<a href=\"https:\/\/www.patheos.com\/blogs\/drishtikone\/2015\/03\/indias-daughter-ok-we-are-outraged-indian-men-are-devils-incarnate-with-medieval-mindset-now-what\/\" target=\"_blank\" class=\" decorated-link\"> extremely low conviction rate<\/a> in rape cases in Europe (7% in UK for example) vs India (24%) \u2013 this documentary has been touted as a \u201c<a href=\"http:\/\/timesofindia.indiatimes.com\/india\/India-have-committed-international-suicide-by-banning-film-Udwin\/articleshow\/46487996.cms?utm_source=facebook.com&amp;utm_medium=referral&amp;utm_campaign=TOI\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">Gift to India<\/a>\u201c. \u00a0Thank you very much! Meanwhile, the only sane human being alive from the scene of the crime \u2013 Nirbhaya\u2019s friend \u2013 <a href=\"http:\/\/ibnlive.in.com\/news\/nirbhayas-friend-who-was-with-her-on-the-fateful-night-calls-indias-daughter-a-fake-film\/533097-3-244.html\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">has this to say<\/a> about the movie and its claims:<\/p>\n<blockquote><p>\u201cThe documentary is unbalanced as the victim\u2019s viewpoint is missing. The facts are hidden and the content is fake. Only Jyoti and I know what happened on that night and the documentary is far from truth,\u201d says Avanindra Pandey who fought with the rapists and murderers to save his friend but was overpowered and beaten up brutally. Backing his claim, Pandey said he had never heard the name of tutor Satendra, who features in the documentary. \u201cMoreover, how does he know which movie I wanted to watch on that night,\u201d asks Pandey. The man who appears as the tutor of the victim in the documentary said, \u201cAvanindra Pandey wanted to watch an action film while Jyoti wanted to watch \u2018Life Of Pi\u2019.\u201d \u00a0The interview of the death row convict created a massive public uproar and controversy after it was made public in which he held girls more responsible than boys for rape. Pandey says, \u201cA controversy was created unnecessarily and was sensationalised. The documentary made fun of emotions and questioned the law and order situation in our country.\u201d<\/p><\/blockquote>\n<p>He discusses another person which the movie uses a lot is some \u201cTutor of Jyoti\u201d \u2013 a friend. \u00a0Avanindra, a close friend of Jyoti, strangely does not recognize the person! \u00a0A case of fake strawman\u00a0planted to mouth\u00a0the script of the predetermined stereotypes the documentary maker \u2013 and her sponsors \u2013 wanted to depict in the movie?<\/p>\n<p><strong>BBC\u2019s documentary violated Nirbhaya in her Death<\/strong><\/p>\n<p>Under\u00a0<span style=\"color: #111111;\">section 1 of the\u00a0<\/span>Sexual Offences (Amendment) Act 1992, if Nirbhaya was alive, showing what the documentary did <a href=\"http:\/\/ejlt.org\/article\/view\/172\/262\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">would be illegal<\/a> in the UK. \u00a0Just the fact that the victim is dead is enough to violate her dignity.<\/p>\n<blockquote><p><span style=\"color: #111111;\">In the UK, victims of rape or serious sexual assault have unequivocal anonymity and protection from media intrusion under section 1 of the <\/span><i style=\"color: #111111;\">Sexual Offences (Amendment) Act 1992<\/i><span style=\"color: #111111;\">. This is a statutory exception under Art 10(2) which allows for derogations on the basis of protecting the rights and freedoms of others. This means the names of victims of rape or sexual assault cannot be reported by the media.<\/span><\/p><\/blockquote>\n<p>There are reasons behind why the details of rape and the name of the victim is not shared in media. \u00a0In India, those who want to titillate the audience with the person\u2019s details and that of the crime ridicule the concept of\u00a0\u201cFamily Honor\u201d, while in the West, they come out with more innovative arguments. \u00a0But the fact remains that victims of molestation live a life of dejection, fear and shame \u2013 even though\u00a0they are not to blame for the crimes. \u00a0This is a common psychological truth. \u00a0To not heap more indignities and hardships on\u00a0the victims, media treatment, commentary and the description is sought to be more restrained than in other cases.<\/p>\n<blockquote><p><span style=\"color: #111111;\">Helena Kennedy QC, comments that the real meaning behind statements which question the rationale of protecting women in these situations, is to reiterate the fear that women make up malicious lies about rape all the time. This is despite the fact that there is no evidence to suggest that false allegations of rape are made any more frequently than in any other crime: which is around two per cent. <\/span><a style=\"color: #003344;\" title=\"\" href=\"http:\/\/ejlt.org\/article\/view\/172\/262#_edn19\" name=\"_ednref19\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">[19]<\/a><span style=\"color: #111111;\">\u00a0Kennedy explains that the reason why laws to protect the victim\u2019s identity in the media were introduced in the UK was to help people come forward, as it was \u2018recognised that the shame of the experience had such serious implications for women\u2019. <\/span><a style=\"color: #003344;\" title=\"\" href=\"http:\/\/ejlt.org\/article\/view\/172\/262#_edn20\" name=\"_ednref20\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">[20]<\/a><span style=\"color: #111111;\">\u00a0For many women public attention over what is still a source of \u2018degradation and humiliation\u2019 for them personally, would be \u2018the final straw\u2019 [Kennedy, p4, 2005]. She notes that for some communities rape is still such a source of dishonour it could affect the safety of some women and even lead to family rejection.<\/span><\/p><\/blockquote>\n<p>Honor and dishonor seem to run common across the developed and developing world! \u00a0In cases where the victims did give consent to the sharing of their ordeal by the media, later admitted to the humiliation that they felt all over again on seeing it in public view. \u00a0That has been an important reason why right to dignity is held above freedom of press.<\/p>\n<blockquote>\n<p style=\"color: #111111;\">Nancy Ziegenmeyer volunteered to be the subject of a series about her rape and the aftermath, however after receiving media attention, she cites that the exposure was \u2018dehumanising\u2019 [Meyers, p105, 1997] EVAW cite an example where a national radio station released the name of a woman who was involved in a high profile rape case and lost. The woman suffered serious anxiety and turmoil over this and her stress was heightened by the fact that she lived in a rural area and did not want her community to know what had happened. For her, the consequence of media attention and her privacy being infringed was serious emotional distress on top of the \u2018unique costs for the victim\u2019 which a rape trial holds [Estrich, p3, 1987]. Both these experiences, of rape victims and media intrusions on their privacy, are compatible with the arguments made by Kennedy and Benedict that rape is still too misunderstood by society to leave victims with no protection against the existing stigmatism.<\/p>\n<p style=\"color: #111111;\">The UK law, which allows an exception to the media\u2019s Art 10 right to free speech, recognises that the potential for unnecessary harm to the character and emotions of the victim outweighs the benefits which denying Art 8 rights to privacy would achieve.<\/p>\n<\/blockquote>\n<p style=\"color: #111111;\">Admitted that the rape victim in this case is dead. \u00a0But are there no ethics or policies on how to report death and its details?<\/p>\n<p style=\"color: #111111;\"><strong>Ethics in death reporting?<\/strong><\/p>\n<p style=\"color: #111111;\">Graphic details of death, any death, are not in public interest. \u00a0That has been the stand of many a media house around the world. \u00a0Even BBC\u2019s! \u00a0In cases of even suicide, journalists are asked to be very careful in how they report the whole event. \u00a0(Source:\u00a0<em>Journalism Ethics and Regulation<\/em> By Chris Frost, Pg 157)<\/p>\n<p><a href=\"https:\/\/books.google.com\/books?id=EbaOAwAAQBAJ&amp;pg=PA157&amp;lpg=PA157#v=onepage&amp;q&amp;f=false\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-25209\" src=\"https:\/\/wp-media.patheos.com\/blogs\/sites\/356\/2015\/03\/death-ethics.png\" alt=\"death ethics\" width=\"557\" height=\"577\"><\/a> Interestingly, every ethic of \u201cDeath Reporting\u201d, specially in a case of gruesome and extremely horrendous crime, were dumped by the BBC in this case. \u00a0Even though Nirbhaya is not alive today, another victim of molestation and violence \u2013 the friend \u00a0(who was found naked on the roadside along with Nirbahaya) is still alive! \u00a0Of course, her parents who have endured the greatest tragedy of their lives are being made to relive the entire ordeal in gruesome detail! \u00a0Avanindra, the friend who relives that night so many times even now, has called the movie \u201c<a href=\"http:\/\/www.indiatimes.com\/news\/india\/nirbhaya-rapes-only-witness-says-indias-daughter-documentary-is-fake-230864.html\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">insensitive<\/a>\u201c.<\/p>\n<p><strong>Conclusion<\/strong> Whether a movie should be banned or not is a completely different issue. \u00a0One wonders if a movie can even be banned in this age of Social Media where voyeurism is at its pinnacle! \u00a0But to say that such a documentary was a \u201cgift to India\u201d is a cruel joke indeed, when all it has done is to use selective sources \u2013 most heavily the villains in the piece showing them as the gospel givers \u2013 to extrapolate their mindset to that of an entire nation! \u00a0All done flouting every norm of journalism globally, specifically in Europe!<\/p>\n<p><a href=\"http:\/\/imgkid.com\/nirbhaya-photo-facebook.shtml\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">Image Source<\/a><\/p>\n<\/body><\/html>\n","protected":false},"excerpt":{"rendered":"<p>Days after the launch of the movie \u201c50 Shades of Grey\u201d the world over, where BDSM (Bondage, Discipline, Sadism and Masochism) erotic practices are shown\u00a0\u2013 a\u00a0movie and a story where women are depicted akin to sex slaves to a rich handsome guy, we have in India and the world, a controversy about a documentary \u201cIndia\u2019s [&hellip;]<\/p>\n","protected":false},"author":1517,"featured_media":25212,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[33,34,81],"tags":[3934,3935,3936,3930,3932,3929,1599,3938,3937,3931,3933,3939],"class_list":["post-25208","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-india","category-indian_culture","category-women","tag-aftercare-bdsm","tag-bbc-essex","tag-bbc-introducing","tag-bdsm","tag-bondage-bdsm","tag-fifty-shades-of-grey","tag-human-sexual-activity","tag-indias-daughter","tag-nirbhaya","tag-sadomasochism","tag-sexual-abuse","tag-udwin"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.1 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>India&#039;s Daughter: Unethical Journalism Breaching Voyeuristic Limits to &quot;Shame a Nation&quot;<\/title>\n<meta name=\"description\" content=\"Days after the launch of the movie &quot;50 Shades of Grey&quot;
