{"id":100,"date":"2013-03-01T23:58:00","date_gmt":"2013-03-02T06:58:00","guid":{"rendered":"http:\/\/admin.patheos.com\/blogs\/ecperson\/2013\/03\/01\/friend-of-the-court\/"},"modified":"2016-07-27T15:04:05","modified_gmt":"2016-07-27T22:04:05","slug":"friend-of-the-court","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/ecperson\/2013\/03\/01\/friend-of-the-court\/","title":{"rendered":"Friend of the Court"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><div class=\"separator\" style=\"clear: both; text-align: left;\">\u00a0Yesterday, the Obama Administration\u2019s Department of Justice filed an <a href=\"http:\/\/sblog.s3.amazonaws.com\/wp-content\/uploads\/2013\/02\/12-144tsacUnitedStates.pdf\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><i>amicus curiae<\/i> brief<\/a> with the Supreme Court of the United States for <a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/hollingsworth-v-perry\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><i>Hollingsworth v. Perry<\/i><\/a>. The case revolves around whether <a href=\"http:\/\/voterguide.sos.ca.gov\/past\/2008\/general\/title-sum\/prop8-title-sum.htm\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Proposition 8<\/a>, the initiative in 2008 that amended the California state constitution to only recognize marriage between one man and one woman as legally valid, is constitutional.\u00a0 The Justice Department finds Proposition 8 unconstitutional.<\/div>\n<p>People who have been following the same-sex marriage cases in the United States that this is the second<i> <\/i>\u201cfriend of the court\u201d brief that the Justice Department has recently filed on the issue. Two prior briefs were for <a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/windsor-v-united-states-2\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><i>Windsor v. United States<\/i><\/a> (one for the <a href=\"http:\/\/www.americanbar.org\/content\/dam\/aba\/publications\/supreme_court_preview\/briefs-v2\/12-307_brief_amcu_esw.pdf\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">jurisdictional questions<\/a>, the other for the <a href=\"http:\/\/www.americanbar.org\/content\/dam\/aba\/publications\/supreme_court_preview\/briefs-v2\/12-307_pet_usa_merits.pdf\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">merits<\/a>), a case that will examine the constitutionality of the <a href=\"http:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=5&amp;cad=rja&amp;ved=0CFAQFjAE&amp;url=http%3A%2F%2Fwww.gpo.gov%2Ffdsys%2Fpkg%2FBILLS-104hr3396enr%2Fpdf%2FBILLS-104hr3396enr.pdf&amp;ei=T2IxUbOMNqf0igKp8YDYCQ&amp;usg=AFQjCNH9hTkb1pi-Da6V-FtyU_qKIbonbA&amp;sig2=VsZQ8LmwsFiPIAm3MO3p9Q&amp;bvm=bv.43148975,d.cGE\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Defense of Marriage Act (DOMA)<\/a> at the federal level. In that case, the Justice Department found DOMA indefensible. <i>(Psst\u2026if you haven\u2019t seen The Good Wife\u2019s <a href=\"http:\/\/www.cbs.com\/shows\/the_good_wife\/episodes\/197967\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">episode on DOMA<\/a>, you should.)<\/i><\/p>\n<p>The brief wires me like coffee. It wires Ellen DeGeneres too, as she was wondering what the Supreme Court would do with <a href=\"https:\/\/www.facebook.com\/ellentv\/posts\/10151482388947240\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">all that underwear.<\/a><\/p>\n<p>But it wires me because no doubt, this will be yet another sign to Obama\u2019s critics that the Administration is hopelessly secular. Despite the fact that Obama constantly opens speeches with \u201c<a href=\"http:\/\/www.youtube.com\/watch?v=YiIXQGpDqRU\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Scripture tells us\u2026<\/a>\u201d Mitt Romney told an adoring Republican crowd that he thought that Obama was <a href=\"http:\/\/www.rawstory.com\/rs\/2012\/04\/03\/romney-obama-wants-to-establish-a-religion-called-secularism\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">inventing a new religion<\/a>: secularism. (Romney was subsequently <a href=\"http:\/\/www.realclearpolitics.com\/video\/2012\/04\/04\/lawrence_odonnell_mormonism_is_an_invented_religion.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">trolled by Lawrence O\u2019Donnell<\/a> for saying that.) The Obama Administration\u2019s <a href=\"http:\/\/www.cbsnews.com\/8301-503544_162-20035398-503544.html?tag=contentMain;contentBody\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">refusal to defend DOMA<\/a> and Obama\u2019s admission that <a href=\"http:\/\/swampland.time.com\/2013\/03\/01\/whats-behind-obamas-latest-evolution-on-gay-marriage\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">he had evolved<\/a> to support same-sex marriage was evidence. Never mind that Obama justified supporting same-sex marriage with the Bible, using the Golden Rule to trump the controversial passages on sexuality. In these accounts, the Obama Administration is secular and hell-bent on taking religion out of the public sphere, and every mention of his support for gay rights, from his <a href=\"http:\/\/youtu.be\/eEzSaQgbM6s\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">campaign speeches on equal love<\/a> to his <a href=\"http:\/\/www.youtube.com\/watch?v=BzC135ql_wA\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Second Inaugural Address<\/a>\u2018s invocation of Stonewall and historic use of the word \u201cgay,\u201d demonstrated that Obama had gone off the religion-hating secular deep end.<\/p>\n<p>I agree with these people to the extent that I think that the Obama Administration is secular. But I don\u2019t think secularism, especially Obama\u2019s secularism, works that way. The Obama Administration\u2019s friend of the court brief is a case in point.<\/p>\n<p>Here are some observations:<\/p>\n<ul>\n<li><i>The United States has an interest in the Court\u2019s <\/i>resolution of that question, particularly in light of its participation in United States v. Windsor\u2026The President and Attorney General have determined that classifications based on sexual orientation should be subject to heightened scrutiny for equal protection purposes (p. 1):<i> <\/i>For all the public theological rhetoric Obama has made, the argument of the Obama Administration is a secular one. The Administration\u2019s stake in the case reveals what <i>secular <\/i>interests the executive branch has in the case\u2019s outcome. Referencing their merits brief in <i>Windsor<\/i>, the Justice Department argues that its interest lies in the \u201cheightened scrutiny\u201d for \u201cclassifications based on sexual orientation,\u201d <i>i.e.<\/i> that the court must scrutinize exactly why certain people are being lumped into a single category based on their sexuality and then discriminated against (see p. 12). To pass heightened scrutiny, \u201ca law must be defended by reference to the \u2018actual state purposes\u2019 behind it, not \u2018rationalization for actions in fact differently grounded\u201d (p. 16-17). Heightened scrutiny applies, the brief explains, because gays and lesbians are a \u201cprotected class\u201d due to the \u201chistory of discrimination\u201d against them. This discrimination itself fails heightened scrutiny because it doesn\u2019t advance a state interest. Instead, it\u2019s a classification that \u201cgenerally bears no relation to ability to perform or contribute to society\u201d (p. 6). As anthropologist Talal Asad points out in <a href=\"http:\/\/www.amazon.com\/Formations-Secular-Christianity-Modernity-Cultural\/dp\/0804747687\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><i>Formations of the Secular<\/i><\/a>, this is a classic <i>secular<\/i> argument: modern governments don\u2019t really care what their citizens privately believe or even what sorts of things they do in the bedroom. They only care about those things when it affects the way that they contribute to society, to civic discussions of secular things like how the government should run, how the economy is going, and how we can all be more productive. This isn\u2019t secular in the sense that religion is absent from the brief. It is instead a case study in secularism because the argument hinges on citizens being productive contributors to public life, never mind their private beliefs or desires.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<ul>\n<li><i>Proposition 8 fails heightened scrutiny. Neither the interests asserted by petitioners nor Proposition 8\u2019s \u201cactual purposes as approved by its official sponsors suffice under that standard (p. 7f)<\/i>. Not only does the Obama Administration proceed on secular terms, but it suggests that the proponents of Proposition 8\u2013the supposed religious fanatics\u2013are also making secular arguments. You can read their appeal <a href=\"http:\/\/sblog.s3.amazonaws.com\/wp-content\/uploads\/2012\/08\/12-144-Hollingsworth-v.-Perry-Cert-Petition.pdf\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">here<\/a>; it\u2019s actually pretty secular, if I may say so myself. The Justice Department names three of these secular arguments: a) opposite-sex marriage advances \u201can interest in responsible procreation\u201d because \u201conly heterosexual couples can produce \u201cunintended pregnancies\u201d (p. 7), b) same-sex marriage should be pursued \u201cwith caution before departing from the traditional understanding of marriage\u201d (p. 8), and c) marriage itself should be left up to the \u201cdemocratic process\u201d (p. 9). These are <i>secular<\/i> arguments because they don\u2019t mention anything about the transcendent or metaphysical character of marriage; instead, they try to show that there are legitimate state interests at stake in keeping marriage between one man and one woman. The Justice Department then proceeds to poke secular holes in these secular arguments. First, they point out that the institution of marriage doesn\u2019t exist just to make kids legitimate. Second, they observe that Proposition 8 doesn\u2019t proceed with caution; as it bans same-sex marriage altogether. Third, they assert that equal protection is never subject to the democratic process because it\u2019s a constitutional right. The Justice Department then moves to the Voters\u2019 Guide, where they show that Proposition 8 fails even its own secular purposes of preserving tradition (the Administration argues that no opposite-sex marriages will be affected) and preventing kids from learning about it in school (the Administration points out that the text of Proposition 8 says nothing about education). In short, the heightened scrutiny that the Department of Justice applies demonstrates that at a <i>secular <\/i>level, Proposition 8 doesn\u2019t make sense on its own terms and is better described as stemming from \u201cimpermissible prejudice\u201d (p. 32).<\/li>\n<\/ul>\n<p>These observations raise several points for conversation. The Obama Administration frames the case as a secular one. This framing, of course, is nothing new. In fact, a key plank in the <a href=\"https:\/\/ecf.cand.uscourts.gov\/cand\/09cv2292\/files\/09cv2292-ORDER.pdf\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">original district court\u2019s decision<\/a> against the proponents, which basically affirmed the plaintiffs\u2019 arguments, was that the Yes on 8 campaign had advanced a \u201cprivate moral view\u201d with little interest to a common, secular public good.<\/p>\n<p>Call it secularism as we might, though, what the Obama Administration advances isn\u2019t what Charles Taylor would call a \u201csubtraction story,\u201d <i>i.e.<\/i> a case the Administration is actively trying to vacuum religion out of the public discussion. The <i>secular<\/i> here is contained in the rubric of <i>heightened scrutiny<\/i>. The Administration is pushing the court to ask what legitimate <i>state interest<\/i> Proposition 8 advances and what relation that has to the public contribution of all of America\u2019s citizens. They want to know why Proposition 8 has merit in a civil society where every citizen should be equal and why a government primarily interested in the contributions of its citizens, no matter who they are or who they privately love, should support it. The Obama Administration and its Justice Department are thus secular friends of a secular court discussing a secular case in which both sides have made secular arguments.<\/p>\n<p>In terms of religion, then, we have some things to discuss about the Obama Administration:<\/p>\n<ul>\n<li>If we take the <i>heightened scrutiny<\/i> rubric as the key to understanding how secular both sides of <i>Hollingsworth v. Perry <\/i>are, what different things could we say about the secularity of the Obama Administration?<\/li>\n<li>If we take re-define secularism through heightened scrutiny, how might we re-think how we hear Obama reading Scripture and doing theology?<\/li>\n<li>If we re-read the Proposition 8 proponents\u2019 case with heightened scrutiny on religion, what new insights might we come up with regarding their view on what religion is and what the relationship among religion, public participation, and views on sexuality is?<\/li>\n<\/ul>\n<p>The Department of Justice calls for \u201cheightened scrutiny\u201d for Proposition 8. Willfully plucking that legal term out of its contextual jargon, I\u2019ve tried to provide some religious scrutiny on the brief.
