{"id":862,"date":"2008-05-20T21:20:00","date_gmt":"2008-05-20T21:20:00","guid":{"rendered":"http:\/\/www.patheos.com\/blogs\/filmchat\/2008\/05\/expelled-copyright-lawsuit-update\/"},"modified":"2008-05-20T21:20:00","modified_gmt":"2008-05-20T21:20:00","slug":"expelled-copyright-lawsuit-update","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/filmchat\/2008\/05\/expelled-copyright-lawsuit-update.html","title":{"rendered":"Expelled &#8212; copyright lawsuit update"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p><span style=\"font-family: georgia\">More evidence that <i><a href=\"http:\/\/filmchatblog.blogspot.com\/2008\/05\/expelled-coming-to-canada-after-all.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Expelled: No Intelligence Allowed<\/a><\/i> may be coming to Canada on June 6:  The date apparently came up in court yesterday, as lawyers defended the film against <a href=\"http:\/\/filmchatblog.blogspot.com\/2008\/04\/newsbites-hobbit-demons-superman.html#4\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Yoko Ono\u2019s accusation<\/a> that they had violated her copyright by including a few seconds of John Lennon\u2019s \u2018Imagine\u2019 on the soundtrack, and the judge in that case has promised a \u201cfast decision\u201d because of the Canadian release date and other time-sensitive matters.<\/span><\/p>\n<p>To quote the <a href=\"http:\/\/www.macleans.ca\/article.jsp?content=e052091A\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">Associated Press<\/a>:<\/p>\n<blockquote><p>U.S. District Judge Sidney Stein said he will rule quickly in the case after both sides described the issues surrounding the song and movie in harsh terms during arguments on Monday.<\/p>\n<p>Lawyer <a href=\"http:\/\/cyberlaw.stanford.edu\/blog\/anthony-falzone\" target=\"_blank\" class=\" decorated-link\">Anthony T. Falzone<\/a> said the movie, \u201cExpelled: No Intelligence Allowed,\u201d was set to open in Canada on June 6 and DVD rights needed to be finalized by the end of May for distribution in October. The movie is currently being shown in about 200 theatres in the United States.<\/p>\n<p>He said an adverse ruling by Stein would mean \u201cyou have muzzled the speech of my clients\u201d because they would have to replace the song with other images, losing the chance to make the issue important enough that it could even influence the U.S. presidential campaign.<\/p>\n<p>\u201cIf you issue that injunction, you trample on these free speech rights and you put a muzzle on them and you do it in a way that stops them from speaking on this political issue leading up to the election,\u201d Falzone said.<\/p><\/blockquote>\n<p>Uh, wait a minute \u2026 the <i>election<\/i>?  Does anybody seriously think that the battle between Darwinian science and so-called Intelligent Design theory is really going to be a factor in the showdown between Barack Obama and John McCain?  Really?<\/p>\n<p>Besides, I repeat what I have said <a href=\"http:\/\/filmchatblog.blogspot.com\/2008\/05\/expelled-coming-to-canada-after-all.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">before<\/a>:  Shouldn\u2019t this movie be about the science, and not about partisan politics?<\/p>\n<p>Meanwhile, here is what Yoko\u2019s lawyer said:<\/p>\n<blockquote><p>Ono has accused the movie\u2019s producers of infringing the song\u2019s copyrights by using portions of it without her permission, giving the impression that the Lennon family had authorized it.<\/p>\n<p>Dorothy M. Weber, a lawyer for Ono, Sean Lennon, Julian Lennon and EMI Blackwood Music Inc., said the makers of the movie \u201ctook away their right to stay no.\u201d<\/p>\n<p>She said the defendants \u2013 Premise Media Corp. of Dallas, Rampant Films of Sherman Oaks, Calif., and Rocky Mountain Pictures Inc. of Salt Lake City \u2013 had obtained authorization for the other songs used in the movie, a point the judge noted himself. . . .<\/p>\n<p>About 20 to 30 seconds of the song are played in the movie.<\/p>\n<p>Falzone said the portion of the song \u2013 \u201cnothing to kill or die for, and no religion too\u201d \u2013 was central to the movie.<\/p>\n<p>\u201cWhat they are criticizing here, your honour, is they\u2019re saying that happy, naive feeling you get when you hear the song and think about peace and children and play is dangerous, dangerously naive.\u201d<\/p>\n<p>Falzone said the movie suggests \u201cthat this absence of religion paves the way for fascism, totalitarianism, Nazism.\u201d<\/p>\n<p>\u201cReally, what the film is doing is, it\u2019s asking if John Lennon was right and it\u2019s concluding he was wrong,\u201d the lawyer said.<\/p>\n<p>He said the movie makers did not believe they needed to ask Ono\u2019s permission to use a portion of the song because it was not the entire song or enough of it to infringe on the copyright.<\/p>\n<p>\u201cWhy would you ask somebody for permission to criticize their work?\u201d he asked. \u201cIt\u2019s not likely it\u2019s going to be granted.\u201d<\/p><\/blockquote>\n<p>Indeed.  In general, I would take the filmmakers\u2019 side on this one, to the extent that I think people should be free to <i>comment<\/i> on songs and films like this.
