{"id":16566,"date":"2013-09-09T06:00:59","date_gmt":"2013-09-09T10:00:59","guid":{"rendered":"http:\/\/www.patheos.com\/blogs\/geneveith\/?p=16566"},"modified":"2013-09-08T15:57:39","modified_gmt":"2013-09-08T19:57:39","slug":"lets-apply-just-war-theory","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/geneveith\/2013\/09\/lets-apply-just-war-theory\/","title":{"rendered":"Let&#8217;s apply Just War Theory"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p>As Congress and the nation as a whole decide on whether to attack Syria, let us take up the exercise of applying the guidelines for starting a \u201cJust War,\u201d according to Christian ethicists going back to St. Augustine.<\/p>\n<p>The criteria are listed after the jump.\u00a0 How would they apply to the current proposal to use cruise missiles to punish Syria for using chemical weapons?<\/p>\n<p>Even if a war would be just by these criteria doesn\u2019t mean it\u2019s necessarily a good idea, but let\u2019s see to what extent these ancient principles can offer guidance in a contemporary problem.<!--more--><\/p>\n<p>From\u00a0 <a href=\"http:\/\/en.wikipedia.org\/wiki\/Just_war_theory\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Just war theory \u2013 Wikipedia, the free encyclopedia<\/a>.:<\/p>\n<blockquote><p><strong>Just cause<\/strong><\/p>\n<p>The reason for going to war needs to be just and cannot therefore be solely for recapturing things taken or punishing people who have done wrong; innocent life must be in imminent danger and intervention must be to protect life. A contemporary view of just cause was expressed in 1993 when the US Catholic Conference said: \u201cForce may be used only to correct a grave, public evil, i.e., aggression or massive violation of the basic human rights of whole populations.\u201d<\/p>\n<div id=\"premium-content\">\n<p><strong>Comparative justice<\/strong><\/p>\n<p>While there may be rights and wrongs on all sides of a conflict, to overcome the presumption against the use of force, the injustice suffered by one party must significantly outweigh that suffered by the other. Some theorists such as Brian Orend omit this term, seeing it as fertile ground for exploitation by bellicose regimes.<\/p>\n<p><strong>Competent authority<\/strong><\/p>\n<p>Only duly constituted public authorities may wage war. \u201cA just war must be initiated by a political authority within a political system that allows distinctions of justice. Dictatorships (e.g. Hitler\u2019s Regime) or deceptive military actions (e.g. the 1968 US bombing of Cambodia) are typically considered as violations of this criterion. The importance of this condition is key. Plainly, we cannot have a genuine process of judging a just war within a system that represses the process of genuine justice. A just war must be initiated by a political authority within a political system that allows distinctions of justice\u201d.[20]<\/p>\n<p><strong>Right intention<\/strong><\/p>\n<p>Force may be used only in a truly just cause and solely for that purpose\u2014correcting a suffered wrong is considered a right intention, while material gain or maintaining economies is not.<\/p>\n<p><strong>Probability of success<\/strong><\/p>\n<p>Arms may not be used in a futile cause or in a case where disproportionate measures are required to achieve success;<\/p>\n<p><strong>Last resort<\/strong><\/p>\n<p>Force may be used only after all peaceful and viable alternatives have been seriously tried and exhausted or are clearly not practical. It may be clear that the other side is using negotiations as a delaying tactic and will not make meaningful concessions.<\/p>\n<p><strong>Proportionality<\/strong><\/p>\n<p>The anticipated benefits of waging a war must be proportionate to its expected evils or harms.
