{"id":22200,"date":"2015-09-22T05:30:07","date_gmt":"2015-09-22T09:30:07","guid":{"rendered":"http:\/\/admin.patheos.com\/blogs\/geneveith\/?p=22200"},"modified":"2015-09-21T22:03:32","modified_gmt":"2015-09-22T02:03:32","slug":"collective-bargaining-with-joint-employers","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/geneveith\/2015\/09\/collective-bargaining-with-joint-employers\/","title":{"rendered":"Collective bargaining with &#8220;joint employers&#8221;"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p>The National Labor Board has ruled that companies that subcontract parts of their operation or sell franchises to private operators are to be considered \u201cjoint employers.\u201d\u00a0 That means they may have to engage in collective bargaining with the unions that represent employees of the subcontractors or franchisees.<\/p>\n<p>But many subcontractors offer services to scores of companies!\u00a0 Must all of them have a say in what the smaller businesses pay their employees?<!--more--><\/p>\n<p>From <a href=\"http:\/\/www.oklahoman.com\/article\/5446657\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Labor board more than willing to carry out Obama\u2019s agenda | Oklahoman.com<\/a>:<\/p>\n<blockquote><p>The NLRB\u2019s five-member panel includes three Democrats, a majority that has produced a number of blatantly pro-union decisions during Obama\u2019s six-plus years in office. Perhaps that shouldn\u2019t be surprising, considering that roughly 90 percent of labor\u2019s political contributions have gone to Democratic candidates the past many years. But the board may have outdone itself with its \u201cjoint employer\u201d decision handed down late last month.<\/p>\n<div id=\"premium-content\">\n<p>In that case, the NLRB opened the door for companies that use subcontractors or have franchises to have to bargain with the unions representing the subcontractors\u2019 and franchisees\u2019 employees.<\/p>\n<p>Unions contend that employers rely increasingly on subcontractors and temp agencies in order not to have to collectively bargain. But as The Wall Street Journal noted in an editorial, \u201cmany employers would be contracting out work anyway. Why would a tech company want to manage its janitors?\u201d<\/p>\n<p>Good question. Under this new rule, businesses with only \u201cindirect\u201d control over workers could potentially be called to the negotiating table, which is a nightmare waiting to happen.<\/p>\n<p>The Journal noted that Apple, eBay and Yahoo have contracts with the same private bus service, whose employees are members of the Teamsters union. \u201cWould all these companies have to bargain individually with the Teamsters?\u201d the Journal wrote. \u201cWhat if they disagree? Could eBay\u2019s labor agreement override Apple\u2019s bus contract?\u201d<\/p>\n<p>In short, this ruling is sure to hobble business and will only add to the sort of uncertainty that has kept the economy coughing along at such a slow pace.<\/p>\n<p>The International Business Times said this ruling \u201cincreases the likelihood that parent companies can be held liable for labor violations committed by their partners further down the contracting chain.\u201d That\u2019s exactly what unions want, of course, and Obama\u2019s NLRB was only too happy to do their bidding.<\/p>\n<p>\u00a0<\/p>\n<\/div>\n<\/blockquote><\/body><\/html>\n","protected":false},"excerpt":{"rendered":"<p>The National Labor Board has ruled that companies that subcontract parts of their operation or sell franchises to private operators are to be considered \u201cjoint employers.\u201d\u00a0 That means they may have to engage in collective bargaining with the unions that represent employees of the subcontractors or franchisees.
