{"id":23034,"date":"2016-01-18T05:35:31","date_gmt":"2016-01-18T10:35:31","guid":{"rendered":"http:\/\/admin.patheos.com\/blogs\/geneveith\/?p=23034"},"modified":"2016-01-17T20:30:37","modified_gmt":"2016-01-18T01:30:37","slug":"so-is-marco-rubio-eligible-or-not","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/geneveith\/2016\/01\/so-is-marco-rubio-eligible-or-not\/","title":{"rendered":"So is Marco Rubio eligible or not?"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p>Now a lawsuit is claiming that Marco Rubio is not eligible to be president, under Article 2 of the Constitution, since neither of his parents were citizens at his birth.\u00a0 I would say that he is, since he was born in this country.\u00a0 Under the <a href=\"https:\/\/www.patheos.com\/blogs\/geneveith\/2016\/01\/so-is-ted-cruz-eligible-or-not\/\" class=\" decorated-link\" target=\"_blank\">common-law meaning being cited <\/a>for \u201cnatural born citizenship,\u201d a child born to illegal immigrants in the United States would qualify, while a child born to two American citizens in Canada would not.<\/p>\n<p>If \u201cnatural born\u201d requires that both parents be citizens, that would rule out George Washington and other early presidents who were born before the United States existed.<\/p>\n<p>At any rate, we need a clear definition of citizenship in its various permutations. This is true especially since we are in the midst of a controversy over immigration.\u00a0 A <a href=\"http:\/\/www.theatlantic.com\/politics\/archive\/2016\/01\/ted-cruz-citizenship-lawsuit\/424425\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">lawsuit has been filed <\/a>in Texas to get a ruling in the case of Ted Cruz.<\/p>\n<div id=\"premium-content\">\n<p>But read the discussion on our <a href=\"https:\/\/www.patheos.com\/blogs\/geneveith\/2016\/01\/so-is-ted-cruz-eligible-or-not\/#comments\" class=\" decorated-link\" target=\"_blank\">Ted Cruz post<\/a>, especially the remarks of Joe Olsen and DonS.\u00a0 Joe quotes this statute from 1790 (though Don says that the \u201cnatural-born\u201d language was dropped in the 1795 version):<\/p>\n<blockquote>\n<p class=\"style-scope twt-user-content\">\u201cChildren of citizens of the United States, that may be born beyond the sea, or out of the limits of the United States, shall be considered as natural-born citizens.\u201d 1 Stat. 103 (1790).<\/p>\n<\/blockquote>\n<p><!--more--><\/p>\n<p>From <a href=\"http:\/\/www.aol.com\/article\/2016\/01\/15\/marco-rubio-hit-with-birther-controversy-over-parents-citizensh\/21297590\/?icid=maing-grid7%7Cmain5%7Cdl19%7Csec1_lnk3%26pLid%3D788088559\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Marco Rubio hit with birther controversy over parents\u2019 citizenship \u2013 AOL<\/a>:<\/p>\n<blockquote><p>Republican presidential hopeful Marco Rubio is facing a new controversy as opponents allege he is legally unable to serve as president.<\/p>\n<p>The issue at hand \u2014 as Ted Cruz has learned well \u2014 is over whether Rubio can be consider a \u201cnatural born citizen.\u201d<br>\n<a href=\"http:\/\/www.tampabay.com\/blogs\/the-buzz-florida-politics\/rubio-seeks-to-dismiss-court-challenge-to-his-eligibility-to-be-president\/2261269\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Rubio\u2019s lawyers are in court this week<\/a> fighting claims he\u2019s not eligible because his parents weren\u2019t U.S. citizens until four years after his birth.
