Just in time for the new school year, a federal court has granted an injunction blocking the Obama administration\u2019s decree\u00a0that public schools must allow children to use whichever bathroom <\/a>corresponds to their self-chosen gender identity, rather than their biological sex. \u00a0The injunction will hold until the issue is decided in the courts.<\/p>\n

Months after the Obama administration advised school districts that transgender students should be given access to bathrooms based on their gender identity, a federal judge in Texas has blocked the guidance from going into effect \u2014 for now.<\/p>\n

U.S. District Judge Reed O\u2019Connor has granted a preliminary, nationwide injunction in response to a lawsuit filed by Texas and a number of other states.<\/p>\n

As we\u2019ve reported<\/a>, the lawsuit argues that the guidance from the White House would turn schools \u201cinto laboratories for a massive social experiment.\u201d<\/p>\n

The preliminary injunction would mean that, until that lawsuit works its way through the courts, the \u201cstatus quo\u201d would be maintained and the guidance could not be considered enforceable.<\/p>\n

The guidance from the White House was issued in May<\/a>, and addresses the Title IX requirement that schools receiving federal funding not discriminate against students on the basis of sex.<\/p>\n

The administration says that, as the departments of Justice and Education interpret the law, transgender students must be allowed to use a bathroom that corresponds to their gender identity. Alternately, individual bathrooms can be made available to all students.<\/p>\n

In their lawsuit, Texas and other states argue that references to \u201csex\u201d in Title IX refer only to biological sex, and that the administration\u2019s interpretation is a \u201cradical re-authoring\u201d of the term.<\/p>\n
