{"id":34244,"date":"2018-05-23T06:00:57","date_gmt":"2018-05-23T10:00:57","guid":{"rendered":"http:\/\/admin.patheos.com\/blogs\/geneveith\/?p=34244"},"modified":"2018-05-22T20:22:08","modified_gmt":"2018-05-23T00:22:08","slug":"a-bill-to-amend-the-religious-freedom-restoration-act","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/geneveith\/2018\/05\/a-bill-to-amend-the-religious-freedom-restoration-act\/","title":{"rendered":"A Bill to Amend the Religious Freedom Restoration Act"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p><a href=\"https:\/\/wp-media.patheos.com\/blogs\/sites\/305\/2018\/05\/6426695539_e77c978e71_o.png\" class=\" decorated-link\" target=\"_blank\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-34253\" src=\"https:\/\/wp-media.patheos.com\/blogs\/sites\/305\/2018\/05\/6426695539_e77c978e71_o.png\" alt=\"\" width=\"768\" height=\"383\"><\/a><\/p>\n<p>Leading Democrats in the Senate have introduced a bill that would amend the Religious Freedom Restoration Act (RFRA), so that it could not be used to protect Christians who refuse to approve of gay marriage and other LGBT causes.<\/p>\n<p>The RFRA was passed in 1993 as a bipartisan measure with overwhelming support, introduced by liberal Democrats Chuck Shumer and Ted Kennedy, and was signed into law by President Bill Clinton.\u00a0 <a href=\"https:\/\/en.wikipedia.org\/wiki\/Religious_Freedom_Restoration_Act\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">The act mandated t<\/a>hat \u201cGovernment shall not substantially burden a person\u2019s exercise of religion even if the burden results from a rule of general applicability.\u201d\u00a0 An exception is only allowed if two conditions are met:\u00a0 (1) In the\u00a0\u201cfurtherance of a compelling government interest.\u201d\u00a0\u00a0<sup id=\"cite_ref-Utter_5-1\" class=\"reference\"><\/sup>This is defined as an interest that is not just routine and is not just about improving government efficiency.\u00a0 Rather, it must directly relate to core constitutional issues.\u00a0 (2)\u00a0 Even then, the interest must be applied in \u201cthe least restrictive way.\u201d<\/p>\n<div id=\"premium-content\">\n<p>At the time, the law was mostly used to protect minority religions, upholding the right of Sikhs to wear turbans and Native Americans to use peyote.\u00a0 But today conservative Christians are invoking the law to protect themselves from being forced to be complicit in abortion,\u00a0 contraception, and same-sex marriage.<\/p>\n<p>Courts are currently considering how to balance religious liberty with anti-discrimination laws.\u00a0 They may well rule that non-discrimination is a \u201ccompelling government interest,\u201d though the \u201cleast restrictive\u201d clause might provide an out for wedding cake bakers and photographers who cannot, in good conscience, participate in a same-sex marriage celebration.<\/p>\n<p>But liberal Democrats today are not waiting for the issues to be resolved in a nuanced court ruling.<\/p>\n<p>From Julie Zauzmer, <a href=\"https:\/\/www.washingtonpost.com\/news\/acts-of-faith\/wp\/2018\/05\/22\/top-senate-democrats-introduce-bill-to-amend-religious-freedom-restoration-act\/?utm_term=.fd2412718e92\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Top Senate Democrats introduce bill to amend Religious Freedom Restoration Act<\/a><em>\u00a0 Washington Post:<\/em><\/p>\n<blockquote>\n<p data-elm-loc=\"1\">Prominent Senate Democrats introduced a bill Tuesday that would amend the 25-year-old Religious Freedom Restoration Act to prevent the law from being used to justify discrimination against people, including gay, lesbian and transgender citizens. . . .<\/p>\n<p data-elm-loc=\"6\">The Democrats\u2019 bill would amend RFRA to say that it does not protect the religious liberty of one person when the civil rights of another would be impinged. \u201cWhile our country was founded on the value of religious liberty, that freedom cannot come at the expense of others\u2019 civil rights,\u201d Sen. Mazie Hirono (D-Hawaii) said in a statement.<\/p>\n<p data-elm-loc=\"7\">A similar bill was introduced in the House in 2016 and 2017. The sponsors of the Senate bill include Hirono and Sens. Richard J. Durbin (Ill.), Dianne Feinstein (Calif.), Kirsten Gillibrand (N.Y.), Kamala D. Harris (Calif.), Patrick J. Leahy (Vt.), Edward J. Markey (Mass.), Jeff Merkley (Ore.), Bernie Sanders (I-Vt.), Elizabeth Warren (Mass.), Sheldon Whitehouse (R.I.) and\u00a0Ron Wyden (Ore.).<\/p>\n<p data-elm-loc=\"8\">The bill would add text to the 1993 law specifying that RFRA cannot counteract civil rights laws, employment law, protections against child abuse or access to health care.<\/p>\n<p data-elm-loc=\"8\"><a href=\"https:\/\/www.washingtonpost.com\/news\/acts-of-faith\/wp\/2018\/05\/22\/top-senate-democrats-introduce-bill-to-amend-religious-freedom-restoration-act\/?utm_term=.fd2412718e92\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">[Keep reading. . .]<\/a><\/p>\n<\/blockquote>\n<p data-elm-loc=\"8\">Now, of course, this bill doesn\u2019t have a chance in the current Republican-dominated Congress.\u00a0 But, as the article says, its primary purpose is to define the Democrats\u2019 position on the matter and to motivate their base.<\/p>\n<p data-elm-loc=\"8\">But if the Democrats do sweep to power, as is possible, this measure shows that they will brook no compromise.\u00a0 Notice how many possible Democratic presidential candidates are in the list of sponsors.<\/p>\n<p data-elm-loc=\"8\">The Democrats believe that the LGBT cause is so popular and the dissenters are so unpopular that this will be a winning issue for them.\u00a0 They might want to beware lest if they run too hard to the left, as they are apparently planning to do, that they may scare away ordinary voters.\u00a0 But maybe the public will rally to their side.<\/p>\n<p data-elm-loc=\"8\">At any rate, it appears that the Democrats plan to run not only against President Trump, but against conservative Christians.<\/p>\n<p data-elm-loc=\"8\">\n<\/p><p data-elm-loc=\"8\"><em>Photo:\u00a0 President Bill Clinton signing the Religious Freedom Restoration Act, from the National Archive via Flickr, Public Domain<\/em><\/p>\n<p data-elm-loc=\"8\">\n<\/p><\/div>\n<\/body><\/html>\n","protected":false},"excerpt":{"rendered":"<p>Leading Democrats in the Senate have introduced a bill that would amend the Religious Freedom Restoration Act (RFRA), so that it could not be used to protect Christians who refuse to approve of gay marriage and other LGBT causes.
