http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p>First of all, the Indiana legislature revised its legislation yesterday with an amendment\u00a0\u201cthat, while not outlawing anti-gay discrimination, clarified that the religious freedom law does not authorize such discrimination,\u201d which Governor Pence signed into law, according to the <a href=\"http:\/\/www.nytimes.com\/2015\/04\/03\/us\/indiana-arkansas-religious-freedom-bill.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">New York Times<\/a>. \u00a0The <a href=\"https:\/\/www.documentcloud.org\/documents\/1699997-read-the-updated-indiana-religious-freedom.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">actual text is here<\/a>, and the key elements are that (a) this law is neither an authorization to discriminate on the basis of a protected category, including sexual orientation, nor may it be used as a defense against a civil complaint, except (b) for a church \u201cor other religious nonprofit organization or society\u201d or a minister \u201cwhen the individual is engaged in a religious or affilated educational function of the church or other nonprofit religious organization or society.\u201d<\/p>\n<p>So, in other words, back to square one \u2014 except that Indiana doesn\u2019t have a law specifically providing protection against nondiscrimination based on sexual orientation, so strictly speaking the law doesn\u2019t mandate wedding-service providers to provide their services to all comers, so much as say that, if another law, or a judge based on application of current law, does so, then this law provides no recourse. \u00a0And what\u2019s more, the narrow protection for ministers seems explicitly to say that if you\u2019re a freelance wedding officiant, this protection doesn\u2019t apply to you.<\/p>\n<p>In the meantime, Memories Pizza has now <a href=\"http:\/\/www.gofundme.com\/memoriespizza\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">taken in $500,000<\/a> via a gofundme website (not established by them but by people affiliated with the\u00a0<span style=\"font-weight: 300; color: #000000;\">Dana Loesch Show. \u00a0So, we\u2019re good here, right? \u00a0The Left\u2019s current spin seems to be that they\u2019re just a bunch of crybabies in closing because of threats of arson or worse, because the threats weren\u2019t credible. \u00a0But beyond this: \u00a0are they at risk legally? \u00a0Most likely they will, upon reopening, face \u201ctesters\u201d requesting, in fact, gay-wedding catering; will they be subject to state fines based on current law, or a judge\u2019s finding?<\/span><\/p>\n<p>I suppose the bigger question is this, one I don\u2019t have the resources available to answer:<\/p>\n<p>So far, there\u2019s the florist, the baker, and the wedding photographer. \u00a0The florist has been ordered to create gay-wedding floral arrangements in the future, with a fine still pending (<a href=\"http:\/\/www.worldmag.com\/2015\/04\/washington_florist_fined_ordered_to_create_gay_wedding_arrangements\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">update here<\/a>). \u00a0The baker in question is at risk of a $150,000 fine due to the \u201cmental anguish\u201d of the denied couple (<a href=\"http:\/\/www.oregonlive.com\/business\/index.ssf\/2015\/03\/halfway_through_sweet_cakes_by.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">update here<\/a>), even after they closed down their business. \u00a0The Supreme Court refused to hear the wedding photographer\u2019s appeal last year (<a href=\"http:\/\/www.huffingtonpost.com\/2014\/04\/07\/supreme-court-gay-wedding-photography_n_5104699.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">see here<\/a>) but I can\u2019t figure out what the practical consequences were \u2014 the $7,000 fine was reportedly waived, but was she allowed to continue in business, or was her business shuttered, or was she told that this was the equivalent of a \u201cwarning shot\u201d and next time she\u2019d be made to suffer?<\/p>\n<p>That\u2019s three cases.<\/p>\n<p>Which either means that every other wedding provider who might have objected \u00a0has been cowed into providing services, or that virtually all gay and lesbian couples are respectful of those with beliefs opposing gay marriage and\/or select providers who have expressed support, or that other cases have found in favor of the provider, and these three are the exception. \u00a0I\u2019d like to say that it\u2019s the second of these explanations \u2014 but the anger being poured forth at Memories Pizza and at Indiana more generally, and the knee-jerk reaction by politicians, pundits, and corporations that, of course, Christian wedding-service providers are hateful if they hesitate, makes this unlikely.<\/p>\n<p>Which leaves the question unanswered: \u00a0why only these three
