The human cost of &#8220;fighting sexual assault&#8221; (plus bonus reflections on the legal system)"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p>(I originally wrote this post this morning, and am now re-writing it in light of additional reading and thinking.)<\/p>\n<p>Last weekend, I read and wrote about a <a href=\"https:\/\/www.patheos.com\/blogs\/janetheactuary\/2014\/09\/the-15-statistic-reading-source-document.html\" class=\" decorated-link\" target=\"_blank\">suspect study on college sexual assault<\/a>, and another on <a href=\"https:\/\/www.patheos.com\/blogs\/janetheactuary\/2014\/09\/a-new-cdc-report-crying-wolf.html\" class=\" decorated-link\" target=\"_blank\">sexual assault among women of all ages<\/a>. \u00a0Here\u2019s a real-life story, from the local news section of the Chicago Tribune: \u00a0\u201c<a href=\"http:\/\/www.chicagotribune.com\/suburbs\/arlington-heights\/chi-jeopardy-winner-child-sex-assault-20140903-story.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Local \u2018Jeopardy!\u2019 champ charged with child sex assault<\/a>.\u201d<\/p>\n<p>The basics of the story: \u00a0a 28-year-old former Jeopardy champion, now working as a security guard in Arlington Heights, in northwest suburban Chicago, met a 15 year old from Wisconsin on the job. \u00a0They arranged to meet in Lake Geneva, went to a movie together, then \u201cparked\u201d in the teenage sense of the term \u2014 that is, they made out in his car, and he got to second base: \u00a0\u201cPolice said Slowik and a 15-year-old Wisconsin girl were found topless in the back seat of a Hummer parked on a cul-de-sac near Lake Geneva in Wisconsin.\u201d <\/p>\n<p>As a result,<\/p>\n<blockquote class=\"tr_bq\"><p>Jerome Slowik, 28, was charged in Walworth County, Wis., with second-degree sexual assault of a child, according to Wisconsin court records. He is due in court next month on the felony charge, which was filed April 16, records show. If convicted, he could face fines of up to $100,000 and 40 years in prison, according to prosecutors.<\/p><\/blockquote>\n<p>And here\u2019s something a commenter on the Trib story had to say:<\/p>\n<blockquote class=\"tr_bq\"><p>I know this guy and the story. \u00a0 She told him she was 18. When they got caught he was not arrested because the police found no cause and mutual consent. He was free to go the police took her to a friends because mommy wasn\u2019t home. When the police called the next day and mommy found out she lied to save her ass. That\u2019s the story.<\/p><\/blockquote>\n<p>What do you make of this? \u00a0Is your gut reaction, \u201cthis man is a predator and should be locked up\u201d? \u00a0Or something else?<\/p>\n<p>Her\u2019e some background: \u00a0according to <a href=\"http:\/\/www.dailyherald.com\/article\/20131227\/news\/712279735\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">a report in the local Daily Herald<\/a>, the man won $122,000 on Jeopardy earlier this year, but he works as a security guard at the Mitsuwa Marketplace nearby, a \u201cshopping mall\u201d for Japanese ex-pats. \u00a0He had a perfect score on the SAT and a near-perfect ACT score, but didn\u2019t attend college. \u00a0He lives with his parents. \u00a0And he\u2019s an aspiring writer, with a self-published book \u00a0on Amazon (kindle only), Sandland, with two five-star (and improbable) and one one-star (and more believable) review. <\/p>\n<p>What do you make of this? \u00a0It seems more likely that he is, at best, naive, possibly with deficits that prevented him from attending college, maybe even (though I\u2019m hardly a professional) autism-like tendencies (that is, social-skill deficiencies), happy that a girl chatted him up, unable to see warning signs, not really able to truly perceive that there\u2019s a 13-year age difference, or even recognize that, when she said she\u2019s 18, if she did in fact say that, she was lying. \u00a0Look at the video clip of the Jeopardy-watching \u201cparty\u201d on the link above \u2014 he seems perfectly ordinary but it\u2019s a pretty small gathering at the bar.<\/p>\n<p>One also wonders how a 15-year-old from Wisconsin ended up at Mitsuwa in the first place. \u00a0Was she there with her parents, or on her own? \u00a0And was there some further context that led to this date at Lake Geneva (a resort town just north of the Wisconsin state line)?<\/p>\n<p>(Yes, it\u2019s possible that there\u2019s more to the story, that he has a habit of picking up teenage girls and deceiving them, \u00a0and he\u2019s just a jerk, but it doesn\u2019t seem to me to be the case.) \u00a0 <\/p>\n<p>So I looked up the details on the definitions and penalties we\u2019re looking at here.<\/p>\n<p>Here is\u00a0<a href=\"http:\/\/legis.wisconsin.gov\/lrb\/pubs\/ib\/01ib1.pdf\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">a document<\/a>\u00a0describing all of Wisconsin\u2019s sex crimes and penalties; this dates from 2009, and penalties seem to have been stiffened since then, if he\u2019s now looking at a maximum of 40 years instead of 30. <\/p>\n<p>Some surprises:<\/p>\n<ul>\n<li>In Wisconsin, even sex with a 16 or 17-year old is a crime, unless you\u2019re married. \u00a0A misdemeanor, and therefore not something to put you on the registry, but a crime nonetheless. \u00a0<\/li>\n<\/ul>\n<ul>\n<li>For younger teenagers, there\u2019s a differentiation between under 13s (first degree) and 13 \u2013 15 year olds (second degree), but \u201csexual assault of a child\u201d encompasses everything from \u201csexual contact\u201d (e.g., second base, even with clothes still on) to actual sex, and any such conviction earns you a spot on the sex offender registry, even if the judge sentences you lightly.<\/li>\n<\/ul>\n<ul>\n<li>And there\u2019s no exception for a teenager having sex with another teenager!\u00a0<\/li>\n<\/ul>\n<p>So what will happen to this man, when this goes to trial? \u00a0Strictly speaking, he is guilty. \u00a0The law says that, regardless of whether she gave every appearance of consenting, whether he believed she was older, whether she initiated the date, whether there was any risk at all that she\u2019d let him get past second base, he has in fact committed a felony.<\/p>\n<p>And a spot on the sex offender registry is life-destroying. \u00a0You\u2019ve read stories before, about men even younger than this, teenagers even, being on the list, and they\u2019re unable to live a normal life, to imagine having a family of their own someday. \u00a0 \u00a0There have been stories where men accept plea agreements, with the intent to avoid jail, not realizing that they will doom themselves this way. This is a penalty far in disproportion to the crime.<\/p>\n<p>Now, my initial point this morning was this: we all know the expression, \u201cyou can\u2019t make an omelette without breaking a few eggs\u201d (according to <a href=\"http:\/\/www.answers.com\/Q\/Who_first_said_you_can't_make_an_omelette_without_breaking_a_few_eggs\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Answers.com<\/a>, it was actually not Stalin but\u00a0Robespierre, in 1790, who first said this). \u00a0Do people understand that this is an illustration of the ruthlessness of dictators, not a maxim for how to build a just world? \u00a0The \u201ceggs\u201d being broken are real people whose lives are being ruined far out of proportion to their crime, in order, not to achieve justice, but to accommodate other people\u2019s desire to \u201cfeel safer.\u201d <\/p>\n<p>Then I found myself wondering, what would the outcome be in this case, or in similar cases with younger men, even teenagers? \u00a0Are the cases where boys receive these severe statutory rape penalties in the news because they\u2019re man-bites-dog, and most of the time prosecutors shrug off these cases, if there aren\u2019t circumstances that compound the crime? \u00a0 Will the charge be reduced to the misdemeanor that would apply if she were 16 instead of 15? \u00a0There\u2019s an article in <a href=\"http:\/\/www.thedailybeast.com\/articles\/2009\/03\/19\/the-teen-rape-double-standard.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">The Daily Beast<\/a> from 2009 about a 17-year old charged with felony statutory rape of his 14-year-old girlfriend, where, simultaneously, the same prosecutor charged a 17-year-old girl with a 14-year-old boyfriend with a misdemeanor, but I can\u2019t find anything with the outcome of that case.<\/p>\n<p>Would this situation, or a situation of a teenager with a 15-year-old girlfriend, be more just if we knew that these charges are routinely lowered to a misdemeanor unless it was known that he was acting in some \u201cpredatory\u201d manner? <\/p>\n<p>And what bugs me is this: \u00a0the law should be fair as written. \u00a0There simply should not be situations where no one enforces the law because everyone knows its unjust, or where the prosecutor uses the legal code to frighten individuals into a plea agreement, but no one intends for individuals to be convicted of the law as its found in the books.<\/p>\n<p>This goes for these sorts of \u201csexual assault\u201d cases. \u00a0And this goes for more routine situations as well. \u00a0Consider speeding, where it\u2019s generally a given that, on highways, for instance, the posted speed may be 65 or even 55, but cops don\u2019t care until you exceed 80 (except potentially if you\u2019re from out-of-state). \u00a0Of course, our situation with illegal immigrants, in which the government simply says, \u201cwe won\u2019t enforce the law.\u201d \u00a0And other situations in which the law seems to be nothing more than an arbitrary means of the government choosing when to intervene. \u00a0 <\/p>\n<\/body><\/html>\n","protected":false},"excerpt":{"rendered":"<p>(I originally wrote this post this morning, and am now re-writing it in light of additional reading and thinking.)
