As the debate about the Transportation Security Administration\u2019s screening procedures pings across the Internet, a\u00a0growing chorus of critics<\/a> is asserting that electronic imaging scans and \u201cenhanced pat-downs\u201d both represent an unconstitutional violation of the Fourth Amendment, which protects against unreasonable searches.<\/p>\n

\u201cEnough is enough. I should not have to submit to a digital strip search or being groped by a glorified security guard,\u201d writes commenter vrwc1 in a typical post on cnet.com. \u201cThis is the largest violation of personal privacy we\u2019ve ever seen.\u201d<\/p>\n

The choice to get on an airplane, the argument goes, is not probable cause for such invasive searches, nor does buying a ticket constitute consent to be subjected to a \u201cvirtual strip search\u201d and \u201cgroping,\u201d as critics call the two searches.<\/p>\n

For the courts, however, it is a matter of balancing personal privacy rights against public safety.<\/p>\n

\u201cAre the conditions that you\u2019re consenting to so draconian and so unreasonable that there\u2019s a Fourth Amendment problem?\u201d asks William Schroeder, a professor of law at Southern Illinois University at Carbondale. \u201cI don\u2019t think that argument is going to carry the day, given that people have hidden bombs on their bodies in ways that cannot be found through less invasive searches.\u201d<\/p>\n

\u2018You don\u2019t have to fly\u2019<\/h2>\n

At the heart of the issue is consent, says Professor Schroeder. Have people consented to this search, simply by buying a ticket? \u201cI certainly understand why people are not altogether pleased about it,\u201d says Schroeder, but \u201cyou\u2019ve consented. You don\u2019t have to fly \u2013 that\u2019s your choice.\u201d<\/p>\n

Others, however, suggest that the searches overreach. In order to pass the Supreme Court\u2019s test for constitutionality, searches must balance a \u201creasonable\u201d amount of privacy invasion against the likelihood of finding evidence of a crime.<\/p>\n<\/div>\n<\/blockquote>\n<\/body><\/html>\n","protected":false},"excerpt":{"rendered":"
