A Review Series of Anonymous Tip, by Michael Farris<\/strong><\/em><\/a><\/p>\n

Pp. 109, 110-111\u00a0<\/em><\/p>\n

Remember Sheriff\u2019s Deputy Wally Elrod, who delivered court papers to Gwen before Tuesday\u2019s hearing way back when? Well, he\u2019s back, and this time\u00a0Peter sent him subpoenas to serve!<\/p>\n

Sheriff\u2019s Deputy Wally\u00a0Elrod loved serving subpoenas on government employees. It was so easy.<\/p><\/blockquote>\n

It was easy because all Wally and to do was walk across the public safety building to various desks, rather than having to drive across town to people\u2019s homes.<\/p>\n

After Elrod gave Rita her subpoena (she was second after Officer Mark Donahue), we get this:<\/p>\n

She did not resent being served, but when Elrod made the mistake of asking if she was Mrs<\/em>. Coballo, her feminist ideology took over.<\/p>\n

\u201cI\u2019ll thank you for leaving your sexist titles to yourself. It\u2019s Ms. Coballo, if you don\u2019t mind,\u201d she fumed.<\/p>\n

Elroy raised his eyebrows and said, \u201cHope your broom is working well to fly you to court on Tuesday.\u201d He was two months from retirement and simply didn\u2019t care anymore.<\/p><\/blockquote>\n

Um. Yeah.<\/p>\n

Peter has Gwen call Donna and Rita witches, and then has the sheriff\u2019s deputy do the same, and this is supposed to be some sort of coincidence? Also, feminists are witches. Apparently. But this goes back to what I\u2019ve said before\u2014Gwen is divorced, but still goes by \u201cMrs. Landis,\u201d which appears to be a good and positive thing in Farris\u2019s eyes. Rita is upset at being called \u201cMrs. Coballo\u201d rather than \u201cMs. Coballo,\u201d and that, for Farris, clarifies her status as bad bad and very bad. As a married woman who goes by \u201cMs.\u201d instead of \u201cMrs.,\u201d all I can say is no thanks<\/em>.<\/p>\n

Anyway, now we turn to Mark Donahue.<\/p>\n

Corporal Donahue walked with his subpoena across the foyer of the Public Safety Building to the Office of the Prosecuting Attorney. The main floor of this huge building houses the Spokane City Police Department, the Sheriff\u2019s Department, and the Clerk\u2019s Office for the District Court.<\/p><\/blockquote>\n

And I\u2019ll spare you the rest, but Farris goes on to explain the sorts of cases held in the district court and the layout of the building.<\/p>\n

It seems that Gail\u00a0Willet, the prosecutor, had summoned Mark after learning\u00a0that he\u2019d received a subpoena. How she found out about the subpoena is unclear, because Farris also tells us that \u201cPeter had simply typed of the subpoena and had it delivered on the strength of his own signature as an officer of the court.\u201d Regardless, Farris is at pains to make sure that we know that Mark is one of the good guys. \u201cHe would rather be out on patrol,\u201d Farris tells us as he arrives at Gail\u2019s\u00a0office, \u201cbut he tolerated such matters as a necessary evil.\u201d<\/p>\n

Anyway, Gail\u00a0asks for his subpoena, looks it over, and then wonders what Peter\u2019s purpose was in sending it.<\/p>\n

\u201cWhat did you tell him during your interview?\u201d<\/p>\n

\u201cI can\u2019t think of anything he would be interested in. I pretty well just repeated my report. I reread it prior to the interview.\u201d<\/p>\n

\u201cDid he seem to focus on any particular issues?\u201d<\/p>\n

\u201cHe asked a lot about bruises. Asked me if I heard the CPS workers say anything about bruises.\u201d<\/p>\n

\u201cWhat did you tell him?\u201d Willet asked.<\/p>\n

\u201cThat I didn\u2019t hear them say anything directly one way or another.\u201d<\/p>\n

\u201cIs that it?\u201d Willet asked.<\/p>\n

\u201cAs far as I know. The only hard evidence I have about bruises is that I know nothing. I know nothing.\u201d He intoned the last phrase with a mock Germany accent to do his best Sergeant Schultz imitation from the old Hogan\u2019s Heroes<\/em> television show. Willet didn\u2019t get it and wouldn\u2019t have cracked a smile even if she did.<\/p><\/blockquote>\n

Funny, because for me Mark\u2019s statement brought this<\/em> to mind:<\/p>\n

\"you-know-nothing-06-0313-400x300\"<\/a><\/p>\n

Yes yes, I know, this book was published\u00a0in 1996! What Mark was referring to, apparently, was this bit<\/a> from Hogan\u2019s Heroes<\/em>. Either way, we are informed once again that Gail\u00a0is both an elite ignorant of the culture and ways of the common people and entirely humorless. Yay.<\/p>\n

Anyway, as regular readers will know, Peter issued a subpoena for Mark because Mark said he had thought Donna and Rita hadn\u2019t found bruises, because Donna had told Gwen she would dismiss the case if Gwen would only cooperate with a few questions. As I noted at the time and as multiple readers pointed out, this is actually very weak evidence. Donna could say that she\u2019d lied to Gwen to gain her cooperation, or that Mark misheard or misunderstood, and for his part Mark appears to be emphasizing his lack of knowledge one way or another.<\/p>\n

And in another example of Farris\u2019s tell-don\u2019t-show style, Farris tells us that later that morning Gail called\u00a0Dr. McGuire\u2019s report and called Dr. McGuire to go over a few questions. \u201cMcGuire was impressed with her insight,\u201d Farris tells us, without telling us what that insight was or what questions Gail\u00a0asked. \u201cIndeed she was a very competent lawyer.\u201d Well, okay then.<\/p>\n

Farris tells us that as Gail finished her preparations for the hearing she decided\u00a0against writing a trial brief, because the determining facto would be what was in \u201cthe best interest of the child\u201d and \u201cthe judge could reach that legal point automatically.\u201d By the end of the day,\u00a0all Gail had left to do was oversee \u201cthe exchange of the psychologists\u2019 reports on Monday morning.\u201d As Farris explains, Gail had arranged with Peter to give him Dr. McGuire\u2019s report on Monday at 10:00, refusing to hand it over on Friday as Peter had asked. Farris tells us that Peter concluded from this that Gail \u201cwas hard-nosed about everything.\u201d<\/p>\n

It seems Gail is both \u201ca very competent lawyer\u201d and \u201chard-nosed about everything.\u201d This has been Farris\u2019s description of her throughout\u2014whip smart, but stubborn. But as we saw at the ex parte hearing on Wednesday, when she refused to cede\u00a0a position simply to spite Peter and looked foolish when she lost, her stubbornness sometimes comes back to bite her. I\u2019m wondering how all this fits together, for Farris. For his part, Peter is described as a very good lawyer, but he also takes various ethical shortcuts, such as when he blackmailed Bill Walinski into signing paperwork making Peter Gwen\u2019s lawyer without ever contacting Gwen\u00a0as legally required.\u00a0For Farris, it appears, neither unhelpful\u00a0stubbornness nor ethical dubiousness gets in the way of one being a good lawyer<\/em>.<\/p>\n
