\"Neil_Gorsuch_and_Donald_Trump\"<\/a><\/p>\n

With the Republicans showing some spine and elevating Judge\u00a0Neil McGill Gorsuch\u00a0to the Supreme Court, there is reason to celebrate.\u00a0 Antonin Scalia\u2019s seat has been filled by someone who may be able to do it justice, if you\u2019ll allow the pun.\u00a0 Really, only time will tell, since we\u2019ve been burned before.<\/p>\n

Conservatives have a long tradition of being sorely disappointed in our Republican Presidents\u2019 selection: Richard Nixon selected Lewis Powell and Harry Blackmun; Reagan nominated Anthony Kennedy and Sandra Day O\u2019Connor; George H.W. Bush\u00a0 picked David Souter.\u00a0 Most recently, however, George W. Bush picked John Roberts.<\/p>\n

When the Supreme Court voted 6-3 in\u00a0King v. Burwell<\/em>\u00a0to uphold the subsidies undergirding Obamacare, Chief Justice John Roberts wrote the majority opinion, making it the second time he preserved Barack Obama\u2019s nation-debilitating health program.\u00a0 \u00a0In fact, when Justice Scalia wrote the dissent,\u00a0<\/em>he accused the other justices of rewriting the law to make sure it was upheld. \u201cWe should be calling this SCOTUScare<\/a>,\u201d he wrote.<\/p>\n

In other words, we should not be too jubilant over the Gorsuch.\u00a0 The best-case scenario is that we\u2019ve held our ground after losing a great originalist on the Court. Hopefully, we\u2019ve replaced him with another meaning we haven\u2019t gained ground but have defended a position.\u00a0 Remember, this \u201cnew\u201d court has the same ideological balance as the court that gave us Obamacare and Obergefell.<\/p>\n
