{"id":114096,"date":"2019-11-08T00:52:50","date_gmt":"2019-11-08T07:52:50","guid":{"rendered":"https:\/\/admin.patheos.com\/blogs\/markshea\/?p=114096"},"modified":"2019-11-08T08:17:39","modified_gmt":"2019-11-08T15:17:39","slug":"ill-give-this-to-libertarians","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/markshea\/2019\/11\/ill-give-this-to-libertarians.html","title":{"rendered":"I&#8217;ll give this to Libertarians&#8230;"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p>Unlike an awful lot of \u201cprolife\u201d Catholics and other conservative white Christians, they are on the front lines when it comes to abolishing the death penalty, rather than fighting for this barbarity even against Holy Church herself.<\/p>\n<p>Here, for instance, is a <a href=\"https:\/\/conservativesconcerned.org\/conservativestatement\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">statement<\/a> from <a href=\"https:\/\/conservativesconcerned.org\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Conservatives Concerned About the Death Penalty<\/a> (a nationwide group of conservatives questioning whether capital punishment is consistent with conservative principles and values due to the system\u2019s inefficiency, inequity, and inaccuracy. Conservatives Concerned About the Death Penalty is a project of Equal Justice USA, a national, non-partisan, grassroots organization working to transform the justice system by promoting responses to violence that break cycles of trauma):<\/p>\n<blockquote>\n<p style=\"text-align: center;\"><strong>Statement of Support to End the Death Penalty<\/strong><\/p>\n<p>We have come to the conclusion that the death penalty does not work and can\u2019t be made to work, not in spite of our conservative principles, but because of them. There are many reasons why growing numbers of conservatives are questioning the death penalty. Some of us are concerned that instead of making us safer, capital punishment has proven to be a costly and ineffective government program. Others of us are concerned that the death penalty makes too many mistakes. Still others are concerned that the death penalty has no place in a culture seeking to promote life. In light of its track record, we call on our fellow conservatives to reexamine the death penalty and demonstrate the leadership needed to end this failed policy.<\/p><\/blockquote>\n<p>Significantly, and shamefully, of the 250 signatories to this statement, a mere six self-identify as \u201cprolife\u201d while 118 signatories identify as associated with Libertarian or Libertarian-related organizations (and that does not include Libertarian icon Ron Paul, who self-identifies as Republican).\u00a0 I suspect many more Libertarians are on the list in association with other organizations.<\/p>\n<p>Nobody, nada, not one single conservative among the signatories identifies as Catholic and opposed to the death penalty (though there may be some Catholics among them).<\/p>\n<p>The reason for this glaring absence is not far to seek.\u00a0 Just as they battled the Church tooth and claw to justify torture a decade ago and formed the leading theological shock troops for making war on the clear teaching of the Church in total defiance of the Magisterium, so conservative Catholics have tended to likewise make a name for themselves by their dogged advocacy of the death penalty in defiance of the Church, like this:<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/images-na.ssl-images-amazon.com\/images\/I\/51YL4NjVxqL.jpg\" alt=\"By Man Shall His Blood Be Shed: A Catholic Defense of Capital Punishment by [Feser, Edward, Bessette, Joseph]\"><\/p>\n<p>\u201cWell, Mark, you have to admit that opposition to the death penalty is a not a <em>de fide<\/em> teaching.\u00a0 So Catholics are free to ignore the pope on this as on all non-dogmatic teaching.\u201d<\/p>\n<p>No.\u00a0 They are not.\u00a0 Prudential judgment is not Catholicese for \u201cFeel free to make war on the authoritative teaching of Holy Church.\u201d\u00a0 And this is doubly true for conservative Catholics who have proven themselves so wrong about so much so many times for so long that their massive case of Dunning-Kruger Syndrome blinds them to the fact that only a complete and utter fool would trust their prudence over that of the Magisterium\u2019s teaching.<\/p>\n<blockquote><p>Among the principal duties of bishops the preaching of the Gospel occupies an eminent place. For bishops are preachers of the faith, who lead new disciples to Christ, and they are authentic teachers, that is, teachers endowed with the authority of Christ, who preach to the people committed to them the faith they must believe and put into practice, and by the light of the Holy Spirit illustrate that faith. They bring forth from the treasury of Revelation new things and old, making it bear fruit and vigilantly warding off any errors that threaten their flock. Bishops, teaching in communion with the Roman Pontiff, are to be respected by all as witnesses to divine and Catholic truth. In matters of faith and morals, the bishops speak in the name of Christ and the faithful are to accept their teaching and adhere to it with a religious assent. <strong>This religious submission of mind and will must be shown in a special way to the authentic magisterium of the Roman Pontiff, even when he is not speaking ex cathedra; that is, it must be shown in such a way that his supreme magisterium is acknowledged with reverence, the judgments made by him are sincerely adhered to, according to his manifest mind and will. (<a href=\"http:\/\/www.vatican.va\/archive\/hist_councils\/ii_vatican_council\/documents\/vat-ii_const_19641121_lumen-gentium_en.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\"><em>Lumen Gentium<\/em> 25<\/a>)<\/strong><\/p><\/blockquote>\n<p>In short, unless you can show a <em>damn<\/em> good reason why you think it is absolutely necessary to fight the Holy Father so that you can\u00a0<a href=\"https:\/\/www.innocenceproject.org\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">kill innocent people<\/a> in order to unnecessarily kill the guilty, then you should just be quiet.<\/p>\n<p>This is quadruply true if you have spent the past fifteen years lecturing everybody on the need to \u201cfocus on the non-negotiables like abortion\u201d while in fact focusing on making war on the Church for the Right Wing Culture of Death. You should listen to your own advice and try channeling that energy you used to devote to torture advocacy and currently devote to death penalty advocacy into actually defending the unborn. Don\u2019t be like William Barr, Opus Dei Celebrity Folk Hero, and pretend that you are making war on the Church\u2019s teaching in order to \u201cuphold Real Catholic faith\u201d:<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Barr: We must execute this man for the victims.<\/p>\n<p>Victim 1: Don\u2019t want this.<br>\nVictim 2: I\u2019ve petitioned Trump to prevent this.<br>\nProsecutor: Don\u2019t want this.<br>\nJudge: I\u2019ve regretted this forever.<\/p>\n<p>Barr: For. The. Victims.<a href=\"https:\/\/t.co\/vhpk2aE5Xu\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">https:\/\/t.co\/vhpk2aE5Xu<\/a> <a href=\"https:\/\/t.co\/W4ysOPfkCx\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">pic.twitter.com\/W4ysOPfkCx<\/a><\/p>\n<p>\u2014 John Pfaff (@JohnFPfaff) <a href=\"https:\/\/twitter.com\/JohnFPfaff\/status\/1189531031445090304?ref_src=twsrc%5Etfw\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">October 30, 2019<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>\u201cBut Mark! Barr\u2019s just upholding the law of the land!\u201d<\/p>\n<p>Really? Seriously? You are going with that? The personal consiglieri of the most corrupt enemy of the Constitution our Republic has ever seen cares about \u2018the law of the land\u2019?<\/p>\n<p>Okay. Sure. Fine. Super-Catholic Barr must obey Caesar rather than God\u2013cuz he\u2019s just doing his job (in between obstruction of justice for his Mob Boss). Whatevs.<\/p>\n<p>So you must likewise be super-outraged that Joe Biden was denied communion last week. He is, you know, also \u201cjust doing his job and obeying the law of the land\u201d (as <a href=\"https:\/\/www.theatlantic.com\/politics\/archive\/2017\/03\/neil-gorsuch-confirmation-hearing\/520425\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">GOP Neil Gorsuch calls <em>Roe v. Wade<\/em>).<\/a> Or did a I detect a whoop of glee from conservative Catholics when Biden got his comeuppance for putting the laws of man over the laws of God?<\/p>\n<p>All this \u201cHe was just obeying the law of the land\u201d junk is reserved by MAGA Catholics only for those who make open and naked war on the clear teaching of the Church when the GOP Cult of Trump does it.\u00a0 When Dems do it, they are (rightly) accused of putting the law of man over the law of God.<\/p>\n<p>At this point, it is customary for the Catholic Court Prophets to begin pettifogging over the fact that abortion is gravely and intrinsically immoral and capital punishment is not.\u00a0 Of course, if grave and intrinsic evil really mattered to them, the same people eager to execute would not have also spent the previous decade passionately defending torture (and still applauding for it when their god king and others use it as an applause line at conservative soirees).\u00a0 But the whole \u201cgrave and intrinsic evil\u201d thing is just a smokescreen.\u00a0 It\u2019s the same trick as invoking \u201cprudential judgment\u201d: the attempt to turn the Church\u2019s authoritative teaching into an elaborate and stupid game of \u201cSimon Peter Says\u201d in which the goal is not maximum love of God and neighbor but the bare minimum obedience to the moral law.<\/p>\n<p>This Minimum Daily Adult Requirement approach to the dignity of human life was, by absolutely no coincidence, the basis for one of the most popular conservative Catholic arguments for defying the Church on torture.\u00a0 It went like this:<\/p>\n<p>\u201cHey! According to Just War Teaching, we get to kill people in war and that\u2019s worse than torture.\u00a0 So why don\u2019t we get to torture them?\u201d<\/p>\n<p>Answer:\u00a0 Because we don\u2019t <em>get<\/em> to kill in war.\u00a0 We sometimes <em>have<\/em> to kill in war.\u00a0 And if killing can possibly be avoided, just war teaching says we must try to do that.\u00a0 That\u2019s why, the moment an enemy combatant becomes your prisoner you are not allowed to shoot him and must provide him three hots and a cot.\u00a0 Because he is a human being.\u00a0 And because he is a human being, you must not torture him either.<\/p>\n<p>The Church\u2019s essential development on the Death Penalty is simply this: \u201cDon\u2019t kill people if you don\u2019t have to.\u00a0 You don\u2019t have to, so don\u2019t.\u201d\u00a0 The Church need not declare (and hasn\u2019t) that the DP is gravely and intrinsically immoral to say that.<\/p>\n<p>In addition to that development, there are a bunch of side reasons that are also benefits to not killing people who don\u2019t need to be killed.\u00a0 These include:<\/p>\n<ul>\n<li>Not butchering innocent 14 year olds like <a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/george-stinney-jr-black-14-year-old-boy-exonerated-70-years-after-he-was-executed-9932429.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">George Stinney<\/a> in racist bloodlust.<\/li>\n<li>Not butchering roughly <a href=\"https:\/\/www.theguardian.com\/world\/2014\/apr\/28\/death-penalty-study-4-percent-defendants-innocent\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">4 out of 100<\/a> other innocent people in (still racist) bloodlust (since our gulag\u2013<a href=\"https:\/\/www.cnn.com\/2018\/06\/28\/us\/mass-incarceration-five-key-facts\/index.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">the largest one on planet Earth<\/a>, outstripping Stalin\u2019s, China\u2019s and North Korea\u2019s\u2013has a <a href=\"http:\/\/newjimcrow.com\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">massively disproportionate minority population<\/a>)<\/li>\n<li>Not becoming the sort of hypocrite who brags about being \u201cprolife\u201d while working to kill innocent people in their bloodlust to kill people who do not need to be killed<\/li>\n<li>Not becoming a Catholic who pridefully brags about their super-duper superiority to the Pope and the Church while making open and naked war on the Magisterium in their bloodlust to kill innocent people so they can kill people who do not need to be killed<\/li>\n<li>Not becoming a massive hypocrite who pretends they care about FutureHitler killing citizens when they argue for gun rights and then cheering when the state kills people they want dead.<\/li>\n<\/ul>\n<p>It will be noted that the last side-benefit\u2013curbing state power against the individual (including the power to tax)\u2013is really the driving issue for Libertarians.\u00a0 The statement above argues against it on\u00a0 a descending scale of reasons:<\/p>\n<ol>\n<li>Cost and efficiency<\/li>\n<li>Errors in sentencing<\/li>\n<li>Not prolife<\/li>\n<\/ol>\n<p>I\u2019m fine with Libertarians opposing the death penalty primarily for the least noble reason. The death penalty <em>is<\/em> expensive and inefficient.\u00a0 Morally, that\u2019s an argument similar to \u201cAx murder is primarily wrong because it gets blood on your clothes\u201d.\u00a0 But in the end it matters more <em>what<\/em> they do than <em>why<\/em> they do it.\u00a0 So I applaud them.<\/p>\n<p>Meanwhile, the tragedy is that, for the Greatest Catholics of All Time in their ongoing war with the Holy Father, the first four side-benefits in the bullet points above are of little or no interest. This demographic supports our brutal kidnapping Racist-in-Chief in huge percentages and thinks discussions of the overwhelmingly racist issues behind the death penalty are not a question related to the fifth commandment, but related to wussy pro-abort liberalism that needs to be reflexively pwned without a movement of the grey matter at every turn.\u00a0 And because they hate \u201cliberal snowflakes\u201d more than life or common sense, they don\u2019t even care about the Libertarian\u2019s worries about the state\u2019s expensive and inefficient taste for blood. It is more important to them to kill than it is to observe even the lowest form of prudence.<\/p>\n<p>Solution:\u00a0 Just stop wasting everybody\u2019s time fighting the Church for your cult of death and do what you say you want to do: focus on fighting abortion.\u00a0 You don\u2019t even have to spend time trying to abolish the death penalty.\u00a0 Just stay out of the way of decent people\u2013like Conservatives Concerned About the Death Penalty\u2013who are trying to abolish it.<\/p>\n<p>\u00a0<\/p>\n<\/body><\/html>\n","protected":false},"excerpt":{"rendered":"<p>Unlike an awful lot of \u201cprolife\u201d Catholics and other conservative white Christians, they are on the front lines when it comes to abolishing the death penalty, rather than fighting for this barbarity even against Holy Church herself.
