The ban, imposed in the name of France\u2019s sacred ideal of secularism, began with the argument that the burkini, representing Muslim modesty, was oppressing to women and impeded their rights, in a republic where liberty, equality and fraternity reigns supreme.<\/p>\n<p>Consider this for a moment \u2013 France touts itself as the champion of liberty, equality and fraternity. And yet several French cities saw fit to police women\u2019s rights to choose what they wanted to wear. Whereas decades ago women fought for the right to uncover and wear bikinis, now many were fighting for the right to cover.<\/p>\n<p>I\u2019ve been a proud owner and wearer of a burkini for six years now, and it has given me immense freedom to go where I want to go and do what I want to do, especially to be in the water with my eldest son, who is autistic and a big fan of oceans and pools. Modesty is important to me. It\u2019s important to many women, Muslim and not Muslim. Avoiding harmful UV rays is important to others. Still others have skin conditions that require them to avoid the sun.<\/p>\n<p>At the end of the day \u2013 my body, my choice.<\/p>\n<p>How lovely, that France\u2019s high court understood all this. How infuriating that it had to come to this. And to be sure \u2013 <a href=\"http:\/\/www.usnews.com\/news\/world\/articles\/2016-08-26\/the-latest-french-top-court-overturns-burkini-ban\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">it\u2019s far from over<\/a>, this burkini ban. Armed French police standing over her, forcing her to remove her tunic in plain sight of the public. Said members of the public hooting and hollering at her. Is this what we\u2019ve come to? Isn\u2019t that a form of violence against women?<\/p>\n<p>Said Qudsia Raja, policy director of the National Domestic Violence Hotline in a Facebook update: \u201cI can\u2019t seem to stop thinking abt [sic] what\u2019s happening in\u00a0<a href=\"https:\/\/www.facebook.com\/hashtag\/france?source=feed_text&amp;story_id=761087617684\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">#France<\/a>\u00a0as systemic rape institutionalized by the state \u2013 complete lack of consent; forcible removal of clothing and a violation of a woman\u2019s agency and personal space; and the use of firearms and law enforcement as a threat (power\/control dynamic). Absolutely there are Muslim countries (Saudi Arabia, Iran) that have laws in place in regards to women covering their bodies and hair. And yes, when activists and Muslim women grew outraged at the burkini ban in France (on top of banning the headscarf in public schools and institutions, the full face veil and in some instances, long skirts), it seemed logical to say \u2013 what about forced veiling in other countries?<\/p>\n<p>(I\u2019m not a fan of that either by any means. I believe in modest dressing for sure as something important to me and as a tenet of my faith. But I also believe in self-determination, and that how we live our faith is something between us and God.)<\/p>\n<p>Sheikh Yasir Qadhi offered this explanation that pretty much explains the dichotomy of the situation <a href=\"https:\/\/www.facebook.com\/yasir.qadhi\/photos\/a.10150091939643300.277936.19667888299\/10154099294583300\/?type=3&amp;theater\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">here<\/a>:<\/p>\n<blockquote><p>And by the way, I\u2019m tired of those who retort with, \u2018If Muslims don\u2019t like it, they can leave.\u2019<\/p>\n<p>Firstly, Muslim citizens are *just* as part of any nation state as anyone else is, so if *you* don\u2019t like Muslims in your country, *you* can leave, thank you.<\/p>\n<p>Secondly, last I checked, Saudi Arabia and\/or the Taliban\/and or Iran are *not* claiming secular liberalism and religious freedom for all. France, and Europe and the Western World, are. So don\u2019t bring in other lands with other systems of government as comparisons. If the Western lands claim to be liberal, their liberalism is independent of the laws of Saudi Arabia, so let them live up to it.<\/p>\n<p>Thirdly, the hypocrisy is clear. Towards the culmination of the fever pitch of outrage, Deputy Mayor of Nice (and president of the regional council of Provence-Alpes-Cote d\u2019Azur) Christian Estrosi <a href=\"http:\/\/www.theverge.com\/2016\/8\/25\/12637964\/france-burkini-ban-photo-nice-social-media\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">threatened to file a lawsuit<\/a> against anyone \u2013 <em>anyone<\/em> \u2013 who shared photos or videos of the police who enforced the burkini ban, saying the photos \u201cprovoke defamatory remarks and threats\u201d against police officers.<\/p>\n<p>Yes, really.<\/p>\n<p>The <em>real<\/em> lesson here, though, was about protecting the rights of the woman targeted by the police \u2013 the woman whose photograph of forced unclothing was shared by millions around the world via social media and other mediums. I shared the Daily Mail article with the photo myself. And later, in a discussion with other friends, some who wear a headscarf and others who don\u2019t, we all came to the conclusion that by sharing that photo, we were violating her privacy.<\/p>\n<p>I imagined if someone took a photo of me in a state of undress and shared it around the world, and how it would make me feel. Something to remember the next time we come across a situation like this. How can they actually ban a burkini (or a headscarf or a \u2026) and say it was for the benefit of women? (France\u2019s Prime Minister Manual Valls said the ban was to break free of the \u201censlavement of women\u201d while Cannes Mayor David Lisnard said \u201cThe burkini is the uniform of extremist Islamism, not of the Muslim religion.\u201d) Wasn\u2019t this against the law?<\/p>\n<p>Well, France\u2019s highest court has overturned the ban, but here is a breakdown of how the European Court of Human Rights allowed for this to happen in the first place, and the difficult place it puts French Muslims in, <a href=\"http:\/\/www.nytimes.com\/2016\/08\/24\/opinion\/when-a-swimsuit-is-a-security-threat.html?_r=0\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">courtesy of lawyer Asma T. Uddin<\/a>:<\/p>\n<blockquote><p>Mr. Valls and Mr. Lisnard perfectly summed up the two contradictory public order rationales that European courts all the way up to the\u00a0<a href=\"http:\/\/topics.nytimes.com\/top\/reference\/timestopics\/organizations\/e\/european_court_of_human_rights\/index.html?inline=nyt-org\" target=\"_blank\" class=\" decorated-link\" rel=\"nofollow\">European Court of Human Rights<\/a>\u00a0use when dealing with Muslim women in religious garb. According to Europe\u2019s highest court of human rights, Muslim women in head scarves and burqas are simultaneously victims, in need of a government savior, and aggressors, spreading extremism merely by appearing Muslim in public.<\/p>\n<p>Article 9 of the European Convention on Human Rights is the key provision, and it lays out a broad conception of \u201cthe right to freedom of thought, conscience and religion\u201d in the 47 member states of the Council of Europe; this includes the right of a person \u201cin public or private, to manifest his religion or belief, in worship, teaching, practice and observance.\u201d However, a further clause allows for exceptions \u2014 limits on the manifestation of belief as \u201cnecessary in a democratic society in the interests of public safety, for the protection of public order, health or morals, or for the protection of the rights and freedoms of others.\u201d<\/p>\n<p data-para-count=\"452\" data-total-count=\"2948\">Unfortunately, the European Court of Human Rights has shown time and again that a challenged state can satisfy these exceptions largely in the strength of unsubstantiated stereotypes (the notion of a burkini as a type of jihadist \u201cuniform\u201d comes to mind). Image source: author<\/figcaption><\/figure>\n<p><strong>Why We Need to Realize the Bigger Picture<\/strong><\/p>\n<p>I\u2019ll leave the last word and lesson to two ladies who say it better than I. This is from Darakshan Raja, co-founder of the Muslim American Women\u2019s Policy Forum:<\/p>\n<blockquote><p>France hasn\u2019t banned structural Islamophobia or racism. Neither has it suspended its emergency laws that were put into place after the Paris attacks. If we speak about the policing of Muslim bodies, restricting spaces, banning communities, and institutionalizing discrimination, then it\u2019s important to name the larger systems at play here.<\/p>\n<p>The burkini ban has sadly not produced a larger conversation on how Muslim women\u2019s bodies are policed by the state within the larger structure of anti-Muslim racism in France. No one wakes up out of the blue and states today I feel like banning the niqab, veil or the burkini. If things have been able to get that far, it means there is already a larger system in place that is socially acceptable.<\/p>\n<p>This is why the sole focus on policing women\u2019s bodies and false equivalences between Muslim-majority states forcing the hijab\/niqab have served as a derailing tactic to take the attention away from the larger environment in France. Somehow anytime Muslim women\u2019s status is brought up in Western countries, people continue to bring the attention back to Muslim-majority states and are comparing lived realities in ways that are counterproductive.<\/p>\n<p>This is why solely focusing on policing of women\u2019s bodies globally or just Islamophobia, without connecting the two and linking it to state violence, mischaracterizes the problem. The policing (literal sense) of Muslim women\u2019s bodies in France has to be placed within the larger context of structural Islamophobia, state emergency laws, and the suspension of rights.<\/p><\/blockquote>\n<p>And this is from Rim-Sarah Aloune, a French citizen and Ph.D candidate who spoke out heavily against the ban:<\/p>\n<blockquote><p>It is disturbing to see all of these hardcore French nationalists claiming that Muslims are taking over France, THEIR country, THEIR culture, THEIR Christian roots (Sic).<\/p>\n<p>These folks did not seem to be bothered by the fact that they brought the first generation of these so dangerous \u201cMuslims\u201d from former French colonies in France to build the country in the 60s, to do the job that \u201ctrue real decent\u201d French would not do. But the \u201cFatima\u201d and the \u201cMohammed\u201d were supposed to remain hidden from the public space, because they built the country, but they could not be part of it.<\/p>\n<p>People have such a short memory.<\/p>\n<p>In other news, one of Fran\u00e7ois Hollande\u2019s assistant wore a headscarf\u2026.while being part of the delegation visiting the Vatican. I haven\u2019t heard from extremist secularists and \u201cTrue French\u201d yet.<\/p><\/blockquote>\n<p>Talk amongst yourselves,
