{"id":29391,"date":"2015-03-30T09:40:03","date_gmt":"2015-03-30T13:40:03","guid":{"rendered":"http:\/\/admin.patheos.com\/blogs\/exploringourmatrix\/?p=29391"},"modified":"2015-03-30T09:40:03","modified_gmt":"2015-03-30T13:40:03","slug":"does-iu-have-the-legal-right-to-prohibit-discimination","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/religionprof\/2015\/03\/does-iu-have-the-legal-right-to-prohibit-discimination.html","title":{"rendered":"Does IU Have the Legal Right to Prohibit Discimination?"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p>I was proud when I read <a href=\"http:\/\/news.butler.edu\/blog\/2015\/03\/rfra\/\" class=\" decorated-link\" target=\"_blank\">the statement by Butler University\u2019s president Jim Danko about the \u201cReligious Freedom Restoration Act.\u201d<\/a><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-29394 \" src=\"https:\/\/wp-media.patheos.com\/blogs\/exploringourmatrix\/files\/2015\/03\/Butler-University-open-for-everyone-300x300.jpg\" alt=\"Butler University open for everyone\" width=\"264\" height=\"264\">When I then <a href=\"http:\/\/www.indystar.com\/story\/news\/education\/2015\/03\/29\/butler-president-speaks-religious-freedom-bill\/70628622\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">saw<\/a> that <a href=\"http:\/\/news.iu.edu\/releases\/iu\/2015\/03\/rfra-mcrobbie-statement.shtml\" class=\" decorated-link\" target=\"_blank\">the president of IU Michael McRobbie had alsod issued a statement<\/a>, I found myself wondering about it in relation to the law.<\/p>\n<p>The statement says, \u201c<span style=\"color: #352d22\">we will not tolerate discrimination on the basis of any of these same factors. \u201c<\/span><\/p>\n<p>Butler is a private institution, with a religious heritage even if not a religious affiliation. As a legal \u201cperson\u201d it may have its\u00a0rules protected under the RFRA, as expressions of religious convictions.<\/p>\n<p>But IU is a state institution, and I could well see an attempt by IU to enforce non-discrimation to lead to a lawsuit from a student. Indeed, that seems to be the very purpose of the RFRA.<\/p>\n<p>The IU statement then goes on to say, \u201c<span style=\"color: #352d22\">These are not merely words written in a policy and soon forgotten. These are core values by which every member of the Indiana University community is expected to treat his or her fellow colleagues, students and visitors.\u201d<\/span><\/p>\n<p>I would love to hear from legal experts on this. Can\u2019t a student who falls afoul of this policy at IU claim that it is having its religious freedom burdened by the state through IU, and bring a lawsuit which \u2013 thanks to the RFRA \u2013 might well be successful?<\/p>\n<p>If you haven\u2019t seen it yet, please do watch <a href=\"http:\/\/abcnews.go.com\/Politics\/indiana-gov-mike-pence-controversial-religious-freedom-law\/story?id=29985752\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">the video of Governor Mike Pence\u00a0refusing to answer a direct yes or no question when asked by George Stephanopoulos<\/a> whether discriminating against gays and lesbians should be legal in Indiana. His refusal to simply answer \u201cno\u201d says it all. If you had any doubts about just how sinister the motivation behind this legislation is, this should make things unambiguously clear.
