{"id":822,"date":"2014-03-20T08:15:00","date_gmt":"2014-03-20T08:15:00","guid":{"rendered":"http:\/\/admin.patheos.com\/blogs\/rhetoricraceandreligion\/2014\/03\/should-the-bible-trump-americas-laws.html"},"modified":"2014-03-20T08:15:00","modified_gmt":"2014-03-20T08:15:00","slug":"should-the-bible-trump-americas-laws","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/rhetoricraceandreligion\/2014\/03\/should-the-bible-trump-americas-laws.html","title":{"rendered":"Should the Bible Trump America&#8217;s Laws?"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p><span style=\"font-family: Georgia, Times New Roman, serif\">As conservatives grapple with the reality of gay marriage and the Supreme Court weighs whether companies should be forced to offer birth control to employees, it\u2019s very clear: The conflict between religious freedom and gender\/sexual equality has become \u201cthe most important civil rights issue of this time.\u201d<\/span><\/p>\n<p>So says Professor  <a href=\"http:\/\/www.law.columbia.edu\/fac\/Katherine_Franke\" class=\" decorated-link\" target=\"_blank\">Katherine Franke<\/a>, director of the  <a href=\"http:\/\/web.law.columbia.edu\/gender-sexuality\/faculty\/katherine-franke\" class=\" decorated-link\" target=\"_blank\">Center for Gender and Sexuality Law at Columbia Law School<\/a> and one of the driving forces behind the school\u2019s Public Rights\/Private Conscience Project, a new initiative that seeks to shift the way people look at religious and secular values \u2014 and to bridge a divide that has come to seem insurmountable. Here, Franke talks with ProPublica\u2019s Sex and Gender reporter, Nina Martin.<br><\/p>\n<div><span style=\"font-family: Georgia, Times New Roman, serif\">NM: Let\u2019s start with why these two things \u2014 religious belief and civil rights \u2014 have come to seem so at odds.\n<p>KF: Part of the problem is the way we\u2019re currently framing the issue. On the one hand, we have the free exercise of religion, which is largely based in an appeal to revelation, to the truths of religious texts and religious doctrine. And on the other hand we have rights of equality and liberty, which are based in rational arguments \u2014 what are people entitled to as a matter of their humanity because we should all be treated equally under law. It\u2019s an incommensurable confrontation between revelation and rationality. What ends up happening is that religion ends up like a trump card \u2014 you throw it down, it\u2019s a conversation stopper, and we don\u2019t know how to get out of this impasse. Law is really ill equipped for adjudicating between the claims of revelation and the claims of rationality.<\/p>\n<p>NM: How did we get to this point?<\/p>\n<p>KF: In part it\u2019s historical. Really since the late 19th century, when opponents of expanding notions of equality have lost in the public arena, their plan B has been to seek refuge in religion. We first saw it in racial equality cases, and more recently in the areas of reproductive rights and gay rights. When Congress or a state legislature or a federal court mandates the integration of public schools or upholds sex equality in the workplace or allows same-sex couples to marry, opponents of those efforts fall back on religion to say, \u201cYou can have those laws, they just don\u2019t apply to me.\u201d<\/p>\n<p>Read the rest <a
