{"id":16074,"date":"2010-01-29T12:28:53","date_gmt":"2010-01-29T16:28:53","guid":{"rendered":"http:\/\/www.firstthings.com\/blogs\/theanchoress\/?p=16074"},"modified":"2017-03-10T22:22:39","modified_gmt":"2017-03-10T22:22:39","slug":"weighing-obama-vs-alito","status":"publish","type":"post","link":"https:\/\/www.patheos.com\/blogs\/theanchoress\/2010\/01\/29\/weighing-obama-vs-alito\/","title":{"rendered":"If Obama v Alito were a murder trial -UPDATED"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><head><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><meta http-equiv=\"content-type\" content=\"text\/html; charset=utf-8\"><\/head><body><p><strong>Still lots of talk in the blogosphere about the president<\/strong> calling out a co-equal branch of government before the whole nation and then inciting another co-equal branch to jeer against it, and Justice Samuel Alito\u2019s reflexive, and unheard-only-lip-read reaction.<\/p>\n<p>I have followed with great interest the varying <a href=\"http:\/\/opinionator.blogs.nytimes.com\/2010\/01\/27\/justice-alitos-reaction\/?scp=2&amp;sq=linda%20greenhouse&amp;st=cse\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">opinions<\/a>, <a href=\"http:\/\/althouse.blogspot.com\/2010\/01\/glenn-greenwald-flails-absurdly-in-lame.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">arguments<\/a>, and <a href=\"http:\/\/www.professorbainbridge.com\/professorbainbridgecom\/2010\/01\/alito-at-the-sotu.html\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">thoughtful comments<\/a>.  I was particularly struck by Megan McArdle, though, <a href=\"http:\/\/meganmcardle.theatlantic.com\/archives\/2010\/01\/tit_for_tat.php\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">who wrote<\/a>:<\/p>\n<blockquote><p>I\u2019m sorry, I\u2019m having a really hard time getting worked up about Alito\u2019s \u201cbreach of protocol\u201d.  It\u2019s totally true that justices usually sit there like a stone.  On the other hand, president\u2019s don\u2019t usually call out said justices for being too wrapped up in that dumb first amendment\u2013much less call them out with statements that seem to be <a href=\"http:\/\/voices.washingtonpost.com\/postpartisan\/2010\/01\/on_alitos_state_of_the_union_h.html?wprss=postpartisan\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">unequivocally false.<\/a><\/p>\n<p>Using the state of the union as an opportunity to call out supreme court justices, who you expect will have to sit there impassively while you rake them over the coals is, well, kind of a jerk move.  And I\u2019m pretty sure it\u2019s not exactly traditional presidential protocol.  It certainly doesn\u2019t show \u201call due deference\u201d to the separation of powers, especially when it\u2019s followed by a pledge to pass more of the kinds of laws they\u2019ve just ruled unconstitutional.<\/p>\n<p>I\u2019m calling this one a draw. (H\/T <a href=\"http:\/\/pajamasmedia.com\/instapundit\/92729\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Insty<\/a>) <\/p><\/blockquote>\n<p><strong>Because I am a laywoman, perhaps I don\u2019t get how McArdle can end her stinging rebuke<\/strong> with a \u201cdraw.\u201d<br>\nObama is the President of the United States, and he had the pulpit, the microphone, the cameras and the attention of the whole chamber.  Alito was one robed judge among 7, barely noticeable in the crowd.  The president\u2019s remarks were premeditated.  The justice\u2019s muttering was reflexive.  One act meant to be both disrespectful and elicit a partisan response, the other was probably not even voiced at all and was meant to satisfy the justice\u2019s own sense of, well, <em>justice<\/em>.<\/p>\n<p>If we were talking about a murder, instead of a murmer, Alito would be facing a charge, probably, of involuntary manslaughter.  Obama, on the other hand: cold-blooded murder in the first degree:  weapon, means, motive, deliberation, calculation.<\/p>\n<p>Again, only as a laywoman, it seems to me that our constitutional scholar president, at the very least <a href=\"http:\/\/corner.nationalreview.com\/post\/?q=ZDcxNjNjNTlhNmQxZDYwYjNkOGJjZjkxZTZiMjI0NTg=\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">distorted the ruling<\/a> before the whole nation.  Which either means he is dumb or a demagogue, I don\u2019t know.  Some are saying demagogue, but since <a href=\"http:\/\/hotair.com\/archives\/2010\/01\/29\/obamateurism-of-the-day-199\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Ed Morrissey<\/a> and <a href=\"http:\/\/gatewaypundit.firstthings.com\/2010\/01\/former-constitutional-lawyer-makes-up-constitutional-quotes-during-sotu-address\/\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">Gateway Pundit<\/a> noticed the president kind of making up the constitution as he went along (nothing like counting on Americans to be stupid\u2026or something) maybe he is just not as smart as everyone thought.  Or, maybe he is a dumb demagogue, and not a smart one.<\/p>\n<p>I mean, in his SOTU address, Obama also proudly (and <a href=\"http:\/\/corner.nationalreview.com\/post\/?q=ZWVhZDY2Mzc4NTg3OWIyNTMwNjI4NjdiNmJjN2JjMzM=\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">rather nastily<\/a>) claimed that his administration was \u201conce again prosecuting civil rights violations\u201d, excepting those violations against <a href=\"http:\/\/washingtontimes.com\/news\/2010\/jan\/27\/legislator-seeks-panther-case-dismissal-probe\/?feat=home_headlines\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">voters<\/a> who have tried to  exercise their constitutional right and duty, only to be intimidated by a guy with a nightstick, whom the president and his justice department <a href=\"http:\/\/corner.nationalreview.com\/post\/?q=NmNkYmM2NDFkMTQ1NDM2NThmM2UzOGYwNzBkNzIxNTk=\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">refuse to prosecute<\/a>.<\/p>\n<p>So, maybe President Obama is confused about lots of things in the constitution and in the law.  Or maybe he spouts \u201cjust words.\u201d  Lots and lots of \u201cjust words.\u201d<\/p>\n<p>In any case, having watched every SOTU speech since I was ten years old, I agree with McCardle that Obama\u2019s making his remarks about and to the court \u2013 made when they were a captive audience unable to address his odd distortion and promise of legislative revenge \u2013 was \u201ckind of a jerk thing to do.\u201d  I have never trusted the president less.<br>\n<strong><br>\nUPDATE: In the comments section, \u201cZachriel\u201d writes:<\/strong><\/p>\n<blockquote><p><em>Bush, State of the Union 2004: \u201cActivist judges, however, have begun redefining marriage by court order, without regard for the will of the people and their elected representatives.\u201d<\/em><\/p><\/blockquote>\n<p><strong>I think reasonable, thoughtful people who debate<\/strong> should be able to make distinctions, particularly when they are not exactly <em>fine<\/em> distinctions. Let us stipulate -as the left has, for several days now, and the right has agreed- that the separate branches of government <em>may<\/em> speak to each other and <em>about<\/em> each other. Having so stipulated, it seems to me to be rather a large difference between a president making a very broad remark about a general trend of the court, vs a president <em>citing<\/em> a specific ruling, <em>distorting<\/em> that ruling, <em>instructing<\/em> his party to <em>legislate<\/em> in a manner that will overturn that ruling and get them on their feet <em>jeering<\/em> at the court.<\/p>\n<p>Yes. I would say there is a very big difference between what Bush did, and what Obama did.<\/p>\n<p><strong>While we\u2019re at it, I wonder when the left is going to realize<\/strong> that validating the actions of President Obama by bringing up the actions or near-actions of a president whose every move they despised does not really help them in their defense. I can\u2019t tell you how many emails I\u2019ve had from people on the left who say, <em>\u201cyou complain about spending, but Bush spent a lot!\u201d<\/em> Yes, he did, and most on the right (me included) decried it. But let us not forget that the <em>Democrats<\/em> wrote the budgets and <em>voted for the spending<\/em> that Bush signed. Let us not forget, further, that if Bush spent far too much, then Obama\u2019s spending far, far, far more, cannot be justified by saying \u201cBush did it.\u201d<\/p>\n<p>It is a crazy way to live -saying what your guy is doing is okay, because the guy you thought was an evil moron did it first \u2013 it is cognitive dissonance to the nth degree. And when the argument is used in this case, citing one president\u2019s broad statement against another president\u2019s focused and narrow admonishment, well\u2026it doesn\u2019t work at all.<\/p>\n<p>Little Miss Attila <a href=\"http:\/\/littlemissattila.com\/?p=13199\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">has more<\/a>.<\/p>\n<p><strong>On a related topic<\/strong>, how far does Pelosi go before she becomes <a href=\"http:\/\/www.commentarymagazine.com\/blogs\/index.php\/wehner\/227211\" class=\" decorated-link\" target=\"_blank\" rel=\"nofollow\">\u201canti-Democratic\u201d<\/a>?
