Bail Set for Porn Star Accused of Sexually Assaulting Child June 8, 2019

A judge granted former porn star Mercedes Carrera bail in California after being held for more than four months without bail. Carrera, aka Melina Smith, was arrested in February for sexual assault on a minor child.

After four long months behind bars without bail, Mercedes Carrera could theoretically get out of jail. Judge Stephan G. Saleson heard arguments from both prosecutors and defense regarding bail for Carrera.

In February, police arrested Carrera and charged her sexually assaulting a minor child. Carrera admitted in an interview and through a media release that the victim in the case was her daughter. Carrera denied all the charges and instead, blamed her ex-boyfriend for coercing her daughter to admit to the abuse.

However, police raided the apartment Carrera shared with her boyfriend, Jason Whitney, and daughter in January. During the raid, authorities found evidence that matched statements made by the victim. Additionally, they found her bedroom set up with cameras and editing equipment.

Carrera denied the cameras and equipment were used to film any assaults on children. Rather, she insisted that her boyfriend used the electronics in his work as a film producer. She also admitted to using her room to film live webcams for customers.

Prosecutors in the case were not convinced by the couple’s denials and charged them with nearly a dozen felonies associated with the assault. They also added drug and gun charges because police found unregistered weapons and meth at the apartment.

At the time of the arrest, the judge denied Carrera a bail amount. Carrera told XBIZ news that she knew that she would be held until her trial. Nicole Fitzgerald, Jason Whitney’s attorney, asked the court to release the couple on their recognizance. Joshua Castro, Mercedes’ public defender, asked the court to set bail at $1.1 million.

On the flip side, prosecutors requested the court set the bail at $4.0 million for each defendant. After hearing arguments from both sides, Judge Saleson met them in the middle by setting bail at $2 million.

Despite having a bail amount, Mercedes Carrera is unlikely to bond out of county jail. She has not worked since January 2019. Additionally, in March she told XBIZ news that she and Whitney had liquidated nearly all of their assets to pay for their defense. With no money or collateral to secure bond, the couple will remain held until their next court date on July 17, 2019.

For the next trial date, the prosecutor will begin laying out the case against the couple. The prosecutor does not have to prove guilt in the preliminary hearing in July. Instead, the prosecutor has to establish probable cause for the case to continue.

Police involved in the investigation told XBIZ news that they are confident that there is more than enough evidence to support the nine charges against Carrera.

For now, Carrera remains in county jail. Since her arrest, she has not been allowed any contact with her daughter. Her daughter remains in the custody of her father. There are no details about her whereabouts or well-being at this time.
