A Moral Case for Military Commissions

When we grant greater rights to terrorists than we ever gave Japanese and German war criminals, we are not moral; we are preening fools. And deadly fools at that. We reward evil, punish good, and mourn the resulting dead—to what end? To congratulate ourselves at academic conferences? To score political points in electoral contests back home?

The message we must send the Taliban and al Qaeda—and the message Israel must send Hamas and Hezbollah—is quite simple: war crimes do not pay. We will not permit their deliberate violation of the law of war to deny us our right of self-defense. And the blood of every single innocent man, woman, and child killed because of their civilian disguise behind human shields falls on their heads, not ours.
