Oklahoma Bill Would Criminalize Abortion As First-Degree Murder

Oklahoma Republicans introduce a new bill that adds “killing an unborn child” to existing murder statutes.

Oklahoma Senator Joe Silk has introduced an unprecedented piece of legislation that would criminalize abortion as first-degree murder.

Silk’s bill, S.B. 1118, ads “killing an unborn child” to existing murder statutes, and states:

No person shall perform or induce or attempt to perform or induce an abortion after conception.

A person commits murder in the first degree when that person performs an abortion as defined by Section 1-745.5 of Title 63 of the Oklahoma Statutes.

Planned Parenthood of Oklahoma reports on S.B. 1118:

SB 1118 would ban abortion as early as 6 weeks, or once a fetal heartbeat can be detected. This law has been struck down as unconstitutional in other states, including Arkansas and North Dakota. This bill’s vague language could lead to requiring physicians to force a transvaginal ultrasound on any woman who seeks abortion care.

The bill stipulates that abortion is “the use or prescription of any instrument, medicine, drug or any other substance or device to intentionally kill an unborn human being” and gives protection to the “unborn” from the moment of conception.

S.B. 1118 is scheduled for a hearing on Tuesday before the Oklahoma Senate.

Bottom line: The bill is unconstitutional, and a complete waste of taxpayers time and money. However, the bill is red meat for the forced birth, pro-fetus, anti-abortion crowd, and will no doubt aid the fund raising efforts of those Republicans willing to pander to the lunatic fringe.
