It was obvious that this was coming. Josh Duggar isn’t denying he had paid sex with adult entertainer Danica Dillion, he’s now filed a lawsuit to ask the judge to dismiss her lawsuit according to the Daily Mail and Radar Online. His legal team seems to be saying in the documents that Josh doesn’t dispute having sex with Dillion outside of marriage or that he paid her for her services, but that Dillion hasn’t shown any evidence that she was somehow harmed by this transaction. Duggar’s attorney says because Josh didn’t intentionally try to inflict harm on her on purpose there’s not legitimate case. Hearing on January 21st to rule on this motion. From the legal papers:
“Assault requires both intent to place the Plaintiff in imminent apprehension of harmful or offensive contract and the Plaintiff’s actual imminent apprehension,” he wrote in the December 30 filing. “Plaintiff did not provide anything more than a formulaic recitation of the elements of assault and/or battery.”
The attorney then took a dig at her admission of prostitution.
“Her labels and conclusions are not adequate, particularly because she states that she consented to physical and sexual contact in exchange for payment.”
