A postmodernist judge

So we know that the Supreme Court nominee Sonia Sotomayor is a postmodernist in her legal theory. From Sotomayor’s View of Judging Is on the Record – NYTimes.com:

Judge Sotomayor questioned whether achieving impartiality “is possible in all, or even, in most, cases.” . . .She also approvingly quoted several law professors who said that “to judge is an exercise of power” and that “there is no objective stance but only a series of perspectives.”

Let us set aside for the moment the nominee’s politics, her race, and her legal opinions on other issues. Let us look just at these statements. I’d like to ask those on the liberal side–particularly tODD, Bass, Bob–if you are OK with that judicial philosophy. If so, would you be OK with it if a right wing judge held this position?

If so, what do you do with this verse?: “You shall do no injustice in court. You shall not be partial to the poor or defer to the great, but in righteousness shall you judge your neighbor” (Leviticus 19:15).
