Print What I Say, Not What I Do…

From the New York Times:

“The Obama administration has told a federal judge that military detainees in Afghanistan have no legal right to challenge their imprisonment there, embracing a key argument of former President Bush’s legal team….’Having considered the matter, the government adheres to its previously articulated position,’ wrote Michael F. Hertz, acting assistant attorney general.” These prisoners have been detained for years already and are suing under Habeus Corpus to be released.

This assertion comes at the same time that Vice-President Biden and Leon Panetta (CIA Director) continued to attack President Bush’s policies of not giving detainees their legal rights, including situations very similar to those mentioned above. Did these different elements of the Administration not speak to each other before arguing in disparate manners? If these positions are not in opposition, they are at least in uncomfortable tension.
