When your mother is a man and your father is a woman

When your mother is a man and your father is a woman August 18, 2014

Feminists make a distinction between “sex,” which has to do with biology, and “gender,” which has to do with culture; thus, gender roles are changeable and interchangeable with those of men, having nothing to do with an individual’s sex.  But now sex is held to be changeable too, determined not by reproductive organs or the DNA of every cell in a person’s body but by the individual’s choice, which can be reinforced by surgical and hormone treatments.  And transgendered (technically, transexed) individuals can marry each other.  And, if they do so before the surgeries are complete, have children.  So now there are children whose mother is now a man and whose father is now a woman.  The account of two cases after the jump. From Transgender Parents Speak Out About What Makes a Family – Shine from Yahoo Canada:

Bianca, 32, was born a boy named Jason, while her husband, Nick Bowser, 27, was born a girl named Nicole. They met and fell in love in 2009, before Nick’s gender transition, in Atlanta. Eventually, they decided to start a family, and Nick, still physically female (though he would eventually undergo breast-removal surgery), decided to carry Bianca’s babies — something he described to the Mirror as being “an absolutely horrible experience for me” because he already identifed as male.

“We have the parts so we will use them,” Bianca told the Mirror. “If we could change them we would, and they would be the other way around,” she said, referring to sex-reassignment surgeries that they both hope to undergo someday, “but we cannot afford it and the children come first.”

Now that their boys, Kai and Pax, are 3 and 1 respectively, the couple is beginning to grapple with how to explain that Mom was technically Dad and Dad was technically Mom. But, Bianca told Yahoo Health, “Our guts have always led us in the right direction.”

From Arizona’s ‘pregnant man’ has right to divorce wife, Reuters:

A transgender man who made headlines by giving birth to three children can divorce his wife of more than 10 years, an Arizona appeals court ruled on Wednesday, rejecting a lower court’s decision.

A three-member panel of the Arizona Court of Appeals unanimously decided that the divorce can proceed because Thomas Beatie’s 2003 marriage in Hawaii was considered legal in Arizona.

“As the Beaties’ Hawaii marriage was lawfully entered in Hawaii and is not deemed void by Arizona law, the marriage is valid within this state,” said Judge Kenton D. Jones, in the 12-page opinion.

The court’s decision overturns a ruling made in March 2013 by a Maricopa County Family Court judge that blocked the divorce.

Judge Douglas Gerlach denied the divorce on the grounds that Beatie had not shown he was a man when he wed in 2003, and thus could not show he and his wife were a heterosexual couple. Same-sex marriages are not recognized as valid in Arizona.

Beatie, 40, was born a woman, but has lived as a man since his 20s after hormone treatments and surgery to change his gender. Beatie was legally allowed to change his birth certificate and other documents to reflect his being a male.

He first gained notoriety after stopping the testosterone treatments and deciding to have a baby when his wife was unable to conceive because she had a hysterectomy.

He made the rounds of national talk shows as the man with the thin beard and baby belly when he first became pregnant and gave birth to a baby girl in 2008. Two other children followed in the next two years.

Beatie filed for divorce in 2012, seeking dissolution of his marriage with plans to marry his new girlfriend.

Beatie attorney David Michael Cantor said he hopes that the appeals court ruling goes beyond this one case.

“People are going to have to get used to the fact that transgender people exist and they deserve the same rights and responsibilities that everyone else have,” Cantor told Reuters.

“That includes the right to get married and the right to be divorced and the responsibilities that go along with all that.”
