Hollywood and Big Media are in a state of crisis over falling revenue, a writers and actors strike, and an upstart faith-based movie trouncing its stale remakes. The Left has a new legal theory called “popular constitutionalism.” And the truth about the coverup of Hunter Biden’s incriminating laptop is coming out.
Hollywood and Big Media in Crisis
“Traditional TV is dying. Ad revenue is soft. Streaming isn’t profitable. And Hollywood is practically shut down as the actors and writers unions settle in for what is shaping up to be a long and bitter work stoppage.”
That’s the grim assessment of business reporter Lillian Rizzo. To add insult to injury, a much-hyped expensive would-be blockbuster–yet another sequel to Indiana Jones–was trounced at the boxoffice by a crowd-sourced faith-based film about a crusader against child sex trafficking, The Sound of Freedom.
Some in the entertainment establishment reacted to the success of that movie, which cost $14.5 million but has brought in more than $100 million in only three weeks and has had good reviews, by accusing it of being made by conservatives, as if child sex trafficking is not a real problem.
Popular Constitutionalism
Conservative judges tend to follow the legal theory of “originalism,” which means that the constitution should be interpreted by the original meaning of its words and the intent of its authors. Liberal judges have had the theory of “the living constitution,” that our country’s foundational law should be interpreted according to the needs of our changing times.
That’s not quite radical enough for today’s progressives, especially given the Supreme Court’s current makeup, in which six of its nine members are some version of originalists. The left’s new doctrine of constitutional interpretation is being called by its chief theorist Harvard law professor Mark Tushnet “popular constitutionalism.”
Under this theory, the Supreme Court isn’t the only branch of government that can authoritatively interpet the Constitution. The President can do that too. Tushnet urges President Biden to just ignore the Supreme Court rulings on abortion and affirmative action. He should assert that those cases were wrongfully decided and that he, as president, has overturned them.
The problems with this are, of course, legion and, I hope, obvious. See these critiques of Prof. Tushnet’s idea: The Left Isn’t Even Pretending to Work within the American System of Government Anymore and, with a title that says it all, Harvard’s Mark Tushnet Wants Joe Biden to Become a Dictator.
Covering Up Hunter Biden’s Laptop
It is coming out that the FBI knew that Hunter Biden’s abandoned laptop computer, which was filled with incriminating evidence about his and his family’s corrupt dealings, was genuine. But then colluded with the array of intelligence experts who said that the laptop had the markings of a Russian disinformation plot. Whereupon the titans of social media shut down all talk about it, to the point of deplatforming The New York Post, which was publishing stories about it.
This collusion of the Department of Justice, the U.S. intelligence establishment, and the big tech corporations was all for the cause of helping Joe Biden beat Donald Trump, as opposed to the normal democratic process.
