With the DoJ’s threat to North Carolina, feds prove they aren’t interested in states’ rights

The will of the people in North Carolina is not the priority of the federal government, if the Department of Justice’s lawsuit against the state has anything to say about it.

Last week, the DoJ sent a threatening letter to Gov. Pat McCrory stating that the state is in violation of the federal Civil Rights Act if they didn’t abandon the implementation of H.B. 2, which, among other things, dictates that males use men’s rooms and females use women’s rooms. McCrory stood up to the federal bullies on Monday by filing a lawsuit against Attorney General Loretta Lynch and her Justice Department in demand that “clarity” be brought “to our national anti-discrimination provisions.”

Lynch countered with a lawsuit of her own, accusing McCrory, North Carolina legislatures, the state’s Department of Public Safety, and the University of North Carolina of “state-sponsored discrimination” against transgender individuals. Lynch stressed that the federal lawsuit seeks a statewide ban of H.B. 2’s implementation, along with the strong-armed threat to curtail federal funds from the state’s public safety department and UNC.

This is exactly the kind of thing I warned about last month when I wrote:

If the federal government does decide to carry through with their threats, they will be setting a precedent for years to come in every multi-faceted, grey area of politics — “do as we say, agree with us in every way, or you will be cut off.”

By forcing men and women to use the same bathrooms even after the people have spoken, the federal government will flush democracy down the toilet.

And so here we have a literal “Lynch mob” coming after the values of North Carolinians, coming after their constitutional rights and hindering public safety. Would that same “Lynch mob” be as swift, as David French wondered, to “intervene to defend the state from liability the first time a woman or child is assaulted in a bathroom by a man who was granted a legal right to be there?”

Sadly, the federal government is too drunk on its own power to ever do what’s right.
