Planned Parenthood Medical Director Filmed Selling Baby Body Parts July 14, 2015

“Laws are open to interpretation.”

That’s how Planned Parenthood’s Senior Director of Medical Services, Dr Deborah Nucatola, described the organization’s attitude toward federal law prohibiting partial birth abortion. This 2014 video shows Dr Nucatola engaging in conversation with someone she believed to be a Fetal Tissue Procurement organization.

She goes into grisly detail about the baby body parts that she will provide to buyers, and she names prices. She also explains her attitude — which, given her position, is probably also Planned Parenthood’s position — toward the federal ban on partial birth abortion. Here is what she said:

The Federal (Partial Birth) Abortion ban is a law, and laws are up to interpretation. If I say on day one, I do not intend to do this, what ultimately happens doesn’t matter.

In other words, the wording in the statute has a loophole that means it cannot be enforced unless the government can prove that the doctor deliberately intended to violate the law. Intent is a difficult thing to prove, as Dr Nucatola seems to know.

I think this is the portion of the statute that she is referencing. I put the verbiage that I believe Dr Nucatola probably believes supports her reasoning in bold.

Any physician who, in or affecting interstate or foreign commerce, knowingly performs a partial-birth abortion and thereby kills a human fetus shall be fined under this title or imprisoned not more than 2 years, or both. This subsection does not apply to a partial-birth abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the pregnancy itself. This subsection takes effect 1 day after the enactment.

(b) As used in this section—

(1) the term “partial-birth abortion” means an abortion in which the person performing the abortion—

(A) deliberately and intentionally vaginally delivers a living fetus until, in the case of a head-first presentation, the entire fetal head is outside the body of the mother, or, in the case of breech presentation, any part of the fetal trunk past the navel is outside the body of the mother, for the purpose of performing an overt act that the person knows will kill the partially delivered living fetus; and
(B) performs the overt act, other than completion of delivery, that kills the partially delivered living fetus; and
(2) the term “physician” means a doctor of medicine or osteopathy legally authorized to practice medicine and surgery by the State in which the doctor performs such activity, or any other individual legally authorized by the State to perform abortions: Provided, however, That any individual who is not a physician or not otherwise legally authorized by the State to perform abortions, but who nevertheless directly performs a partial-birth abortion, shall be subject to the provisions of this section.

It will be interesting to see if Dr Nucatola and Planned Parenthood will be prosecuted under this statute, given that it sounds as if Dr Nucatola has confessed on this video to deliberately violating it for profit. It will also be interesting to see if federal and state monies continue to go to Planned Parenthood in light of this video.

I’ve said before and I will continue to say that there is no reason why this money needs to go to Planned Parenthood to provide the services that the American public wants to continue. Many other organizations could provide pap smears and contraception. We also need to remember that Planned Parenthood teaches their philosophy to our children in our public schools under the guise of sex education. They receive large amounts of federal and state monies to indoctrinate our children in their death-dealing attitudes about human life.

I would also like to make the point that college-aged women who are targeted by egg harvesters are not protected by any law. These unethical doctors run ads in college newspapers to induce young women to undergo dangerous and damaging medical procedures so the doctors can harvest their eggs. The doctors to sell these eggs to researchers who use them to create embryos which are then killed and experimented on, or the doctors use the eggs to create babies that they then also sell. No doctor should be allowed to pay people to undergo unnecessary and dangerous medical procedures that are not in the patient’s best interests in order for the doctor to make money.

The barbarity of doctors making well people sick in order to harvest their bodies so the doctors can make money is one issue. It could easily be settled by simply making it illegal to pay women to undergo egg harvesting. All it would take would be to add egg harvesting to the statute prohibiting the sale of human body parts. The major reason this is not done is the lobbying efforts of the medical associations.

The issues surrounding the human rights violations inherent in using these eggs to create embryos for medical research or to create babies that are then sold on the open market like heads of lettuce should also be addressed. These baby-creating-selling clinics should be shut down and their operators put in prison. No doctor who makes well patients sick to make money for themselves should be allowed to practice medicine. No one should be allowed to buy and sell people.

Egg harvesters, abortionists and doctors who practice euthanasia are the ethical and moral twins of the doctor in Michigan who told well people they had cancer and then subjected them to cancer treatment in order to make money. I would also add the doctors who perform the procedure known as gender reassignment surgery on people who are mentally ill to this list.

The videos below were released by the Center for Medical Progress. I think their web site has been hacked. I was able to access it earlier today, but now I can’t. According to First Things,

The investigation was carried out by the Center for Medical Progress. According to their website, the “Center for Medical Progress is a group of citizen journalists dedicated to monitoring and reporting on medical ethics and advances.”

The video is the first by The Center for Medical Progress in its “Human Capital” series, a nearly 3-year-long investigative journalism study of Planned Parenthood’s illegal trafficking of aborted fetal parts. Project Lead David Daleiden notes: “Planned Parenthood’s criminal conspiracy to make money off of aborted baby parts reaches to the very highest levels of their organization. Elected officials must listen to the public outcry for Planned Parenthood to be held accountable to the law and for our tax dollars to stop underwriting this barbaric abortion business.”

I’m posting two videos. The first one is an edited version of Dr Nucatola’s conversation with what she thought were representatives of an organization seeking to buy baby body parts from Planned Parenthood. The second is the entire conversation, without editing.

  1. It is also illegal to make a surreptitious recording of a private conversation. I wonder if the guy who made the video will get away with it.

    • That depends entirely on state law. For instance, here in Oklahoma, it is legal to record so long as one of the parties agrees to it. It appears that one of the parties agreed to this. In any case, the abuse being revealed here push this video to the level of a public service.

      • I would agree with you if the video had been submitted to the proper authorities. Using it for rabble rousing does no service to the public.

        • I imagine that “if the video had been submitted to the proper authorities,” it would have been quashed. Such is the power of Planned Parenthood. Notice how they’ve gotten their talking heads in the major media marching to the same tune all across the board in a matter of hours? That’s power.

          And by the way, Sophia, lots of public monies are involved in this. The public as a right to know. In this instance, rabble rousing has another name. It’s called freedom of the press and freedom of speech.

          • The “pro-life” movement is shooting itself in the foot with this one. I would never want to restrain it from such a self-defeating maneuver.

            • Abortion laws restricting limits on gestational age are gaining momentum because of people like Gosnell and Carhart and now this little gem. The more people learn about what goes on in these clinics the more disgusted they get. This will be a hopefully self-inflicted mortal wound for PP. Maybe not immediately, but I think a slow and painful death may be coming for them. If their docs are in jail and the feds are forced to pull funding they won’t survive.

              • Even if Planned Parenthood were to be shut down, it would not stop people from helping women in need. Attempting to criminalize abortion is like attempting to criminalize alcohol. Good luck with that.

                  • Let’s see. There is animal husbandry. Some folks consider that to be murder. There is also cabbage farming. Another group of religious fanatics see that as murder.

                    • So you make absurd and illogical justifications for anything that suits you. Speaking of fanaticism.

                    • There is murder as defined by society and there is murder as defined by religious fanaticism. The two are not the same thing.

                    • Shrieking “religious fanaticism” is not an argument. And it speaks ill of your reasoning ability.

                      But since you can’t tell the difference between a baby and a head of cabbage, I’d say you are working in a kind of barbarism that concerns me far more than even Islamic fanaticism. That’s what we are really talking about: barbarian narcissism.

                    • The development of the embryo begins with the zygote. That does not mean that either a zygote or an embryo can be considered a living entity. One of the key words here is development. The infant develops from the fetus. The fetus develops from the embryo. The embryo develops from the zygote. The zygote develops from the ovum. The ovum develops from the woman.

                    • Actually, many states now recognize murderof a baby in utero as a crime.
                      We are not fanatics. We just recognize right and wrong.

                • Abortion is never help. It is damaging and dangerous. Over 60% of women who have had 1 abortion or more regret them. That is not help.
                  Just because some people do something does not make it right or good.
                  People know driving intoxicated is wrong and dangerous, but some still do it.
                  The only shooting I see here are holes in all of your arguments.

                  • Which is more effective at deterring drunk driving: criminalization or education? Religious fanatics rant about abortion, but they also rant against sex education. The latter is far more effective at preventing the need for abortion than attempting to deter the practice with criminalization.

                  • Please, just where is contraception difficult to come by? Plan B hangs on a rack at CVS, condoms are everywhere, women can get an implant for a couple hundred dollars, free if they have Medicaid, they can get a rx for bcp’s and they cost lest than $15 per month, regardless of the brand. And, you can get all those from a doc in the box, really cheaply.
                    So, where are contraceptives unavailable?

          • If you support freedom of speech then don’t filter out comments that you label as “propaganda”. Let your readers see what the breadth of public opinion really is.

          • Truth and compassion for the needs of women is the power behind the rally against the deceptive practices of the people that made these video’s. Even a catholic nun condemns these practices.
            I would like to hear a recording of the conversations it took to get the meeting set up. The rehearsed questions that could elicit unguarded “shop talk” from the doctors. Who bought the wine?? It’s called entrapment. This is coupled with pure deception to create material that can be misconstrued.

            • Pretty obvious there is no entrapment. Several different officials, including Cecile Richards have admitted that PP sells human tissue and organs under the guise of “expenses.” However the fourth video released has a couple of PP executives colluding. It sounds like a legal conspiracy to conceal information because they know what they are doing is illegal. Same thing a bunch of bankers did in the banking crisis, etc.
              These people are participating in abortion and choosing procedures that will most benefit them financially.
              Look, I know nothing I say will convince you, that only God can change your heart and I hope He does that.

Sad but not surprised since I remember reading about some Chinese vendors in parts of China who were selling aborted fetuses in jars as “power food.” It seems it was reported that they believe they could use the parts as a youthful elixir and aphrodisiac. That reports was out about six years ago but recalling it still boggles the mind and sickens the heart not to mention one’s stomach.

    So, I will post some links.
    Took me less than 10 minutes to find this. These companies sell human babies’ tissue for profit to use in “research.”
    How is this not human trafficking?

    • I wondered who was buying–because someone has to be. There’s going to be a lot of hue and cry over this, but will any of it be focused on the organizations who buy?

      • StemExpress is clearly worried that they’re going to get some attention. They pulled their social media pages down this afternoon and their website has been “down for maintenance” as well. But you can still view the order pages and information on becoming an affiliate clinic on the Wayback Machine and Google Cache.

        Now why would they do that if there was nothing to hide?

  5. I wonder if they can prove separate informed consent for donation of fetal tissue or if it’s buried in the fine print to get the abortion. Gruesome and disgusting as it is, I’m afraid it is common practice to allow the donation of tissue, including cord blood and placentas.

    The real problem here is whether getting the fetal tissue becomes an end in itself which leads to additional abuses of the mother and baby.

    • What mechanisms do we have in place to prevent this from becoming an issue, that is, the harvesting becoming an end in itself, when it comes to other types of tissue/organ donations?

  6. I think you have removed my prior post under a false assumption. I know you are interested in truth. The ban on trafficking body parts relates to transplantation, not the
    use of the tissue. No one is suggesting the parts are being transplanted
    are they? You need to see the issue as it is legally, not emotionally, or you will not have a solid argument to use against the people who will support PP on this.

    • I can’t find a comment of yours in the delete file, so I doubt if I deleted whatever you are talking about. However, I have a pretty short fuse where something as egregious as this is concerned.

      As for federal law on trafficking in body parts, I am somewhat familiar with it. You sound as if you are referring to the old statute from several decades ago. That specific federal law addresses inducing people to allow their bodies to be harvested of organs by paying them money. When I speak of amending a statute concerning payment for egg harvesting, that is the one I mean.

      I am not a prosecutor, but it sounded to me like the doctor in the video more or less confessed to violating several federal statutes, including selling the body parts of aborted babies, which is a specific felony in federal law. Also, the doctor sounds to me as if she’s saying that she deliberately performs partial birth abortions, which violates another federal statute.

      One would-be commenter on this blog tried to link to a post from another channel. The post attacked Christians, supported abortion and tried to explain away the revelations in this video. I didn’t read the article in full, but what I saw was inaccurate. That may be where these oddball ideas about federal law are coming from.

      Just for the record, I’m not inclined to allow a lot of propaganda in favor of what amounts to crimes against humanity on this blog. There are plenty of places which accept such things. But this isn’t one of them.

    • I see no ethical difference between killing human beings for transplantation and killing human beings for research.

      Legality? This country can’t even hold to the Declaration of Independence.

      I still think that legally, this nation is so far down the rabbit hole it can’t be recovered.

  7. Rebecca, could some of the Patheos bloggers put together a petition asking Obama, HHS, and Congress to investigate PP immediately? I desperately want a way to join in solidarity with others to DO something. As you noted, PP has the ability to marshall their supporters and get out the talking points rapidly. I think a petition widely publicized could be a way to respond to their media machine.

  9. Isn’t it amazing how Planned Parenthood claims it did nothing wrong, how the video was completely doctored — and yet they have issued an apology. Why would one apologize if one did nothing wrong. Fraulein Docktor Deborah Nucatola is the personification of evil and barbarism and has no place in the medical community.

      • Not name calling, merely a presentation of facts as well as an allusion to similarities with a well known country in Europe that was responsible for the outbreak of WWII. As to Fraulein Docktor — that is merely a German rendering of Ms. Doctor.

        Having said that, in the true spirit of civility and gentility, I sincerely, truly, deeply apologize for those whom I have offended, even those who support the execution and commoditization of babies.

  10. I see a continuation of the distortions of the facts in the video. A tissue donation where de minimis expenses are reimbursed is not “selling baby parts”.
    I also see that there is ongoing deliberate filtering and deleting of the comments acknowledged by the author and also some other reviewer discussing “making it through the filter”
    This is fundamentally anti-American behavior. Further indication of the dishonesty of the Pro-Life movement. It is fundamentally against the constitution of our country to attempt to deny people the right to practice their own religious beliefs and also to be free from the imposition of others religious beliefs upon them. You have a community of like minded people. Keep your beliefs to yourself. It is wrong to lie, distort, cheat and kill others to impose your beliefs.

    • I would say that anyone as blind to the facts of the PP scam to traffic in human parts and hide the profit is pretty obvious in the now, three videos. It’s all laid out, not edited.
      Amusing that you want to shut Rebecca, pro-life individuals and groups and anyone who disagrees with you up.
      You are right one one thing. “It is wrong to lie, cheat, and kill others to impose your beliefs.” Exactly right. That is what PP is doing and pro-abortioners are trying to do.
